March 31:The Basics of Civil Litigation and Expert Witnesses

Pete Fowler Construction has worked on thousands of civil litigation cases over the last 20 years, so we know a thing or two about the subject. But a little bit of knowledge is dangerous, and a lot of knowledge can make a simple explanation harder than it needs to be.
For this reason, "The Basics of Civil Litigation and Expert Witnesses" program is aimed at
(A.) non-lawyers who need to understand the process (that's us), and
(B.) lawyers who need to explain the process to non-lawyers.
Our company's job on all litigated matters is to help clients figure out what happened, what should have happened, how the problem should be solved, how much it will cost, and who is responsible. The hardest part is translating the technical speak of building design, engineering, estimating, contracting, construction, and investigations, into plain-English that everyone can understand and use to make smart decisions. Our lawyer clients have the same problem trying to explain the litigation process to the non-lawyers they work with to bring cases to a successful end (something this program aims to help with).
Civil litigation is a suit based on non-criminal disputes, including contract disputes, property damage claims, personal injuries, construction defect litigation, landlord-tenant disputes, and more. This program is a map of the terrain for understanding how civil litigation works and where expert witnesses fit in the process.

May 20: The AML Act of 2020 and U.S. Compliance with the FATF 40

The Anti-Money Laundering Act (AMLA) of 2020 became law on January 1st as part of the National Defense Authorization Act when Congress overrode then President Trump's veto.
The AMLA has been billed as the most consequential AML law enacted by Congress “in decades.” Among its many provisions are the establishment of a beneficial ownership registration database, increased subpoena power to obtain records from foreign financial institutions, expanded whistleblower rewards and protections, and new BSA violations and enhanced penalties for repeat and egregious violators.
Following an update to the US 2016 mutual evaluation, in May of 2020 the U.S. was rated compliant on 9 of the 40 Recommendations, largely compliant on 22, partially compliant on 5 and not compliant on 4.
Did the AMLA bring it closer to compliance? What provisions in the AMLA did not address the 32 Recommendations for which the U.S. was not fully compliant, and why were they added to the AMLA instead of provisions that would bring the U.S. closer to compliance?

  • Phil DeLuca is Senior Vice President and Director of Compliance Controls at U.S. Bank. Prior to joining U.S. Bank, he led the AML investigations department of a large global bank where he and his team pioneered the use of issue-based typology driven investigations. Mr. DeLuca has over 30 years of financial services investigations management experience and has conducted and managed numerous high profile/sensitive anti-money laundering/counter-terrorist financing investigations. He has partnered with all levels of law enforcement to develop leading-edge investigative strategies and has been recognized by the highest levels of government for his leadership and expertise in leveraging an issue-based investigation approach to identifying data characteristics that are potentially indicative of human trafficking. In 2012, Mr. DeLuca was invited to present at the White House Forum to Combat Human Trafficking with a panel of colleagues from law enforcement and the technology industry. Mr. DeLuca regularly advises industry, government, and law enforcement agencies on typology development and data interrogation techniques to be more proactive and productive in detecting illicit financial activity. 
  • Angel Nguyen Swift is Head of Conduct Management for Wells Fargo where she leads a team responsible for ensuring employees act ethically on behalf of Wells Fargo, its customers, and employee base. Part of the Enterprise Customer Excellence group within the Chief Operations Office, the group provides enterprise-wide conduct functions, including the Ethics program, the Insider Threat program, enterprise investigations, and operational reporting, supporting the company in managing conduct-related issues. Swift is an experienced leader in compliance and financial crimes with more than 18 years helping guide financial institutions in developing, enhancing and remediating financial crime compliance programs. Before joining Wells Fargo, she held multiple leadership, consulting, and advisory positions, including serving in senior leadership roles focused on financial crimes and compliance with American Express and Enigma Technologies. She also served as Assistant District Attorney of New York in the Identity Theft Unit where she helped establish a team of prosecutors with expertise in, and responsibility for, prosecution of major cases of identity theft and cyber-crime. Swift is based in New York City and is the Founder and Executive Director of Stand Together Against Trafficking, Inc.   • Maya Simek is a clinical law professor and co-director of Case Western Reserve’s Health & Human Trafficking Clinic. She also serves as managing legal director at Equality Ohio, where she developed and is now supervising a state-wide legal clinic for the lesbian gay bisexual transgender queer (LGBTQ+) community. Simek focuses her practice on legal issues impacting the LGBTQ+ community and human trafficking prevention and victim redress. Her other areas of interest include community lawyering and the importance of interdisciplinary collaboration, particularly with social services, on the efficacy of legal practice. The focus on these areas of interest inspired Simek’s spearheading of a law clinic for individuals affected by HIV/AIDS engaging in case management services at the Nueva Luz Urban Resource Center in 2012.

March 10: How Policing Reinforces Racial Segregation In The 21st Century

Technocratic debates about police reform typically take a narrow view of the multiple, complex roles that policing plays in American society, focusing primarily on police involvement in systems of crime control. Yet, we know that policing plays many roles in society other than fighting crime.
This project focuses on how routine practices of policing maintain racial residential segregation, one of the central mechanisms of American racial inequality. It illustrates six ways that American policing perpetuates residential segregation, drawing from qualitative research in several American cities. Finally, the project engages a fundamental question that emerges in the context of racial justice movements today: Is an anti-segregation approach to policing possible in a society that is structured through race?

He has more than 25 years experience in the field of money laundering, as a practicing “laundryman,” financial compliance consultant, and trainer/lecturer to law and intelligence agencies including the FBI. He has testified three times before U.S. Congressional committees. Rijock is a veteran of the conflict in Vietnam and Cambodia, and holds the Combat Infantryman's Badge and Bronze Star Medal.
 In Miami in the 1980s, Ken Rijock was the middle man between Colombians and the domestic cartels flooding America's streets with cocaine. Every Friday, carrying hundreds of thousands of dollars in a tattered suitcase, he would fly by private jet to a tax haven in the Caribbean. Rijock's operation was responsible for 'cleaning' over $200 million of dirty cash. And, all the time he was in love with a cop.
 It finally came crashing down when a client testified against him. He agreed to go undercover for the DEA, and he now works with banks and governments to track the new generation of money launderers. Ken Rijock tells his story in his book, The Laundry Man.

April 15: Critical Challenges: Confessions, Strikes, and Transfer

Motion practice is a key part of delinquency counsel’s ethical obligation to protect the constitutional and statutory rights of juveniles in juvenile court proceedings.
This session will examine 
  • Critical challenges every defender should consider, including motions to suppress statements and evidence, and provide the legal basis and key arguments related to each challenge
  • The application of adolescent development research to motion practice
  • Information on the transfer of juveniles to adult court, including an explanation of current law and procedure as well as key considerations for effective advocacy in transfer hearings
  • An overview of the complex and important topic of three strikes law as it relates to juvenile adjudication.
