Before you volunteer with this project, we ask that you attend this free MCLE training session.

This training will be given by VLSP's Supervising Attorney who will go over the volunteer procedures as well as the different types of cases we place with volunteers. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute's Web site. For more information on how to view this webcast and attend our live training, please email Megan Colla at mcolla@sfbar.org or call 415.782.9000 x 8759. Pre-registration is required to attend.

Multiple Dates/Web - Possible hardship waiver for ACC webcasts

The Association of Corporate Counsel sponsors periodic webcasts, and charges a fairly typical fee if you seek CLE credit. However, attorneys experiencing financial hardship may wish to persue the option described at http://www.acc.com/education/accwebcastpolicies.cfm:

"Financial Hardship Policy for CLE Webcasts

ACC understands that due to the present economic environment, it may be difficult to cover the costs required to obtain MCLE. Please submit a request to
webcast@acc.com with the state bar that you need to obtain credit and a statement that you are currently in-transition. All requests must be received seven (7) business days prior to the airdate of the webcast you are interested in attending. ACC will then review your claim and notify you of our decision."
I can't make any promises about this, and I hope people who are not in genuine hardship but who are (like me) merely cheap, won't abuse the system. But, like the website says, for some people the costs really may be difficult. I hope someone will work through this process and let me know how it goes.
You can see a calendar of webcasts here: http://www.acc.com/customcf/vucalendar.cfm?showChapterEvents=0&showACCEvents=1&type=webcasts
A hardship waiver for a paid program can be a good way to get free CLE if you qualify, and it can be an excellent give-back for the sponsor. This generous offer from ACC deserves recognition!

Dec 15/New Orleans, LA - The Safe Escape Initiative-- Kickoff Free CLE training event

In Jefferson Parish, a woman trying to escape a violent relationship with the help of a protective order has almost nowhere to go for legal services if she cannot afford a private attorney. The few legal services available in the parish are forced to turn away the vast majority of domestic violence victims who need help.

In response to this need, the Tulane Domestic Violence Clinic is working with The Metropolitan Center for Women and Children to start the Safe Escape Initiative, a network of pro bono attorneys who volunteer to represent one domestic violence victim in a protective order hearing in Jefferson Parish.
  • The first free CLE training will be December 15, 2010 9:00 am - 2:00 pm.
  • Lunch provided
  • 4 hours of CLE have been applied for, including one hour of ethics and one hour of professionalism.
  • The CLE training will be free, and in return attorneys will agree to accept one protective order case in 2011.
  • This training will provide attorneys with the knowledge required to represent a domestic violence victim in a protective order case, and educate attorneys about the special ethical and professional obligations that arise when working with victims of domestic violence.

Anytime/Web - Various CLE

Here's a list of a variety of CLE available on the web anytime, just in time for your end-of-year enjoyment:
A few notes:
  • These are postings put up earlier this year, grouped together via the "Anytime" tag. Let me know if there are others that should be tagged!
  • Don't forget to check the "older posts" link at the bottom of that page.
  • The "Anytime" tag is to be distinguished from the "Web" tag as follows: "Anytime" is for resources you can access it any time (that is, they're recorded); "Web" is for anything available on the web, whether webinars, or recordings, or something yet to be dreamed of.
  • Many of these events are eligible for credit in multiple jurisdictions, but you'll have to check with your own jurisdiction to see if any particular what gets credit there. Good luck!
  • Washington and Oregon attorneys should take special note of the ethics credit on http://freecle.com/ . I would urge you to send them a few bucks to keep their site running!
  • Let me also shout-out to the Intellectual Property Colloquium http://4freecle.blogspot.com/2009/06/webav-intellectual-property-colloquium.html  - another leader in providing interesting and free online CLE!

Web - Contingent Fees: Access to the Court or Threat to Capitalism?

Contingent fees continue to stir great controversy especially in class action cases, mass torts, and medical malpractice lawsuits.  The controversy most recently gained national attention when President Bush banned contingency fees in cases filed by the U.S Government.  Federal judges have called contingent fees "grotesque" and plaintiffs claim they will be denied access to the courts without them. The debate remains lively among plaintiff and defense lawyers, academics, the judiciary, insurance companies, the Chamber of Commerce and the general public.

Recent legislation and efforts to amend state constitutions to limit contingent fees have been successful. Is there a problem with contingent fees? Do plaintiff's lawyers reap a windfall when enormous fees are awarded? What are the real risks undertaken by plaintiff's counsel and does the risk justify the reward? Are contingent fee awards out of whack? Who will benefit or suffer if they are restricted or eliminated?

The ABA Center for Continuing Legal Education presents:  "Contingent Fees: Access to the Court or Threat to Capitalism?" recording on 12/09/2008 and now available for free at http://www.abanet.org/cle/clenow/nosearch/public/contingentfees/main.html

You'll have to check in your jurisdiction to see whether it's been approved for credit. In Washington State, it's 1.75 AV credit, Activity ID 232134.
