February 6: Web+NYC - Collaboration and Conflict: Litigating Felony Sex Trafficking Cases #MCLE

Human Trafficking has long been a hidden problem in New York State and the US. In 2000, Congress passed the federal Victims of Trafficking and Violence Prevention Act (TVPA) and has since re-authorized it three times making important modifications. In 2005, the US ratified the UN Trafficking Protocol. This was followed by passage of the New York State Trafficking Victim Protection and Justice Act in 2007. The New York law has been heralded as the most comprehensive law of its kind in the country. Yet, relatively few cases have been prosecuted in any jurisdiction.
This program will provide an overview of felony prosecution for human trafficking related crimes under related New York State statutes as well as relief for victims. What you will learn:
  • How to investigate and build a sex trafficking case
  • Who traffickers are and how they operate
  • How to interview a victim
  • How to collaborate across conflicting civil and criminal attorney goals and limitations
  • How to address immigration and other legal issues
  • How New York State courts are addressing vacatur, sentencing, and immigration concerns.
