December 18+22: Breached! Cybersecurity 101

With data security incidents and data breaches happening daily, it’s important for attorneys to turn towards one reality—it’s NOT IF a breach or incident will occur—it’s WHEN.
These incidents are forcing government agencies, companies, law firms, etc. to address, define, and handle these challenges. As cloud technology and big-data analytics have become the norm, cybersecurity risks have increased and it is more important than ever to have both an avoidance and a response plan in place.
During this 60-minute CLE session, we will cover (1) the latest security threats in the news and what’s being done to address/remedy them, (2) explore current data breach laws, (3) the roles and responsibilities of government agencies, and (4) how to prepare a data breach avoidance plan as well as a data breach response plan.
After completing this course, you will be able to:
  • Know the latest cybersecurity threats the U.S. is facing;
  • Understand
    • The different roles and responsibilities of various agencies;
    • What the legal framework surrounding data breaches look like?
    • How both government entities and companies across the globe have been impacted by cyber breaches; and
    • How to prepare both a “data breach avoidance plan” as well as a “data breach response plan.”

December 11, 13+29: Eliminating Bias in the Legal Profession

The goal of this CLE presentation is to discuss bias and where it comes from; why it is harmful; how to detect it and how to eliminate it from our behavior as legal professionals. Practicing law is a bias landmine. From whether we believe a witness or opposing counsel; to how we counsel those in our organization we readily apply judgments to others — coloring our perceptions and thoughts. There is no cure for bias, but you can be more mindful, conscious and monitor your thoughts better. These are the four main questions we will answer in our discussion today: What is bias? What are unconscious and confirmation biases? What are the effects and costs of bias? And, finally how can we avoid bias through thinking about our thinking and implementing best practices?
As a result of attending this course, you will have a better understanding of the following:
• Obtain a better understanding of the types of biases.
• An awareness of the effects and costs associated with bias.
• The benefits of setting good policy and modeling best practices.
• Understanding your ethical obligations.
• Gain insight to offer better legal and compliance counsel.

December 8: AI for Lawyers: Ethical Concerns and Best Practices

Artificial Intelligence (“AI”) and other emerging technologies, while holding the promise of helping lawyers serve their clients efficiently and effectively, can also raise many complex ethical issues. Although an attorney’s ethical obligations remain unchanged regardless of technology relied upon in practice, in certain respects, the current rules of professional conduct may not have entirely “caught up” with emerging AI technology.
This seminar will explore the evolution of tools leveraging AI in legal practice and will cover the ethical issues arising out of the use of AI in the practice of law. This seminar will focus on improving the ability of attorneys to understand Artificial Intelligence and the application of the Model Rules of Professional Conduct (the “Model Rules”) in leveraging Artificial Intelligence, with specific emphasis on the following:
  • Current trends in the legal industry and tools leveraging Artificial Intelligence;
  • An overview of Artificial Intelligence; and
  • Review and discussion on the Model Rules and their applicability to an attorney relying on or leveraging Artificial Intelligence in practice.

In this 60-minute webinar, you'll hear from three Bloomberg Law legal analysts as they call attention to AI-related compliance, litigation, and business trends that you may have missed, and discuss how those issues will shape how corporate legal departments will fare in 2024.
Learning Objectives:
  • See the latest survey data on in-house lawyers' capabilities, expectations, and fears regarding generative AI, and how they differ from their law firm counterparts.
  • Learn more about under-the-radar trends such as companies’ use of employee data to train AI models and the SEC’s strategy to regulate AI use by investment firms.
  • Look ahead to the potential impact AI is making on corporate legal spend and alternative fee arrangements.
Who would benefit most from attending this program?
  • In-house attorneys looking for AI trends with corporate priorities in mind
  • Corporate legal departments and compliance teams

December 4: Avoiding Insurance Bad Faith Claims: A Guide for Policyholders and Insurers

Bad faith litigation remains complex and risky due to unprecedented legal developments and challenges that continue to emerge. Recent court rulings highlight how insurance companies can still be accountable for bad faith if they unreasonably refuse to pay a legitimate claim or settle a third-party claim or lawsuit and the policyholder wins at trial. As the evolving regulatory landscape continues to bring new issues that could affect how “bad faith” applies in future cases, insurers should stay informed to effectively manage their business operations in compliance with legal requirements. On the policyholder side, certain states recognize “reverse bad faith” as a cause of action assertable by insurers, and in other states insurers can assert the insured’s bad faith or misconduct as an affirmative defense to bad faith claims. The speakers will address issues policyholders might face in these jurisdictions.
Listen as our distinguished speakers, Edward Currie of Currie Johnson & Myers, P.A., and Kayla Scroggins-Uptigrove of Spencer Fane, provide a comprehensive discussion of the latest regulatory trends concerning insurance bad faith claims. Speakers, among other things, will offer practical tips and strategies for navigating this evolving legal landscape.
Key topics include:
  • Bad Faith Insurance Claims: Latest Regulatory Trends
  • Notable Cases and Court Rulings
  • Practical Tips and Compliance Strategies
  • What Lies Ahead.
