February 20/San Francisco: Introduction to Family Law Training #MCLE

The Bar Association of San Francisco's Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.
This training will be given by VLSP’s Supervising Attorneys who will go over the volunteer procedures as well as the forms for completing a simple divorce. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site. February 21/Chicago+Web: #Ethics of Witness Preparation for Deposition and Trial #MCLE

Clifford Law Offices is sponsoring a free two-hour continuing legal education program on the ethics of witness preparation in the sixth annual Clifford Law Offices Continuing Legal Education Series. A number of hypotheticals will be presented to help attendees understand the ethics of dealing with witnesses for deposition and trial.
Should I first explain the law before asking the client what happened? Should I reveal other evidence and ask a witness her testimony? What are the differences between preparing a witness for deposition or for trial? These are some of the questions that will be answered.
Presenters will discuss the distinction between aiding a witness to make a point clearly versus how to avoid changing a witness’ presentation so that it is false or creates a false impression. The goal of the two hours is to improve the morality of a lawyer’s conduct and to emphasize that the lawyer must be fully prepared – know the theory of the case, the facts, the documents, prior statements of the witness. Be a good listener and don’t over advocate.
The Model Rules of Professional Conduct will be discussed.

January 29/NYC: #Antitrust Developments: An Ounce of Prevention Is Worth A Pound Of Cure

Part I of this program examines how Medco’s acquisition by Express Scripts was completed this year following eight months of antitrust investigation by the FTC and over 30 State AG offices, concerns raised by over 80 members of Congress, and a last minute private lawsuit.  Led by the attorneys for Medco this program will compare and contrast the successful Express Scripts/Medco transaction with the AT&T/T-Mobile deal (which foundered in the face of political opposition and challenges from government agencies and competitors).   We will discuss best practices for anticipating and defusing  issues that arise during regulatory review of transactions, for allocating antitrust or regulatory risk among parties, for dealing with concurrent federal and state investigations, and for coordinating media and political strategies with underlying legal strategies.
Part II addresses the question: How often have business executives or rank and file employees been stuck having to explain away “unfortunate language” in their own documents?  The problem has become even more acute as email plays into the hands of the impetuous writer.   This program will highlight ways to educate executives to convey their thoughts in a manner  that minimizes antitrust risk.   It will also outline strategies for neutralizing such documents if they already exist.

    February 8/Dallas: Ethical Obligations and Mentally Impaired Clients

    The typical attorney-client relationship is based on the assumption that the client is capable of making decisions about important matters related to his or her case. However, a typical relationship may not be possible when the client has a mental impairment. Model Rule of Professional Conduct 1.14 addresses an attorney's obligations when a client's capacity to make adequately considered decisions is diminished due to, among other things, a mental impairment. This presentation will address an attorney's ethical and related obligations to clients with mental impairments under Model Rule 1.14. ABA guidance regarding these obligations will also be discussed. Attendees will leave this presentation with a better understanding of how to balance the needs of clients with mental impairments and still fulfill their professional responsibilities.

    February 7/Saint Paul: Religious Discrimination in the Workplace #MCLE

    The course will focus on legal definitions and federal and state standards for religious discrimination claims and review the complaint investigation and resolution process for religious discrimination claims in Minneapolis. The speakers will present information on the prevalence of religious discrimination claims in Minneapolis.
    In addressing legal standards for religious discrimination, the course will present information on federal (EEOC) standards as well as Minnesota (Minnesota Human Rights Act) standards for reasonable religious accommodations in the area of employment. The course will focus specifically on the Minneapolis Civil Rights Ordinance, which locally enforces federal and state standards and establishes a complaint investigation process to review allegations of religious discrimination.     • Toni Newborn is currently serving as the interim assistant director of civil rights at the Minneapolis Department of Civil Rights. She graduated from William Mitchell College of Law in 2007 and became a licensed attorney in 2008. She is originally from Birmingham, Alabama and studied at Birmingham-Southern College receiving her undergraduate degree in Political Science. Prior to Newborn’s appointment as interim assistant director of civil rights, she served as an investigator in the Complaints Investigation Unit of the Minneapolis Department of Civil Rights; her duties included investigating complaints of racial, religious, disability, and other discrimination and reaching out to educate the community on diversity issues. She has presented numerous lectures, outreach events, and trainings in civil rights, diversity, disability awareness, religious accommodation, and many other diversity-related topics.
    • Seema Desai is currently employed as an investigator with the Minnesota Department of Civil Rights. She received her BA summa cum laude from the University of Minnesota where she majored in Gender, Women and Sexuality Studies and Asian American Studies.     February 7/Dallas: Disability Issues in Employment & Labor Law

    This program will help guide employers through the complex array of federal and state laws and regulations that protect workers with disabilities. It will assist them in developing a comprehensive strategy for hiring and retaining these workers. The program will provide an overview of the FMLA, ADA/ADAAA, HIPAA, GINA, ERISA, DOT, and OSHA regulations, as well as state workers’ compensation, disability, pregnancy leave, small necessities leaves, and medical privacy protections. In addition, lawyers with sensory, physical, and non-apparent/hidden disabilities will discuss challenges encountered in accessing the legal profession.     January 23/Web: Litigating and Advising on Clawbacks of Executive Compensation #MCLE

    Recent legislation, SEC enforcement actions and Board compensation committee initiatives have put at risk the compensation of CEOs, CFOs and other senior executives of public companies. Bonuses and stock sale proceeds are now subject to "clawbacks" in the event of material errors in financial statements, under the Sarbanes Oxley and Dodd Frank statutes. The SEC has begun a series of aggressive enforcement actions seeking "no fault" clawbacks from executives not alleged to have done anything wrong. Many compensation committees of Boards of Directors have implemented "voluntary" clawback provisions for executives. And, Dodd Frank requires compensation committees to adopt "self-executing" clawback rules, which will be the subject of forthcoming SEC regulations.

