Thus, low-income clients are in great need of your pro bono help.  Attend this free PLI program and volunteer with your local legal services agency to represent low-income family law litigants in need.  With a limited time commitment, you can help obtain essential legal protections needed for low-income families.
What you will learn:
  • Motions Practice in Family Law Cases provides an overview of the procedural steps to obtaining immediate orders (including judicial counsel forms, family law hearings, etc) and how to handle family law court hearings.
  • Using California Family Law Judicial Council Forms provides a detailed summary of using California Judicial Council forms in family law motions – from filing a Request for Order or filing an Answer to obtaining complete and enforceable Orders After Hearing.
  • The program will also generally discuss working with low-income clients and domestic violence survivors and will include a mock client interview to illustrate best practices in this area.

January 21: San Francisco - Housing Negotiation Project Training #probono #MCLE

JDC's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.

  Both the Jewish and American judicial systems place great value on the concept of an impartial judiciary. Alexander Hamilton stated “This independence of the judges is ... requisite to guard the Constitution and the rights of individuals.” Jewish law agrees with this assessment and places judicial independence at the heart of its rules for judicial eligibility. Although both systems agree on the value of judicial independence, they disagree in some instances on which judges are considered biased. In this class, we hope to explore how each system tries to reach the goal of a fair and impartial judiciary.

  • Minnesota: 1.0 CLE credit applied for (Minnesota event codes: 12/26 # 186752; 12/27 # 186753).
  • Montana: Montana will honor the approval given by other CLE jurisdictions. Simply attach documentation of the other state's approval to your affidavit at the end of the reporting year.
  • New Jersey: New Jersey attorneys who are taking courses approved for CLE by another state will receive 1:1 credit for courses approved in that jurisdiction through reciprocity.
  • New York: Attorneys may claim New York CLE hours if the program is accredited in Wisconsin.
  • Wisconsin: 1.0 CLE credit applied for, each program.
  • Washington State: You may apply for credit via online Form 1.

Rabbi Cutler is the director of the Las Vegas Jewish Experience and heads the Community Kollel of Greater Las Vegas’s continuing legal education program. In that capacity he teaches lawyers and law students a wide variety of topics relevant to both Jewish and American law. Rabbi Cutler is also Of Counsel with the firm of Ballon Stoll Bader & Nadler, P.C., a midsize full practice law firm headquartered in New York City with affiliate offices in various cities throughout the United States and around the world. Rabbi Cutler is a member of the firm’s litigation and trusts and estates practice groups. Rabbi Cutler is the co-author of several legal scholarly articles, including: "DTD v. Wells: Historical Curiosity or Important Protection Against Judicial Blackmail?," which appeared in the May 2010 edition of Class Action Watch; and, "The Conflict Between the Circuits in Analyzing Joint Employment Under the FLSA: Why the Supreme Court Should Grant Certiorari in Zheng v. Liberty Apparel," which appeared in the June 2011 edition of Engage. Among Rabbi Cutler's notable cases are DTD v. Wells, 130 S.Ct. 7 (2009), the first Supreme Court opinion joined by Justice Sotomayor; and, Matter of Blaize v. Klein, 68 A.D.3d 759 (2nd Dept. 2009), which helped establish the principle that the New York Department of Education is bound by its own procedural rating rules, and that failure by the Department of Education to follow its published procedures in rating a teacher "unsatisfactory" was grounds for reversal of the unsatisfactory rating. Rabbi Cutler has consulted with religious organizations and other law firms on a wide variety of religious freedom issues including the Religious Land Use and Institutionalized Persons Act.
  • The programs will be moderated by attorney Richard P. Clem, who has a B.A. in history from the University of Minnesota, and a J.D., cum laude, from Hamline University School of Law. December 26: Telecon - RLUIPA’s Land Use Provisions: Practice Points for Litigation Involving Jewish Institutions. #MCLE

From the United States Supreme Court’s decision in Employment Division, Department of Human Resources of Oregon v. Smith 494 U.S. 872 (1990), until its decision in Cutter v. Wilkinson, 544 U.S. 709 (2005), Congress and the Courts waged a 15 year battle over the constitutional and proper level of protection for Free Exercise rights under the First and Fourteenth Amendments to the United States Constitution. This fight ended when the Supreme Court upheld the constitutionality of the Religious Land Use and Institutionalized Persons Act (RLUIPA) in Cutter.
This course examines the history of this conflict and the manner in which courts have interpreted the substantial burden and discrimination clauses of RLUIPA’s land use provisions. A particular focus will be on the manner in which the substantial burden provision is interpreted in light of the different beliefs of different religions and in particular how the courts have interpreted this provision in cases involving Judaism.

