August 19: San Francisco - Housing Negotiation Project Training

JDC's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.

August 15: Webcast - Reentry in California - Overcoming Legal Barriers to Community Reintegration Following Incarceration 2014

In the past three decades, incarceration rates have exploded in the U.S., such that today we incarcerate over two million people, more than any other country in the world. The result is that many more people encounter the criminal justice system at some point in their lives. Indeed, an estimated 1 in 4 adults in California has an arrest or conviction record, and people of color are disproportionately affected.
A person with a prior record faces significant employment and housing barriers, even when the record is old or unrelated to the job or housing. These barriers impede community reintegration and prevent formerly incarcerated people from being able to support themselves and their families or participate as members of their communities. This training is designed to give lawyers a foundation in the collateral consequences that result from contact with the criminal justice system, as well as tools for representing clients in need of reentry legal services.

  • Basic overview of criminal justice system and collateral consequences of arrests/convictions
  • Criminal Records Remedies under California law (i.e. “expungement”)

July 31: DC - The Second Amendment’s Past, Present & Future #MCLE

This year marks the 75th anniversary of United States v. Miller, a 1939 case in which the Supreme Court unanimously held that Congress could prohibit the possession of weapons that were not related to the “preservation or efficiency of a well regulated Militia.” For decades, this was the only consideration the Court gave the Second Amendment, and arguably, it was generally understood that the Amendment's scope was limited to the use of firearms in connection with military activities.
This changed in 2008 in District of Columbia v. Heller, and subsequently in 2010 in McDonald v. Chicago, when the Court declared that the Second Amendment provided an "individual right to possess a firearm.” The Court explained that they were not overturning Miller; that Miller only limited the type of weapon to which the individual right applies.
The symposium’s morning panel will consider if the Supreme Court got it right in Heller and McDonald. Following this discussion of how should the Second Amendment be interpreted, the symposium’s afternoon session will consider the legal and policy questions that now surround the Second Amendment and what this means for gun safety and violence prevention.

July 29: Webcast - The rise of GATCA – Preparing for the new reality of global tax compliance and account reporting systems

Even as many financial institutions are still scrambling to implement the US Foreign Account Tax Compliance Act, new international tax compliance and reporting systems are looming on the horizon. The Organization for Economic Cooperation and Development (OECD) has announced plans for a standard of automatic account information exchange between 45 countries, and other nations are implementing their own FATCA-like systems.
This rise of “global account tax compliance,” or GATCA, presents complex new compliance challenges for a huge range of institutions, from identifying the tax status of all customers to tracking the multiplying network of account data sharing regimes between countries. August 4: Webcast - Effective Communication with the Legal Services Client

As states enact new pro bono requirements and ease some restrictions on pro bono representation, it is becoming more important than ever for lawyers to understand the unique challenges posed by pro bono clients. PLI’s first Open Interactive Course is free to anyone who wants to learn more about how to meet the unique challenges posed by pro bono clients. The format is unlike anything PLI has ever offered. The course will be held exclusively online from Monday through Friday. Participants are expected to participate each day but may attend each daily segment any time, day or night. This course will teach new attorneys and seasoned professionals how to work effectively and cooperatively with their pro bono client.
You will learn proper techniques for getting to know your pro bono client including:

  • How to identify common problems that clients living in poverty have with access to resources (e.g., transportation, child care, Internet access).
  • How to create an environment where clients living in poverty feel safe enough to communicate fully and honestly with their lawyer.

You will learn how to communicate effectively with your pro bono client by:

  • Implementing strategies for establishing a trusting and productive relationship with a client living in poverty.
  • Recognizing the signs of poor literacy skills, especially reading comprehension, and make the necessary accommodations.
  • Establishing effective lines of communication with clients whose native language is not English.

You will learn how to educate your pro bono client about the legal process by:


  • Preparing clients for meetings and courtroom appearances.
  • Setting expectations for client behavior in court.
  • Preparing clients for how judges and other court personnel may speak to them and treat them.

You will learn how to help your pro bono client make informed choices by:


  • Explaining legal options, the negotiation process, and court proceedings in a manner that is understandable to the client.
  • Developing and documenting settlement authority to ensure that decisions to make, accept, or reject offers are the client’s and are not the result of the attorney imposing his/her will on the client.

October 17: DC - #Veterans Consortium Pro Bono Program Training

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
These trainings tend to fill up quickly, so register asap.

Our Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. July 14: Webcast - Early Minnesota Legal History

Lawyers generally don't think of themselves as historians, but we frequently do the work of historians. We seek out historical events (which we call "precedents") and try to apply these historical lessons to current situations. Minnesota's legal history has a long pedigree, dating back to the Northwest Ordinance of 1787. These antecedents give our laws a "chain of title" that is sometimes ignored. Some of the historical antecedents we'll look at are merely interesting "old cases" with little practical application. But others come under the heading of "venerable precedents", which can sometimes make an argument more compelling. And in a few cases, the law as it existed prior to statehood was arguably enshrined into the state constitution, in which case it takes on special significance.

July 15: San Francisco - Housing Negotiation Project Training

JDC's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.

As amply suggested by the many opinions offered by the Court of Appeals for the Federal Circuit’s en banc decision in Alice v. CLS Bank, in recent times, assessing patent claims for patent eligibility under 35 U.S.C. 101 has seemed to entail uncertainty. The recent decision of the U.S. Supreme Court in Alice confirmed that uncertainty, but in holding a financial software-related patent not patent-eligible, did the Supreme Court lead us out of the darkness and into the light?

DC's full scope Eviction Defense Project provides representation to clients during their eviction proceedings. These cases provide excellent litigation experience as the procedures are the same as those involved in business litigation-discovery, motions, settlement, and trial-on a more manageable level. Before you volunteer with this project, we ask that you attend this free MCLE training session.
This training will be given by JDC’s Supervising Attorney who will go over the volunteer procedures as well as the different types of cases we place with volunteers. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site.
