Feb 2/NYC - Litigating orders of protection and child custody/visitation cases

Attorneys will be trained to represent inMotion-referred clients in order of protection, child custody and visitation matters in Family Court. Procedural and substantive aspects will be discussed in detail, as well as tips on how to represent and advise victims of domestic violence. Training manuals and sample documents will be provided.
A case with an order of protection and/or child custody/visitation issues will be assigned at the training or shortly thereafter. Attorneys can work on the case individually or as part of a team of two or more attorneys.
The assigned pro bono case will require at least one court appearance. Attorneys are expected to commit to taking a case pro bono either individually or as part of a team of two or more attorneys. 
The assigned pro bono case will require one or more court appearances.
You must be an attorney at one of inMotion's Corporate Partner firms in order to participate in this training.

Feb 3/Las Vegas - Preparing Clients to Age Out of the System: Impact of AB350 on Older Teens

The Legal Aid Center of Southern Nevada Pro Bono Project coordinates private attorneys who generously volunteer to provide free legal assistance to individuals who cannot afford an attorney. While the attorneys do not charge the clients their hourly rates, the clients are responsible for any costs in the case that cannot be waived.
Through the Project, pro bono attorneys provide assistance with matters including, but not limited to, real estate, consumer fraud, bankruptcy, and family law, including representation of domestic violence victims and child victims of abuse/neglect.

Professor Strassfeld teaches Torts, Federal Courts, Labor Law, and Legal History. He has published articles on theoretical aspects of causation in the George Washington and Fordham law reviews and on law and the Vietnam War in the Wisconsin, North Carolina, and Duke law reviews. He is coauthor of Understanding Labor Law. His current research includes continuing work on the legal history of the Vietnam War and a history of African American lawyers in Cleveland. He received his B.A. in 1976 (Wesleyan University), his M.A. in 1980 (Rochester), and his J.D. in 1984 (Virginia).

Feb 7/Boston - Intro to Guardianship of Adults - VLP Training


This basic training will focus on how to bring a Petition for the Guardianship of an Adult in the Probate Court. The training will address guardianship of incapacitated persons that are unable to make or communicate decisions due to a medically diagnosed condition. The training will include instruction on how to complete the petition and accompanying pleadings, waive fees and costs, obtain a medical certificate from the incapacitated person's physician, and how to handle issues of service and the bond. 
This is an excellent area of practice for new attorneys as well as an additional area of practice for attorneys experienced in other areas of law, but unfamiliar with the guardianship practice.

Feb 16/Chicago + Web - The Ethical Issues in Mediation


Clifford Law Offices is sponsoring a free two-hour continuing legal education program on the ethics of settlement, negotiation and mediation in the fifth annual Clifford Law Offices Continuing Legal Education Series. The two-hour program will include an examination of various hypotheticals involving negotiation, settlement and mediation. These can be effective ways to advocate for your client, but when an outside person comes on the scene to help the parties come to a resolution, various ethical issues can arise. What are some of the questions that lawyers need to look for when trying to resolve their cases out of court? Jan 26/NYC - Corporate Bankruptcy for Small Businesses in Distress

Obtain the knowledge to assist low-income small businesses - corporations, partnerships, or sole proprietorships - faced with financial distress due to loss of a lease, sustained business slowdown, financing issues, or an unforeseen disaster, by analyzing the relevant circumstances and weighing the potential courses of action.

Alternative Fee Arrangements (AFA's) can sound good: predictability, discounts, and the outside lawyer gets a guarantee of a certain measure of work. In practice, however, there can be unforeseen consequences, especially when two or more firms are assigned aspects of the same litigation and their fees are constrained by AFA's.
Issues include ABA Model Rule 1.5 ("Reasonableness of Fees and Expenses") and its application to "success" fees, the conflict between outside counsel's duties to the client and his/her own financial interest when a fee cap is reached before the matter has concluded, fungibility of services, disparity of effective hourly rates, overloading of firms and load-leveling among firms.

SOPA and PIPA, two proposals in Congress to screw-up the web in the name of protecting intellectual property rights.
Many critics of these bills are people and organizations who know and understand the internet's potential for increasing human knowledge and freedom.

