June 24: The Dog Did It – Developing a Products Case from Inadvertent Stove Activations

This presentation will focus on how the defective nature of certain residential ranges results in fires and how such a claim can be successfully subrogated against the manufacturer. The presenters will discuss the applicable standards issued by Underwriter Laboratories (UL) and American National Standards Institute (ANSI) and how the various ranges comply or fail to comply with those standards. A mechanical engineer will explain the testing needed to establish the defect and discuss alternative designs the manufacturer can implement to safeguard against inadvertent stove activations.The presentation will detail the claims that can be asserted against the manufacturer and arguments for rebutting the manufacturer’s inevitable defense that the fire was the fault of the insured, their children, pets, or others.

James Howard Meredith was the first African-American student admitted to the racially segregated University of Mississippi. He is also an American civil rights movement figure, writer, political adviser, and Air Force veteran.
Meredith planned a solo 220-mile March Against Fear from Memphis, Tennessee, to Jackson, Mississippi in 1966; he wanted to highlight continuing racism in the South and encourage voter registration after passage of the Voting Rights Act of 1965. The second day, he was shot by a white gunman and suffered numerous wounds. Leaders of major organizations vowed to complete the march in his name after he was taken to the hospital.
He rejoined the march and when Meredith and other leaders, including Rev. Dr. Martin Luther King, entered Jackson on June 26, they were leading an estimated 15,000 marchers, in what was the largest civil rights march in Mississippi. During the march, more than 4,000 African Americans registered to vote, and it was a catalyst to continued community organizing and additional registration.
A highly independent man, Meredith has identified as an individual American citizen who demanded and received the constitutional rights held by any American, not as a participant in the Civil Rights Movement. Today his mission is to heal racial divisions through honest dialogue and to foster good moral character in today’s youth.

The business of building involves large volumes of documents including plans, contracts, memos, and reports just to name a few. Some of these files are paper, some are electronic and often there is more text available to be read than hours in the day to read it. In essence, we are inundated with documents and data.
This program addresses specific ways to manage information efficiently and to cull relevant information from a file on your desk by applying some project management principles and an understanding of the construction and claims process. Our projects require the ability to separate the 'vital few from the trivial many'; to turn data into actionable information.

June 15: Federal Circuit Update on Patent Claim Construction: Evolving Standards


This webinar will provide a current update of Federal Circuit case law, as the Court continues to refine its approach toward determining the scope of patent claims. It will provide a description of:
  • A framework for understanding how the Federal Circuit determines the “ordinary and customary” meaning of claim terms. The Court’s most significant, recent instructions for resolving “the distinction between using the specification to interpret the meaning of a claim and importing limitations from the specification into the claim.”
  • How the Court now determines a patent applicant has disavowed claimed subject matter.
  • The Court’s refinements in interpreting preambles, coined terms, and “wherein clauses.”
  • Indicators as to when a narrowing amendment is “merely tangential,” such that an amended claim still covers insubstantially different devices or methods.
  • Further constraints on when a claim limitation would be improperly vitiated if construed to cover an accused device or method.
The webinar is of interest to patent drafters who wish to how their drafting efforts will be interpreted; and litigators who wish to know the tools available to them in construing asserted claims. June 11: Ethical Duties and Best Practices in Working with Youth: Considerations Related to Culture, Race, and Special Circumstances

In working with juvenile clients, defenders and system partners must demonstrate sensitivity and understanding regarding each child’s unique qualities and experiences, including a youth’s sexual orientation and gender identity, immigration status, special education needs, and experiences with abuse and exploitation. 
In this session, presenters will identify implications of these circumstances for representation of a juvenile client, and will explore strategies for ensuring that juveniles receive care, treatment and guidance consistent with his or her best interest in partnership with system partners. Additionally, competent representation requires defense counsel to demonstrate racial, ethnic and cultural understanding and to identify and address bias within oneself and within the juvenile justice system. While explicit racism and other forms of racial and cultural bias persist, they have become less prominent and public over the past century. Also important, and likely more pervasive, are questions surrounding implicit bias—attitudes or stereotypes that affect our understanding, decision-making, and behavior towards racially marginalized youth, without our even realizing it. 
This session will explore some harmful side effects of how our brains naturally perceive, categorize, and draw inferences about a youth trapped in the system. Further, this session will present select strategies for de-biasing our brains.

Filing a meritorious petition does not guarantee the Patent Trial and Appeal Board (PTAB) will institute trial in inter partes review (IPR) or post-grant review (PGR) proceedings. Congress allowed that the PTAB “may not authorize” IPR proceedings unless they identify a reasonable likelihood that the petitioner would prevail with respect to at least one of the claims challenged. This leaves the PTAB with discretion over whether to institute if the relevant conditions are present. The PTAB has issued guidance and precedential decisions to help petitioners and patent owners evaluate whether the PTAB should apply its discretion to deny institution.
