February 16: Saint Paul - The Case Against the Supreme Court

While many Americans may perceive the Supreme Court as objective,
Erwin Chemerinsky
Erwin Chemerinsky argues that this is nonsense and always has been. Chemerinsky says that the Court is made up of fallible individuals who often base decisions on their own biases. Today, he believes the Roberts Court is promoting a conservative agenda under the guise of following a neutral methodology, but notorious decisions, such as Citizens United and Shelby County, are hardly recent exceptions. Come to the Hamline School of Law for Erwin Chemerinsky’s talk about how the Court has largely failed throughout American history, often at its most important tasks and at the most important times.

Erwin Chemerinsky is the founding dean of the University of California-Irvine Law School. He is the Raymond Pryke professor of law and has a joint appointment in the Political Science Department. Previously, he taught at Duke Law School for four years, during which he won the Duke University Scholar-Teacher of the Year Award in 2006. Before that, he taught for 21 years at the University of Southern California School of Law. Chemerinsky has also taught at UCLA School of Law and DePaul University College of Law.
His areas of expertise are constitutional law, federal practice, civil rights and civil liberties, and appellate litigation. He is the author of eight books, most recently The Case Against the Supreme Court, to be published by Viking in September 2014, and more than 200 articles in top law reviews. He frequently argues cases before the nation’s highest courts, including the United States Supreme Court, and also serves as a commentator on legal issues for national and local media. He writes a weekly column for the Orange County Register, monthly columns for the ABA Journal and the Daily Journal, and frequent op-eds in newspapers across the country. In January 2014, National Jurist magazine named Dean Chemerinsky as the most influential person in legal education in the United States.

February 19: Web - The Ethics of Conflicts of Interest

Conflicts of interest can bedevil both litigators and transactional lawyers. The relevant rules seem complicated and highly technical, and the decisions interpreting them sometimes give inconsistent guidance. But get it wrong and you can face discipline, disqualification or a civil lawsuit. This two-hour program will give practical advice about how to handle conflicts of interest: When are you barred from representing multiple clients or appearing adversely to a current or former client? When is the representation permitted with the clients’ informed consent, and how should consent be obtained? How do courts handle alleged conflicts when they are raised in disqualification motions? Which conflicts are the most frequent subject of disciplinary decisions and lawsuits – and how can they be avoided?

February 26: Cleveland - Cyber Harassment and Cyber Stalking: The New Frontier of Civil Rights in the Twenty-First Century

Description:
Danielle Keats Citron builds a compelling picture of a problem that is all too often trivialized by the media, the public, lawmakers, and law enforcement. Cyber harassment and cyber stalking are devastating and endemic. These acts involve threats of violence, privacy invasions, reputation harming lies, calls for strangers to physically harm victims, and technological attacks. As if dealing with a single attacker's hateful comments were not enough, harassing posts that make their way onto social media sites often feed on one another, turning lone instigators into cyber mobs.
Thousands upon thousands of cyber harassment incidents happen annually in the United States and throughout the world, and evidence suggests that they are becoming more prevalent. Persistent online attacks disproportionately target women; an estimated 70 percent of cyber stalking victims are women, with women of color facing more harassment than any other group. Typically, women are targeted by men who attack them using sexually explicit, threatening, and slanderous language, as well as posting sexually explicit photographs. By contrast, men are more often attacked for their ideas and actions, rather than their gender. More often than not, these attacks are written off by observers and authorities as another example of "boys will be boys" or they are viewed as less dangerous because they originate online rather than in person. Citron demonstrates that these explanations are simply not realistic. The internet is a large part of people's lives and careers and should be governed by society's rules.
Citron's lecture will discuss cyberspace as the new frontier of the civil rights movement. Citron, well-known for her articles and essays on privacy and cyber civil rights, shows that advocacy and legal work will again chart the way forward and offers a set of practical recommendations for change that policymakers, educators, lawmakers, and corporate executives can implement, while at the same time remaining respectful of the First Amendment.

January 29: Web - Utility Model Patents: Use and Enforcement in Global Patent Practice

In a number of countries outside the U.S., alternative types of patent protection are available to inventors. While many attorneys and inventors are aware of the standard patent, the utility model patent (also known by alternative names in various countries) is less recognized and less frequently used. However, the use of these patents is rapidly expanding in some countries and can be an effective tool in an intellectual property portfolio. Understanding how these patents are obtained and enforced can be essential to companies and inventors with a global presence.
During this webinar, we will cover these topics and more:
  • General concepts common to utility model patent applications
  • Current trends in filings of utility model patent applications worldwide and country by country
  • Basic guidelines and distinguishing features of utility model patent applications in China and other countries
  • Prosecution and enforcement of these applications in select countries
  • Useful practice tips

February 6: Web+NYC - Collaboration and Conflict: Litigating Felony Sex Trafficking Cases #MCLE

Human Trafficking has long been a hidden problem in New York State and the US. In 2000, Congress passed the federal Victims of Trafficking and Violence Prevention Act (TVPA) and has since re-authorized it three times making important modifications. In 2005, the US ratified the UN Trafficking Protocol. This was followed by passage of the New York State Trafficking Victim Protection and Justice Act in 2007. The New York law has been heralded as the most comprehensive law of its kind in the country. Yet, relatively few cases have been prosecuted in any jurisdiction.
This program will provide an overview of felony prosecution for human trafficking related crimes under related New York State statutes as well as relief for victims. What you will learn:
  • How to investigate and build a sex trafficking case
  • Who traffickers are and how they operate
  • How to interview a victim
  • How to collaborate across conflicting civil and criminal attorney goals and limitations
  • How to address immigration and other legal issues
  • How New York State courts are addressing vacatur, sentencing, and immigration concerns.
