November 20: NYC - Litigated Divorces

PREREQUISITES Please note that this training is open only to attorneys from major law firms.
If you have any questions, contact  CLEtrainings@herjustice.org.
Attorneys will be trained to represent Her Justice-referred clients in litigated divorce actions in Supreme Court.
Procedural and substantive aspects will be discussed in detail including equitable distribution of marital property, maintenance, child support and child custody and visitation. Recent changes in matrimonial law, including no-fault divorce and the guidelines for calculating temporary maintenance during the pendency of a divorce, will be highlighted. Training manuals and sample documents will be provided at the training.
A litigated divorce case will be assigned at the training or shortly thereafter. Attorneys can work on the case individually or as part of a team of two or more attorneys.

Our Family Law Project assists individuals, families with children or families with domestic violence in matters including marital dissolutions, child custody, child support, restraining orders, guardianships, conservatorships, wills, powers of attorney and probate litigation. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.

This training will be given by JDC’s Supervising Attorneys who will go over the volunteer procedures as well as the forms for completing a simple divorce. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site. Nearly all of the crime victims seeking assistance under Immigrant Law Center of Minnesota (ILCM)’s project are women and children who have been victims of sexual assault and/or domestic violence. The special provisions under VTVPA encourage these victims to cooperate with law enforcement, and allow victims of abuse to gain the independence they need to break the cycle of violence and provide a safe future for their families.
ILCM’s Crime Victim Relief Project is for all interested pro bono attorneys. No immigration experience is necessary. ILCM does ask that all volunteers have an active license and an address/phone number that can be used for client correspondence and case filings.

December 16: San Francisco + Web - Troubleshooting Mortgage Servicing Problems: Regulatory Responses and Advocacy Approaches

Some of the biggest loan servicers in California are in the process of selling off large segments of their servicing portfolios. Servicing transfers can wreak havoc with borrowers’ accounts, particularly if they are in the midst of seeking a loan modification or other assistance. Other borrowers encounter problems obtaining assistance due to “non-borrower” status after the death of a family member or because of limited English proficiency or disability. Attend this training for an in-depth look at some of the key loan servicing problems faced by borrowers, including servicing transfers, the difficulties heirs encounter after the death of a borrower and unfair servicing. Using case studies, practitioners and consumer advocates will provide an overview of the relevant rules and regulations governing these issues and discuss how to identify and address these all-too-prevalent loan servicing abuses in your practice.