  • Colorado: Colorado attorneys should submit a Colorado Affidavit form along with a statement certifying that the CLE program is accredited in another mandatory CLE state.
  • Florida: Courses approved by other state bars are generally acceptable for use toward satisfying CLE requirement but attorneys must first submit a CLE Application for Course Attendance Credit.
  • Hawaii: Program is eligible for Hawaii CLE credit only if the attorney is calling in from outside of Hawaii. The program cannot be taken for Hawaii credit if you call in from Hawaii.
  • Iowa: 1.0 CLE credit approved, each program. (Iowa activity numbers: 12/26 # 123311; 12/27 # 123310).
  • Maine: Credit hours for activities approved by another MCLE state will be accepted for identical credit by the Board of Overseers of the Bar in Maine upon the Board's receipt of evidence of such certification as issued by that state
  • Minnesota: 1.0 CLE credit applied for (Minnesota event codes: 12/26 # 186752; 12/27 # 186753).
  • Montana: Montana will honor the approval given by other CLE jurisdictions. Simply attach documentation of the other state's approval to your affidavit at the end of the reporting year.
  • New Jersey: New Jersey attorneys who are taking courses approved for CLE by another state will receive 1:1 credit for courses approved in that jurisdiction through reciprocity.
  • New York: Attorneys may claim New York CLE hours if the program is accredited in Wisconsin.
  • Wisconsin: 1.0 CLE credit applied for, each program.
  • Washington State: You may apply for credit via online Form 1.
  • Other States: CLE credit is available in many other states if the participating attorney applies for credit. For further information on reciprocity, see the Baran CLE Reciprocity Guide.

Rabbi Cutler is the director of the Las Vegas Jewish Experience and heads the Community Kollel of Greater Las Vegas’s continuing legal education program. In that capacity he teaches lawyers and law students a wide variety of topics relevant to both Jewish and American law. Rabbi Cutler is also Of Counsel with the firm of Ballon Stoll Bader & Nadler, P.C., a midsize full practice law firm headquartered in New York City with affiliate offices in various cities throughout the United States and around the world. Rabbi Cutler is a member of the firm’s litigation and trusts and estates practice groups. Rabbi Cutler is the co-author of several legal scholarly articles, including: "DTD v. Wells: Historical Curiosity or Important Protection Against Judicial Blackmail?," which appeared in the May 2010 edition of Class Action Watch; and, "The Conflict Between the Circuits in Analyzing Joint Employment Under the FLSA: Why the Supreme Court Should Grant Certiorari in Zheng v. Liberty Apparel," which appeared in the June 2011 edition of Engage. Among Rabbi Cutler's notable cases are DTD v. Wells, 130 S.Ct. 7 (2009), the first Supreme Court opinion joined by Justice Sotomayor; and, Matter of Blaize v. Klein, 68 A.D.3d 759 (2nd Dept. 2009), which helped establish the principle that the New York Department of Education is bound by its own procedural rating rules, and that failure by the Department of Education to follow its published procedures in rating a teacher "unsatisfactory" was grounds for reversal of the unsatisfactory rating. Rabbi Cutler has consulted with religious organizations and other law firms on a wide variety of religious freedom issues including the Religious Land Use and Institutionalized Persons Act.
  • The programs will be moderated by attorney Richard P. Clem, who has a B.A. in history from the University of Minnesota, and a J.D., cum laude, from Hamline University School of Law. He has been in private practice in the Twin Cities for over 20 years. His reported cases include: Asociacion Nacional de Pescadores a Pequena Escala o Artesanales de Colombia v. Dow Quimica de Colombia, 988 F.2d 559, rehearing denied, 5 F.3d 530 (5th Cir. 1993), cert. denied, 510 U.S. 1041 (1994); LaMott v. Apple Valley Health Care Center, 465 N.W.2d 585 (Minn. Ct. App. 1991); Abo el Ela v. State, 468 N.W.2d 580 (Minn. Ct. App. 1991).

