On-Demand: Webcast - Crisis Management for the In-House Counsel: Brand Protection in High Exposure Litigation

Every corporation will face a crisis at some point. While attorneys are usually concerned with preserving legal arguments and limiting liability, corporate counsel must also consider the impact in the court of public opinion. Nixon-Peabody Partner and Crisis Management Specialist Scott O'Connell and public relations expert Mike Lawrence discuss the tension created between those two courts. They examine the benefits of assembling a crisis management team before a crisis occurs and the importance of brand protection in the early stages of crisis management.

Mr. O'Connell and Mr. Lawrence explore seven phases of brand protection during a high exposure crisis: setting the stage, identifying a crisis, launching a call to action, showing your cards, reaching the public, and finishing the job. Throughout this course, the presenters offer best practices to ensure that your client or company weathers the storm.

June 23: Webcast - Pursuing Health Equity: Promising Practices in Policy and Law

According to Healthy People 2020, health equity can be defined as the “attainment of the highest level of health for all people,” regardless of one’s race, gender, nationality, age, ethnicity, religion, and socioeconomic status. Health equity concerns disparities in health that can be traced to unequal, systemic economic, and social conditions, and requires an understanding of not only how health is governed, but also how law and legal frameworks can be used to reduce barriers and increase access to health. Despite significant improvements in the health of the overall population, health inequities in America persist. Legal approaches and tools are increasingly becoming a means for maximizing equity. In fact, the nation’s health reform law, the Affordable Care Act, has been called the “best opportunity in a generation to promote health equity.” From passing laws to protect vulnerable and disparate populations to implementing policies and programs that provide access to legal support in conjunction with medical care, there are increasing models of how law and legal tools can be used to pursue health equity.
This webinar, co-sponsored by CDC’s Public Health Law Program and the Network for Public Health Law, will focus on promising practices, based in law, to address health equity issues through drug abuse treatment and overdose prevention, Medical-Legal Partnerships, and interventions in domestic violence and homelessness.

June 13: NYC - Managing the Renewable Grid: A Transatlantic Dialogue (NYU Energy Policy Discussion Series) #MCLE

In 2015, renewable energy resources supplied approximately 33% of Germany’s electricity demand. Yet, despite the influx of intermittent resources, the German grid appears as reliable as ever. If anything, reliability has improved in recent years. What regulatory and technical innovations has Germany implemented to accomplish this feat and what challenges has it encountered along the way? The upcoming event will examine the German experience and the lessons it may hold for New York State. The panel will also provide an update on initiatives underway in New York to help manage an increasingly renewable power system.

May 19: Webcast - If You’re Not on Facebook You’re Committing Malpractice #MCLE

Can you imagine cross-examining a witness about a telephone call if you’d never used a telephone before? It sounds ridiculous, but that’s precisely where many attorneys find themselves today when it comes to social media. With most of the population now using one or more of these tools to communicate, it’s increasingly dangerous for attorneys to blithely ignore social media and other developing technologies.
Lawyers who attend this webinar will learn about:
  • The growing number of ethics opinions addressing social media, and the obligation of attorneys to be familiar with them.
  • How to think about counseling clients on use of social media during a pending matter — and the attorney’s own use.
  • The intersection between competency requirements and changes in law office technology.

May 18: Webcast - The Flint Water Crisis: Lessons in Public Health, Law and Ethics

The Flint water crisis is currently on the minds of many in public health. In 2014, while under the control of an emergency manager appointed by the State of Michigan to oversee city operations and control finances, Flint changed its source of water to the Flint River in a cost-cutting measure. Subsequently, elevated lead levels were detected in Flint's children. The effects of elevated lead will negatively impact the health of the community, especially its children, for years. This webinar, co-sponsored by the CDC’s Public Health Law Program and the Network for Public Health Law, will examine emergency manager laws and the Safe Drinking Water Act, and explore the ethical considerations in protecting the health of communities in financial crisis.

He's also blogged and written extensively about the profession and its evolution on his blog Right Brain Law and for other online and print publications.
In his six years as a practicing attorney and more than ten years in the legal industry, Dan worked for two lean "NewLaw" law firms, designed and implemented an online program for procurement contract processing, and was a part of early international legal outsourcing efforts with a Fortune 500 company.
