The Supreme Court has suggested divorce is a fundamental right; yet, for same-sex couples in Defense of Marriage Act (DoMA) states, access to this fundamental right is denied. Same-sex couples in numerous states are told by both attorneys and judges that they cannot terminate their legal marriages. Professor Morgan Holcomb, Associate Dean of Academic Affairs for Hamline University School of Law, will discuss the impact of the unequal administration of justice by the courts regarding same-sex divorce in light of DoMA as examined in her publications, "Wedlocked" and "Same-Sex Divorce in a DoMA State." Professor Holcomb's presentation will address subject-matter jurisdiction, due process, and equal protection issues in light of same-sex divorce and will educate attorneys and judges about how courts can grant same-sex divorces by applying current divorce statutes.
