This program will address the role of international election observer, political rights under Venezuelan law, and the international human rights principles of Article 25 of the International Covenant on Civil and Political Rights, a treaty to which both Venezuela and the U.S. are parties. The speaker, Martha Schmidt, was one of 50 international election observers (acompaƱantes) from three missions who travelled to Venezuela in December 2013 for the municipal, metropolitan and indigenous elections.

August 1: Webcast + NYC - Advanced Public Assistance and Food Stamp Eligibility 2014: Special Populations

PLI recently offered training on basic Public Assistance and Food Stamps (SNAP) eligibility. The intricate web of rules for these two programs is further complicated by the fact that there are special rules for certain populations. Immigrants, people who are homeless, and people with disabilities are among the populations who experience various exceptions or modifications of the usual program rules and who are among those most in need of assistance and representation. Two of the primary forums in which advocates assist people with public assistance and food stamps problems are administrative Fair Hearings and Article 78 special proceedings. High quality representation calls for a grounding in both the substantive program provisions and the procedural in these forums.
You will learn about special provisions in the law for certain populations and about the two key forums for advocacy on behalf of these populations. Topics to be covered include:
  • Representing special populations – immigrants, people who are homeless, and people with disabilities – with regard to public assistance and food stamps
  • Representing clients in Fair hearings and Article 78s – including recovering attorneys’ fees
All attorneys interested in helping low-income clients, especially clients who are members of these population groups, with public assistance and food stamp matters, will benefit from attending this program.

July 24: Minneapolis - Pro Bono Naturalization Project Training #MCLE

This training will prepare attorneys to participate in the ILCM Pro Bono Naturalization Project. Through the ILCM Naturalization Project, pro bono attorneys represent low-income immigrants and refugees in their citizenship cases. All cases have been pre-screened for eligibility and should only require 15 – 20 hours of legal work, depending on attorney experience. ILCM staff provides ongoing legal support throughout all cases. The ILCM Naturalization Project is a great way to help immigrants achieve the ultimate goal of securing citizenship in the United States, enabling them to unite their families, pass U.S. citizenship on to their children, and vote in future elections! No immigration experience is needed to volunteer with this project and ILCM can provide malpractice insurance to volunteers if needed! Volunteers will need an active attorney license, as well as a phone number and mailing address that can be used for case work.   • Food marketing and childhood obesity: The food and beverage industry spends nearly $2 billion per year marketing mainly salty, sugary, fatty food to children and adolescents. What does the First Amendment have to do with government action on food marketing? Learn about legal and policy strategies to improve the food marketing environment.
  • Regulation of antibiotics: Antibiotics lose effectiveness over time due to evolutionary resistance. A post-antibiotic era would have significantly higher mortality from infectious diseases. Law can be a useful tool to prevent and reduce this threat, but in some cases legal rules actually promote resistance and hinder infection control. Explore how law can play a role in whether or not we experience a post-antibiotic era.
  • Policy surveillance: How do current laws and policies really impact public health? Policy surveillance creates legal data for evaluation, builds and supports workforce legal capacity, allows stakeholders to track progress, and supports diffusion of innovation in laws and policies. Learn about current work in several areas that is crucial to the practice of policy surveillance.

June 26: Webcast - Joint Infringement and Indefiniteness After Limelight and Nautilus #MCLE

On June 2, the U.S. Supreme Court issued two opinions that continue the Court’s trend of decisions unfavorable to patentees. In Limelight Networks v. Akamai Technologies, the Supreme Court reversed a divided Federal Circuit that had held a party may be liable for inducement of infringement despite the lack of a single direct infringer. As a result, where the performance of a patented method can be divided between two or more actors, infringement may be avoided.
In Nautilus Inc. v. Biosig Instruments Inc., the Court held that the Federal Circuit’s application of its “insolubly ambiguous” standard for claim indefiniteness “breeds lower court confusion” and held that a patent is invalid for indefiniteness if its claims fail to inform with reasonable certainty those skilled in the art about the scope of the invention.
These cases have important implications for businesses, patentees, and practitioners. During the webinar, we will discuss the following:
