Litigation is on the rise in Japan and the Japanese government is determined to make the Japanese court system more effective in resolving disputes. In this presentation, we will begin by discussing the increase in litigation in Japan, then turn to general procedures for Japanese litigation. We will also address specific patent litigation procedures for the Japanese District Court, Invalidity Proceedings, and Customs Office Proceedings. We will then move on to issues for foreign companies litigating in Japan and provide suggestions for addressing those issues and litigating successfully in Japan.

December 19/San Francisco: Introduction to Family Law training


The Bar Association of San Francisco's Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.
This training will be given by VLSP’s Supervising Attorneys who will go over the volunteer procedures as well as the forms for completing a simple divorce. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site. December 10/Boston: Debt Collection at the Boston Municipal Court

This training prepares volunteer attorneys to assist low-income, unrepresented litigants in civil collection cases through VLP's Fair Debt Collection Lawyer of the Day project at the Boston Municipal Court.  The training will cover civil procedure and practice at the BMC, Limited Assistance Representation, as well as substantive areas of consumer and fair debt collection law that you will need as a volunteer.  Fair debt collection cases are a great opportunity for lawyers seeking courtroom experience. 
About this project: 
Volunteer attorneys assist low-income debtors and creditors at the Boston Municipal Court in the Brooke Courthouse on Wednesdays from 9 a.m. to noon on a Limited Assistance Representation (LAR) basis.  LAR means that the attorney only represents the client in the proceeding (case management conference, motion, etc.) before the court that day.  The representation begins and ends on the same day. This project is joint effort of the Volunteer Lawyers Project, Senior Partners for Justice, and the Litigation Section of the Boston Bar Association.

December 3/Boston: New Volunteer Attorney Orientation


This orientation provides an introduction to working with the Volunteer Lawyers Project/Senior Partners for Justice. Led by one of the VLP staff attorneys and the referral coordinator, this orientation provides an in depth look at everything you need to know in beginning your work with our organization. We will touch upon many frequently asked questions like: what types of cases does VLP work with, what it's like to work with interpreters, and where can I get help on this case. 
Along with that, this training will provide a space for new panel attorneys to ask any questions they may have about the way our organization works, the referral process and anything other questions that may arise. 
This training is meant to provide an introduction to VLP, our services, and our clients. It will be held six times per year, on the first Monday of every even number month from 4pm-5pm. Each orientation can accommodate 15 people, so please register early to reserve your spot!

November 29/Boston: Grand Rounds in Suffolk Probate & Family Court

If, like most lawyers, you have spent time in the courtroom waiting for your case to be heard, you know that there is a lot to be learned from just watching other cases. We have decided to take that experience one step further with a pilot program we are calling "Grand Rounds."
Grand Rounds is an opportunity for a small group of new attorneys and attorneys new to family law to observe in the courtroom for part of a morning and then discuss what they saw with an experienced practitioner. It will also include a guided tour of the Probate and Family Court to introduce group members to the various players that may be involved in a family law case.

December 12/Cleveland: Charity Care Obligations and Tax-Exempt Hospitals: Time For a Change? #MCLE

Lawmakers are considering a change in the tax exempt status of hospitals. Nonprofit hospitals, which are currently tax-exempt, might instead become taxable at the state or local levels, and receive tax deductions or credits for charitable activities. Professor Berg will describe the current debates about tax-exempt status for hospitals with respect to charity care requirements, and discuss the challenges. She will explore recent changes in this area of health law and policy and make suggestions for the future. Her talk will deal with issues relevant to health care lawyers, including those who are in-house counsel for hospitals and those who represent physicians, physician organizations, and patients. It will also be relevant to tax attorneys and those who represent non-profit businesses.

Jessica Wilen Berg is Professor of Law, Professor of Bioethics, and Professor of Epidemiology & Biostatistics, with a joint appointment in Case Western Reserve University’s Schools of Law and Medicine. Berg joined the faculty at Case Western in 1999 after serving as the Director of Academic Affairs of the Institute for Ethics, and Secretary of the Council on Ethical and Judicial Affairs for the American Medical Association. While in Chicago, she also taught courses at the University of Chicago Law School and Northwestern University Law School. Before that, she was a Visiting Professor at Michigan State Medical School, a Scholar in Excellence at the University of Massachusetts Medical School, and a Fellow at both the Center for Biomedical Ethics and the Institute for Law, Psychiatry and Public Policy at the University of Virginia. She is first author on a book published by Oxford University Press entitled “Informed Consent: Legal Theory and Clinical Practice.” Her publications and research span a variety of areas including public health, medical decision-making, research with human subjects, confidentiality, reproductive law and ethics, genetic enhancement, end-of-life care, professionalism, and e-medicine. Ms. Berg is the legal consultant for the American Academy of Pediatrics Committee on Bioethics. She works with a number of professional medical organizations and Institutes within NIH. In addition, she is on the editorial board of the American Journal of Bioethics. In 2008 Ms. Berg was named “Health Policy Researcher of the Year” by the Health Policy Institute of Ohio, and in 2009 she received the Mather Spotlight Award for Excellence in Research.

