FIRST TWO HOURS: The top ten most common malpractice concerns will be identified to discuss how problems can arise and what practice tips and advice that can help the attorney stay out of trouble with each area of concern. Participants will learn what some clients know about legal fees that you don’t, what keeps malpractice carrier claims and risk attorneys awake at night, and why the clients who actually sue you aren’t the ones you’re concerned about.
THIRD HOUR: Computers are wonderful tools. Their use allows law firms to be far more efficient than they would be without them. What information would be compromised if your laptop were stolen? As tech users, our actions can unintentionally circumvent the security tools that have been deployed. What we do with email, Internet browsing, downloading, social networking, and even how and where we do these things matters. Unsecured Wi-Fi is exactly that, unsecured. Just because a signal is there doesn’t mean using it is a good idea. Cybercriminals have the same ability to access that signal as you do. This session discusses technology traps for the attorney and information on how to avoid them.

June 25: Webcast - Human Trafficking: Forced Labor & Federal Enforcement

Human trafficking is an international scourge. The International Labour Organisation (ILO) estimates that 20.9 million people are trapped in forced labor or servitude around the globe. In the United States, the federal government has launched a multi-pronged effort to combat trafficking. Federal prosecutions, enhanced regulations to prevent forced labor in government contracting, and increased enforcement activity characterize this initiative. Four experts on trafficking will cover emerging issues in the field, including:
  • Recent prosecutions brought by the federal government in labor trafficking schemes;
  • Enforcement of the Trafficking Victims Protection Act of 2000 (and subsequent reauthorizations);
  • Civil litigation against human traffickers in U.S. federal courts;
  • The role of corrupt labor brokers who use force, fraud or coercion to trick potential employees, who are then held in forced labor;
  • Intersections between human trafficking and the FCPA;
  • Model Business and Supplier Principles on Labor Trafficking and Child Labor created by the ABA Business Law Section;
  • Federal Acquisition Regulation Subpart 22.17 and the Obama Administration’s Executive Order on trafficking and federal government contracting;
  • Pro Bono work on behalf of trafficking victims in U.S. federal courts.

As this Supreme Court’s Term comes to an end, experts from the ACS network will discuss “What’s Next?” as part of a weekly conference call program.

As the Supreme Court’s 2013 Term comes to an end, experts from the ACS network will discuss “What’s Next?” as part of a weekly conference call program. The first in this series will take place shortly after the Supreme Court hands down its opinion in Harris v. Quinn, which could come as soon as next Tuesday, May 27. In Harris v. Quinn, the Supreme Court revisits its review of the First Amendment as applied to union dues, examining the right to collective bargaining by low wage homecare workers. What will this case really mean for the right of workers to engage in collective action and form unions? What does Harris represent with respect to union treatment under the First Amendment? And what does it mean in the context of the Court’s work this Term?

May 29: Webcast - Octane Fitness and Highmark: The Supreme Court’s New Standard for Finding a Patent Infringement Case “Exceptional”

On April 29, in two cases, Octane Fitness LLC v. ICON Health & Fitness, Inc. and Highmark Inc. v. Allcare Health Management System, Inc., the U.S. Supreme Court issued opinions that significantly alter the Federal Circuit’s rigid standards for establishing and appealing an exceptional case and a related award for attorneys’ fees. The Court’s decisions arguably both ease the requirements necessary for the grant of attorneys’ fees and make it more difficult to challenge a district court’s decision on appeal. As such, the two decisions immediately impact litigation strategies for both pending and contemplated patent infringement cases.

June 17: San Francisco - Housing Negotiation Project Training

JDC's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.
