November 18: Birthright Citizenship: A Candid Assessment of Wong Kim Ark and Its Modern-Day Implications

Wong Kim Ark was born in San Francisco in 1873 to parents who had emigrated to the United States from China. In 1894, he took a trip to China. When he returned to San Francisco a year later, he was denied reentry, as the authorities invoked the Chinese Exclusion Act. Wong argued that he could not be denied admission because he was born in this country and therefore was an American citizen. The Supreme Court ruled in Wong Kim Ark's favor, holding that, pursuant to the Fourteenth Amendment, Wong Kim Ark was a U.S. citizen, even though his parents were "subjects of the Emperor of China." On January 20, 2025, shortly after being sworn in, President Trump signed an Executive Order restricting birthright citizenship. Litigation immediately followed.
The Fourth Annual Fall Symposium of the Center on Asian Americans and the Law at Fordham Law School will present a two-part program on birthright citizenship. First, we will tell the story of Wong Kim Ark, a Chinese cook who took his case to the United States Supreme Court in 1898. Second, a distinguished panel will explore the issues presented by the recent Executive Order.

We are lawyers, but we are also human and as such, are subject to all the range of experiences that all people face at some point in their lives. Grief is one such experience. 
We may experience multiple types of loss over the course of our professional careers including the loss of health, a job, a marriage, and of those for whom we care, among many others. 
This CLE discusses what and how we grieve together with the types of grief and the grief journey. This is approached through the lens of attorney ethics because grief can significantly affect our diligence, responsiveness, and client communication, to name just a few of attorneys' job responsibilities.

Michael Maschke is the President and Chief Executive Officer at Sensei Enterprises, Inc. Mr. Maschke holds a degree in Telecommunications from James Madison University. Mr. Maschke is an EnCase Certified Examiner (EnCE), a Certified Computer Examiner (CCE #744), a Certified Ethical Hacker (CEH), an AccessData Certified Examiner (ACE), and a Certified Information Systems Security Professional (CISSP).
He is an associate member of the American Bar Association and has spoken at the American Bar Association’s TECHSHOW conference on the subject of cybersecurity. He is currently an active member of the ABA’s Law Practice Division: Technology Core Group and is on the Fairfax Law Foundation Board of Directors. Mr. Maschke is a 2019 Fastcase 50 award recipient.
He is also a co-author of Information Security for Lawyers and Law Firms, a book published by the ABA in 2006 and The 2008-2020 Solo and Small Firm Legal Technology Guides (American Bar Association, 2008 – 2020).