Feb 2/NYC - Counseling the Small Nonprofit Organization

Counsel for an existing nonprofit organization must be aware of the wide variety of legal and business compliance obligations confronted by its clients. This program will cover the essentials of counseling the small to medium-sized nonprofit organization, including: good governance best practices; fiduciary duties of the board of directors; annual reporting to the IRS and the Charities Bureau; and legally-compliant fundraising. In addition, participants will learn to use a nonprofit compliance checklist, a tool that helps nonprofits and their attorneys to keep track of the sometimes bewildering range of nonprofit organization compliance obligations.
This seminar is well-suited to anyone who has completed the Not-for-Profit Incorporation CLE or who has equivalent experience.

Jan 25/Cleveland - A Tour Through the Supreme Court of Ohio's New Citation Rules & Style Guide


New citation rules went into effect January 1, 2012.  Are you prepared? 
This presentation will take you through the Supreme Court of Ohio’s newly issued Writing Manual.  In the Manual, the Supreme Court completely overhauls its earlier Manual of Citations, which it has not significantly revised since 1992.  The Supreme Court now brings Ohio’s citation rules into line with much of the rest of the country by aligning itself with (but not following) both the Bluebook and ALWD’s citation manual. 
In the Manual, the Supreme Court has also, for the first time, put forth a Style Guide.  The Style Guide not only deals with citations, but also with more general punctuation and structural rules, including how to properly use quotation marks, ellipses, footnotes, and headings. 
While the rules in the Writing Manual are not mandatory, the Supreme Court strongly encourages lawyers to follow these rules when writing briefs.  Learning and following these rules will help you to write more persuasive and trustworthy briefs for your clients.  
This presentation will combine lecture with an interactive workshop so that attendees will not only learn the new citation and style rules, but will be ready to put them into practice.  Attendees will also be provided with materials that summarize some of the biggest changes in the areas lawyers use most.

In order to attend the training, you must complete the application form, which is available here. You would be wise to register early, to avoid disappointment when the program fills up.
The Program provides training free of charge to attorneys who agree to represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
  • Malpractice insurance is provided.

Jan 19/Cleveland - Perspectives on Lincoln: The Constitution and Civil War Exhibition Opening


Join C|M|LAW for the opening of the traveling exhibit, “Lincoln: The Constitution and the Civil War,” produced by the National Constitution Center and the American Library Association, with support from the National Endowment for the Humanities.  Cleveland Marshall College of Law will display the exhibition from January 4 to February 17, 2012.
The opening night event features three expert presentations focusing on the exhibition's themes: the civil war as a constitutional crisis, secession, slavery, civil liberties, and Lincoln’s legacy.

Constitutional law expert Professor David Forte will present a talk on how the Civil War experiences of two soldiers, Albion W. Tourgee, and John Marshall Harlan, affected their attitudes toward segregation in their post war legal careers and jurisprudence.  Professor Forte is a Professor of Law at Cleveland-Marshall College of Law at Cleveland State University, and writes and speaks extensively on constitutional law and history, religious liberty, Islamic law, the rights of families, and international affairs.  He is an active Civil War reenactor.
"Lincoln and Civil Liberty: Suspension of Habeas Corpus"
Levin College of Urban Studies Distinguished Professor Dennis Keating will examine Lincoln’s suspension of the writ of habeas corpus in the interest of national security.  Dr. Keating holds a joint faculty appointment in the Cleveland-Marshall College of Law.  He is Director of the Master of Urban Planning, Design and Development Program at Cleveland State University.  He teaches and writes in the areas of housing, neighborhood development, urban planning and land use law. He is a past President of the Cleveland Civil War Roundtable.
"Black and White and Re(a)d All Over: The Role of Early Cherokee Newspapers in Promoting the Cherokee Practice of Black Slavery"
Professor  Lolita Buckner Inniss traces the history of African-ancestored slavery among the Cherokee and the way it was promoted in early Cherokee newspapers, especially in the period leading up to the war, and examines slavery practices under the Cherokee constitution versus the U.S. constitution.  Professor Inniss is a member of the law faculty at the Cleveland-Marshall College of Law and is the Joseph C. Hostetler-Baker & Hostetler Chair in Law.  Professor Inniss’ current research areas include: critical legal rhetoric, gender and the law, and comparative racism.

Climate change, large-scale ecosystem degradation and a large portion of citizenry disconnected from nature – each of these monumental challenges to the future of wildlife were largely nonexistent when the National Wildlife Federation was formed 75 years ago and were barely on the radar screen when the Endangered Species Act and other key conservation laws were passed roughly 40 years ago. 
What strategies and tools will National Wildlife Federation and other conservation advocates need to rely on to ensure that our country’s legacy of abundant wildlife and healthy habitats are passed to our children and grandchildren?
