This presentation will outline legal standards for survey research in trademark and trade dress litigation. The program will address how to design surveys that meet all required legal standards, including:
  • How to choose the proper survey participants;
  • How to develop questions that are not leading or biased;
  • How to properly measure confusion; and
  • How to choose survey stimuli that are truly representative of actual purchase or post-purchase situations.
