July 23: Conjoint Analysis in Litigation

Description:
Conjoint analysis, long used in marketing research to measure how consumers value product attributes, has increasingly been introduced in litigation as a tool for quantifying economic harm. In consumer class actions and intellectual property disputes, conjoint studies are often proposed to estimate the value consumers place on specific product features, including allegedly misleading claims or protected intellectual property.

This presentation examines how conjoint analysis can be designed and applied in litigation settings. It will discuss the economic principles behind conjoint methods, the types of legal questions they are used to address, such as price premium or apportionment, and the practical considerations involved in implementing a reliable study. The discussion will also highlight key challenges that arise in litigation, including survey design, attribute selection, market realism, and judicial scrutiny under evidentiary standards.

Drawing on recent cases and expert practice, the presentation will explore both the promise and limitations of conjoint evidence. The goal is to provide practitioners with a clearer understanding of when conjoint analysis may be appropriate, how it can inform damages analysis, and what issues commonly arise when such studies are evaluated by courts.

October 22: Opposing Expert Testimony: Preparing Before and Analyzing After

Pete Fowler Construction Services logo Testimony is what legal cases are made of. It is the most compelling evidence of all. Therefore, we should think VERY hard about the testimony in every legal matter we work on. First, we need to elicit the testimony we need, then, we need to analyze, summarize, and use it in well supported arguments.
In our work on building-related claims, we sometimes know (or think we know) what is going on without reviewing testimony, because construction projects are so document intensive. But in other cases we learn almost 100% of the "facts" from testimony. Of course, the "facts" described in testimony are not carved in stone. At best testimony is based on memory, prompted by contemporaneous documentation, and at worst it's intentionally false.
Every litigated case is a competing story of who is right and wrong, and how the law applies. Our primary job as expert consultants and witnesses is to organize and understand the evidence and explain it to our clients in plain language so that they can make smart decisions.
This program is all about how attorneys and experts should collect, organize, summarize, analyze, share, and use testimony to make and support their case. We will begin with our basic analysis. Then we'll be on to preparing for and questioning witnesses, analyzing testimony, and utilizing testimony in opinions and reports.
Description:
Program Outline.
  • Introduction.
  • Construction Claims Analysis.
  • Preparing to Question a Witness.
  • Questioning the Witness.

November 19: Allocation of Responsibility for Construction Defects

Description:
Allocation" is mostly "science," but critical parts include the “art” of applying professional judgment. Construction defect litigation claims come in all possible project types, sizes, and ownership structures. It's rare that construction defect (CD) claims are related to a single party. There are usually multiple parties who share responsibility, and sometimes, there are dozens.

Given how complicated allocation is, it's important to have an engineered process for assigning supportable portions of the cost to repair defects and other damages to each responsible party. This includes making a sensible list of defects ("issues") that can be allocated, assigning values to each issue or category, making a list of all possibly involved parties and understanding their role in the project, and assigning justified portions of responsibility for each issue. A real, professional, supportable allocation has a lot of moving parts. There is lots of math, connected spreadsheets, and professional judgment from expert witnesses and lawyers.

Our panel includes a claims professional, experienced lawyers with understanding of insurance coverage, and building experts who understand defect, analysis, and contractual roles & responsibilities, and a detail-oriented team to transform mountains of data into solutions.

Program Outline
  • Introduction.
  • Working Backwards.
  • Analyzing Construction Defects.
  • Allocation Matrix.
  • Who - What - Where.
  • Professional Judgement.
  • Making a Case.
  • Conclusion.
Learning Objectives
  • Review the process for assigning supportable portions of the cost to repair defects and other damages to each responsible party.
  • Define what parts of allocating responsibility are "science" with little room for argument.
  • Examine what parts of allocating responsibility is more "art," or open to professional judgement.
  • Show the common documents and spreadsheets seen in allocating responsibility for construction defects.
  • Explain the math behind arriving at allocation percentages.

Today’s legal workforce is stretched thin, and the cost of chronic stress shows up in productivity, retention, engagement, client service, and overall firm performance. In a profession built on precision, judgment, and sustained intellectual output, diminished well‑being carries serious professional consequences.

This program explores how burnout and disengagement develop within high‑demand legal environments and how lawyer behavior — especially among those in leadership roles — directly shapes morale, psychological safety, and performance outcomes. Participants will examine why boundaries, resilience, and self‑leadership are not personal luxuries, but business and professional imperatives.

Attendees will leave with practical strategies to embed sustainable performance practices into daily legal work, helping lawyers and legal teams perform at a high level without eroding long‑term effectiveness.

Learning Objectives:

  • Identify the drivers of burnout and disengagement in legal practice
  • Understand why boundaries, resilience, and self‑leadership are professional imperatives
  • Evaluate the impact of leadership behavior on legal teams
  • Develop strategies to embed sustainable performance practices
  • Analyze the business case for investing in lawyer well‑being.

Description:

Social Media in the Workplace: What could possibly go wrong? is a timely CLE program for employment lawyers, in-house counsel, and HR professionals navigating the legal risks of employee social media use. With more than 70% of U.S. adults active on social platforms, workplace social media activity can create reputational harm and significant exposure under employment and labor laws.

The course provides practical best practices for drafting and enforcing workplace social media policies, managing online conduct, and avoiding discrimination, harassment, retaliation, and NLRA issues.

This program will cover:

  • Potential risk of not having or not following workplace social media policies.
  • Required and prohibited social media conduct in the workplace.
  • Ownership of work-related social media accounts and business profiles.