The struggle of shareholders for a greater role in corporate governance has taken many new turns in recent years. The SEC adopted rule 14a-11 to allow some shareholders to place nominations for the board of directors on the corporate proxy statement, but a court invalidated that rule. Proxy advisers (especially ISS) have become more influential; in the opinion of many executives their influence is excessive and detrimental. Coordinated efforts to rescind poison pills and staggered boards have often succeeded. Hedge funds have become more effective at getting issuers to make major changes, another development criticized by many managers, who often claim that activist shareholders seek a short-term boost in share price at the expense of the long-term health of the company. Despite their growing power, many investors feel that shareholder interests are still ignored by too many entrenched managements. Several other countries now give shareholders more power than the United States does. Some academic studies conclude that greater shareholder power is beneficial. This lecture will provide an update on these developments. This lecture will be of interest to Ohio attorneys who serve as CEOs, CFOs, or COOs of corporations, serve on corporate boards, represent corporate boards, or work for or represent national or multi-national corporations.

Earlier he had clerked for Judge Paul R. Hays of the U.S. Court of Appeals, Second Circuit, and practiced corporate law in New York with Debevoise, Plimpton, Lyons & Gates. He teaches Business Associations, Mergers and Acquisitions, and Business Planning and is the faculty supervisor for the Business Organizations Concentration. He is the Associate Director of the Law School's Center for Business Law and Regulation. He has published many articles on corporate and securities law, including “Business Lawyers as Enterprise Architects,” The Business Lawyer (2009); “Academics in Wonderland: The Team Production and Director Primacy Models of Corporate Governance,” Houston Law Review (2008); and “Corporate Governance: Still Broke, No Fix in Sight,” Journal of Corporation Law (2005). He also writes on law and religion, as in “Civil Rights for Whom: Gay Rights Versus Religious Freedom,” University of Kentucky Law Journal (2006-07); and “How Does Same-Sex Marriage Threaten You?,” Rutgers Law Review (2007). Mr. Dent serves as a director of the National Association of Scholars and as president of the Ohio Association of Scholars. He co-chairs the Subcommittee on Constitutional Adjudication of the Religious Liberties Practice Group of the Federalist Society. He heads the Law Section of the Association for the Study of Free Institutions. He is chairman of the Ohio State Advisory Committee to the U.S. Commission on Civil Rights.

Successfully communicating their story poses unique and fascinating challenges for advocates. From filing the application to preparing for an immigration interview, an asylum applicant faces an intensive and daunting immigration process that many worthy applicants cannot navigate. Asylum Step By Step is a four-part series designed to provide volunteer attorneys with skills and techniques necessary to successfully represent asylum seekers, to help avoid common pitfalls, and to give advocates an opportunity to learn from experienced attorneys. This session trains advocates to adequately prepare and conduct successful client interviews with individuals that have experienced significant violence and may be suffering from Post Traumatic Stress Disorder.

December 26: Washington State - Public Service Incentive Award Application Deadline

The WYLC Public Service Award was created to encourage new and young lawyers to engage in public service activities. New and young lawyers who are currently active in pro bono/public service or who are interested in becoming active in pro bono/public service are eligible to be awarded one free WSBA-CLE of their choice (typically up to six credits).
The award is for licensed attorneys admitted to practice in Washington who are in good standing and qualify as a young lawyer (under the age of 36 or in the first five years of practice.) The WYLC Public Service Incentive Award subcommmittee will consider the applicants involvement or proposed involvement in pro bono and public service activities as described in RPC 6.1, including:
  • WSBA, ABA, or local bar association activities
  • Volunteering with pro bono and/or public service programs
  • Writing a blog post for NWSidebar and/or writing an article for NWLawyer.
