From hallucinated cases to confidentiality concerns, the use of generative AI in the practice of law has posed some tricky ethical questions for attorneys. A panel of subject matter experts in AI and ethics will discuss the applicable model rules, as well as ABA and state ethics opinions and recent court cases.
Learning Objectives:
- Understanding the basics of ABA Formal ethics OP. 512 (“Generative Artificial Intelligence Tools”).
- Learning which ABA Model Rules of Professional Responsibility apply when using Gen AI.
- Understanding how courts are treating privilege when attorneys utilize Gen AI.
- Examining recent disciplinary decisions relating to the use of Gen AI.
- Learning about Bloomberg Law data on attorneys’ concerns about using Gen AI.
- Attorneys who use generative AI in their legal practice.
- Any partner or supervising attorney who supervises other attorneys who use AI in their legal practice.
Speakers:
- Jessica Blaemire is Content Team Lead on Bloomberg Law’s Litigation team, developing content related to attorney well-being and ethics. She previously practiced commercial litigation for over fifteen years, focusing on complex litigation and appellate practice, and served as in-house counsel to a national banking association. She is actively licensed in D.C. and Virginia.
- Mary Shields is a Senior Content Analyst for Bloomberg Law and a subject matter expert in legal ethics. She edits the ABA/Bloomberg Law Lawyer’s Manual on Professional Conduct and previously worked for the D.C. Office of the Attorney General. She holds a JD from The George Washington University Law School and a BA from The University of Iowa.
- Wendy J. Muchman is a Professor of Practice at Northwestern University Pritzker School of Law, teaching ethics-related courses including Professional Responsibility for Business Lawyers. She presents widely on ethical issues in AI use and served on the ABA Standing Committee on Ethics and Professional Responsibility during the drafting of Formal Opinion 512. She is designated a “Subject Matter Expert” for the MPRE and serves on multiple national ethics committees.
- Lisa Brook is a trial attorney and partner at First Truth Law, representing plaintiffs in complex medical malpractice, nursing home negligence, and personal injury cases. She has taught and presented on AI for numerous bar organizations and integrates AI tools throughout the litigation lifecycle. She serves on the Virginia State Bar Seventh District Disciplinary Committee and the Board of Central Virginia Legal Aid.