December 17/Boston: Intro to Guardianship of Minors #VLP Training

The training will provide a nuts and bolts approach to handling an uncontested guardianship of a minor case. The training will include instruction on how to complete the petition and accompanying pleadings, waive fees and costs, obtain assents from the ward's parents, and how to handle issues of service and the bond. This class will give participants the tools they need to handle simple guardianship of minor cases from filing through the establishment of a permanent guardianship.
In addition, attorneys and law students who attend this class will be qualified to participate in the VLP/Senior Partners for Justice guardianship petition assistance projects in the Norfolk (Wednesday), Middlesex (Thursday) and Suffolk (Tuesday and Wednesday) Probate & Family Courts on Fridays from 9 a.m. to 1 p.m. These are limited assistance representation projects in which volunteers help pro se petitioners complete and file the guardian of minor petition and other pleadings

November 19/Web: Qualifying a Veteran for Long-Term Care -- GAO Calls for Improvements

This CLE program of the Texas Veterans Legal Assistance Project on Monday, November 19, 2012, will educate attendees on the process to qualify a Veteran for VA pension benefits, pursuant to Title 38 of the United States Code and Title 38 of the Code of Federal Regulations, when Long-Term Care is needed. There will be one lecture by Attorney Janet Totter and it will provide an overview of (1) financial eligibility of the Veteran for VA pension, (2) Aid & Attendance special allowance, (3) spending down the Veteran’s assets and (4) why the GAO is calling for improvements.
Participants will receive a copy of the power point presentation, referencing applicable federal statutes and provisions related to the military judicial system.

In addition, he designed and deployed a number of effective community-based intervention trials that reduced racial and ethnic disparities in health and health care. Earlier, he was Commissioner of the New York State Department of Health. He is a board-certified internist and practiced emergency medicine for 12 years.

Changing the Foreclosure Litigation Landscape with the 49 State AG Mortgage Servicing Settlement 2012

Millions of homeowners have lost their homes and been subjected to unlawful conduct by mortgage servicing companies in the context of both judicial and non-judicial foreclosure proceedings around the country.  All state attorneys general, except the Oklahoma Attorney General, recently announced that they agreed to a 26 billion dollar settlement with the five largest mortgage servicers. The settlement is intended to help millions of homeowners modify their loans, provide compensation to homeowners who lost their homes as a result of the unlawful conduct of servicers in the foreclosure process, and change the way in which these five major loan servicing companies service mortgage loans that are both current and in default. The final settlement will be a long, complex agreement that advocates for homeowners, lenders and government agencies will need to understand in order to represent their clients effectively both in and out of court. This briefing will give you the tools to digest the relevant portions of the settlement and to deploy that knowledge to effectively represent your clients.
The panels  discusses the impact of the 49 State Attorney Generals settlement with some the countries’ largest servicers:
  • An overview of the important terms of the settlement including what claims state AG offices have lost and what claims they have preserved by entering into the settlement (i.e., claims of private litigants that survive the settlement and can still be asserted against the five banks that signed on to the settlement)

A training program entitled, Education Issues for Pro Bono Lawyers" Project PEACE for Educators and Lawyers will be held on November 26, 2012 from 10:00 am - 2:45 pm at the Heinz 57 Center, 339 6th Avenue, Pittsburgh, PA 15222.
Project Peace works to reduce conflicts and violence in Pennsylvania elementary schools by teaching children how to discuss and mediate their disagreements peacefully. The objective of Project PEACE is to neutralize minor conflicts before they escalate to explosive confrontations that could potentially lead to violent acts. Children become active participants in promoting positive behavior in their classrooms by taking on the role of mediator and using the mediation process.
The Project PEACE training introduces participants to the peer mediation process and provides them with instruction to teach their students. Over the past six years, Project PEACE has brought peer mediation programming and conflict resolution education to more than 80 schools directly and another 120 indirectly.
