December 4: DC - Veterans Consortium Pro Bono Program Training #MCLE

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
These trainings tend to fill up quickly, so register asap.

December 1: Seattle - The 'Hub Bill' -- How it Changes Things for Business Lawyers and Paralegals

Effective January 1, 2016, legal requirements common to various business entities, including corporations, LLC’s, limited partnerships and limited liability partnerships, general cooperative associations, and non-profit corporations, have been removed from separate titles in RCW 23B, 23.86, 24.03, 24.05 and 25 and consolidated into a single chapter in RCW 23.95 through the enactment of what is commonly known as the ‘Hub Bill.’ This new chapter covers matters such as entity filing requirements, entity names, registered agents, foreign entities doing business in Washington, and administration dissolution and reinstatement of entities. Any lawyer and paralegal who sets up and helps maintain these types of entities will want to become familiar with this new statute well before January 1, 2016.

November 17: Webcast - Prop 47: The Lawyer’s Role in Implementing California’s Landmark Criminal Justice Reform Initiative

Voters overwhelmingly approved California’s landmark Proposition 47, the Safe Neighborhoods & Schools Act, on November 4, 2014, making California the first state in the nation to end felony sentencing for possessing small quantities of drugs and for petty theft. The law took effect on November 5th and had an immediate impact on tens of thousands of pending cases. Proposition 47 also allows Californians with past low-level non-violent felony convictions to clean up their records, removing obstacles that block them from education and career success. However, most eligible individuals have only until November 2017 to petition for retroactive relief.
At the time of Prop 47’s passage, as many as 10,000 incarcerated Californians were eligible to apply for resentencing, and hundreds of thousands of Californians immediately became eligible to seek a reclassification of a previous felony conviction to a misdemeanor. Since then, thousands of resentencing petitions have been filed and judges have resentenced and released more than 4,000 people from state prison. At the local level, Public Defenders and reentry legal service providers around the state have mobilized to provide relief to as many eligible people as possible, but the clock is ticking and more legal services are needed.

November 18: Cleveland - Contract Interpretation Reconsidered

Contract interpretation is the heart of contract law because the central objective of contract law is to determine the obligations of the contracting parties, which is what interpretation does. Unfortunately, contract interpretation is stuck in an arid debate about the role of text and context, so that courts and commentators spend more time debating the virtues of these two interpretive methodologies than they do thinking about the bargain the parties made. Professor Juliet Kostritsky and I propose a different methodology of interpretation, one that focuses on what obligations a court can infer from the bargaining relationship and the contract terms that are not in dispute. We call this efficient contextualism because it allows courts and contracting parties to determine which contextual details matter and how they matter. This, in turn, allows courts to avoid or streamline trials. My presentation will explain the ideas behind efficient contextualism and how it operates.

November 16: Philadelphia - Veterans Consortium Pro Bono Program Training

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
These trainings tend to fill up quickly, so register asap.

There are over 21 million veterans in the U.S; many of them are not aware of the benefits to which they are entitled. Medical and financial assistance are available to those who have served in the military, but many who need benefits the most are not receiving the Department of Veterans Affairs (VA) benefits that they need. Navigating the VA claims system and applying for discharge upgrades before the Department of Defense are difficult and complex processes. Attorneys play an essential role in assisting veterans with the problems that preclude them from receiving benefits, such as:
  • VA eligibility determinations for those given less than fully honorable discharges for behaviors that were related to minor disciplinary infractions or symptoms of post traumatic stress or other service-related disabilities.
  • Lack of proper paper trails to “service-connect” their injuries.
  • Lack of current medical or mental health evidence documenting severity of symptoms for accurate disability ratings.
What You Will Learn:
Nearly 45% of veterans returning from Iraq and Afghanistan seek compensation from the Department of Veterans Affairs (VA) for service related injuries. A stunning 30% suffer from post-traumatic stress. Many of those who should receive benefits will be denied. All of them will wait months or years for the VA to issue decisions on their claims. Learn how to navigate the VA claims process and to become an effective advocate for veterans in need. This all day program will provide an overview of VA disability law and military discharge review law. You will gain an understanding of different types of military discharges, why they are important, and how you can help veterans with less than Honorable discharges.
The three one-hour morning sessions provide the basics you need to represent veterans before the VA. It will also cover the interactions between VA benefits and other public benefits, such as SSI and SSDI. The morning session fulfills the VA’s requirement for qualifying CLE within the first 12 months of your VA accreditation.

Accreditation by the VA may take several weeks, so do not delay filing your application.You can speed up the process by emailing the form to OGCAccreditationMailbox@va.gov.
Within 12 months of accreditation you are required to complete three hours of qualifying CLE. The morning session of this program satisfies that requirement, but only if you have already received your accreditation from the VA. If you have not received it, you should still watch this program, but keep in mind that you will need to complete three additional hours of CLE within 12 months after receiving your accreditation.