    February 13/Cleveland: Making Sense of the Supreme Court

    After an unprecedented era of stability, the U.S. Supreme Court has undergone a remarkable degree of change. Four new justices have been confirmed to the Supreme Court in the past six years, including a new Chief Justice. Several recent high-profile cases, including the health care case, have reinforced perceptions that the Supreme Court is sharply divided along ideological lines. At the same time, doctrinal differences have emerged among justices long perceived as ideological bedfellows, and the Court’s docket has changed in potentially important ways.
    In this lecture, Professor Adler will look at recent changes on the U.S. Supreme Court and their likely effect on the course of the law. Among other things, Professor Adler will discuss changes in the court’s docket, doctrinal shifts in key areas, the likely effect of the Presidential election on the Court, and what lessons can be learned from the Court’s recent terms, including important cases like NFIB v. Sebelius.
    Prof. Adler will examine how the Court’s rulings could affect regulated industries, litigants, and potential future cases.

    Jonathan H. Adler is the inaugural Johan Verheij Memorial Professor of Law and Director of the Center for Business Law & Regulation at the Case Western Reserve University School of Law, where he teaches courses in environmental, administrative, and constitutional law. Professor Adler is the author or editor of four books on environmental policy and over a dozen book chapters. His articles have appeared in publications ranging from the Harvard Environmental Law Review and Supreme Court Economic Review to The Wall Street Journal and The Washington Post. Professor Adler is a Senior Fellow at the Property & Environment Research Center in Bozeman, Montana, a contributing editor to National Review Online and a regular contributor to the popular legal blog, "The Volokh Conspiracy." A 2007 study identified Professor Adler as the most cited legal academic in environmental law under age 40, and his recent article, “Money or Nothing: The Adverse Environmental Consequences of Uncompensated Law Use Controls,” published in the Boston College Law Review, was selected as one of the ten best articles in land use and environmental law in 2008.
    In 2004, Professor Adler received the Paul M. Bator Award, given annually by the Federalist Society for Law and Policy Studies to an academic under 40 for excellence in teaching, scholarship, and commitment to students. In 2007, the Case Western Reserve University Law Alumni Association awarded Professor Adler their annual "Distinguished Teacher Award." Professor Adler serves on the academic advisory board of the Cato Supreme Court Review, the Board of Directors of the Foundation for Research on Economics and the Environment, and the Environmental Law Institute’s Environmental Law Reporter and ELI Press Advisory Board. A regular commentator on environmental and legal issues, he has appeared on numerous radio and television programs, ranging from the PBS "Newshour with Jim Lehrer" and NPR's "Talk of the Nation" to the Fox News Channel's "O'Reilly Factor" and "Entertainment Tonight." Prior to joining the faculty at Case Western, Professor Adler clerked for the Honorable David B. Sentelle on the U.S. Court of Appeals for the District of Columbia Circuit. From 1991 to 2000, Professor Adler worked at the Competitive Enterprise Institute, a free market research and advocacy group in Washington, D.C., where he directed CEI's environmental studies program.

    February 12/San Francisco: Dream Act & Deferred Action

    Learn the ins and outs of Dream Act (pending legislation) and the Deferred Action for Childhood Arrivals (DACA) policy which is now being implemented by the Obama Administration. Alexander H. Lubarsky, LL.M., Esq. will explain the state of Dream Act legislation and perform a “walk through” of a DACA client interview and forms processing. DACA is a very new and powerful change in immigration law policy resulting in undocumented people thirty and under being able to obtain lawful status. This workshop will take the practitioner through the DACA application process from beginning to end.

    January 17/Milwaukee: Judicial Campaigns, Money and the Future of Justice #MCLE

    The Wisconsin Supreme Court, a non-partisan court, has recently seen persistent partisan divide.  Additionally, Supreme Court campaigns nationwide continue to be inundated with big money contributions, with nearly $28 million spent on television ads alone in 2012.  The increasing role of campaign contributions in judicial races poses unique challenges to maintaining an independent and impartial judiciary, and the public's trust in our system of justice.
    The ACS Milwaukee Lawyer Chapter invites two panelists, The Honorable Ann Walsh Bradley and Mike McCabe, to share their insight and perspectives on our growing crisis in state courts.  Come learn about the pressures and influences facing judges, how they strive to remain objective despite them and steps to take to solve this problem properly.  Dr. Greg Rabidoux, Director of the American Constitution Society’s State Courts Project, will moderate this discussion.
