April 3/Web: The U Visa for Immigrant Crime Victims #MCLE

Passed as part of the Victims of Trafficking and Violence Protection Act of 2000, the U Visa was designed by Congress to encourage immigrant victims of domestic violence and other violent crime to step out of the shadows and report criminal activity without fear about being undocumented.  One of the principal requirements of the U Visa is a certification signed by law enforcement that attests to the victim’s cooperation in the investigation or prosecution of the criminal activity.
In this webinar, Selena Britzius-Negash, an attorney from the Immigrant Law Center of Minnesota, will provide an overview of the legal framework governing the U Visa, including the specific role that the law provides for criminal justice professionals.  In addition, Assistant Mower County Attorney Jeremy Clinefelter, will discuss that office’s approach to the U Visa and will provide examples of cases where they signed an immigrant victim’s U Visa certification.   Preregistration Required.

April 10/NYC: Ethical Considerations for In-House Attorneys: CLE & Reception

Join Alex Kaye, Robin Stephan and Nehal Siddiqui of Milbank Tweed Hadley and McCloy to discuss ethical considerations for in-house attorneys.
The New York Rules of Professional Conduct apply not only to attorneys working at law firms, but also those working in-house at public and private companies and non-profit organizations. In legal matters, the company itself -- and not its directors, officers or employees -- is the client of the lawyer. This can create tension for the in-house lawyer, who is responsible not only to the company, but also to one or more corporate officers or other executives as an employee. Without proper attention, the distinction may be blurred resulting in a conflict.
At this event, the presenters will discuss the issue of client identity, as well as conflict of interest, privilege, business relationships with the company, "no-contact" rule and other topics using real-world examples and illustrations.
It is not clear from the announcement, but this event may be free only to members of New York In-House Counsel.

Wayne Bidwell Wheller, American prohibitionist and lawyer, earned his LLB from Western Reserve University in 1989. From Temperance work, he went on to lead the Anti-Saloon League, pioneering the idea of presssure politics and inventing the modern political lobby.
As attorney for the League, Wheeler was prominent in the fight for prohibition legislation, notibably the Eighteenth Amendment to the Constitution.

April 5/Cleveland + Web: Balancing Privacy, Autonomy, and Scientific Progress: Patients' Rights in the Use of Electronic Medical Records for Non-Treatment Purposes

This program will focus on the impact of the transition from paper medical files to electronic health records outside of the clinical setting. Computerization will enable researchers, public health officials, and others to obtain unprecedented amounts of data that can be used to achieve significant medical and social advances. However, a tension exists between maximizing the benefits of secondary (non-clinical) use of electronic health information (EHI) and deferring to patient preferences regarding what is done with their EHI. Secondary data use thus raises complicated questions about patient autonomy, privacy protections, and the degree to which the potential to promote the common good should supersede concerns about risks to individuals. This program will bring together a distinguished group of experts to explore these fascinating issues.
Health Matrix: Journal of Law-Medicine, one of the most prestigious health law journals in the country, will publish the articles generated by the symposium (Volume 23, Issue 2, due out Spring 2013).

Washington State: How To Earn Six #MCLE Credits a Year Through Pro Bono Service


Attorneys in Washington state can earn six credits a year by doing pro bono services, under APR 11 Regulation 103(f). These are broken down as follows:


Performing pro bono services is an ethical obligation that comes with the privilege of practicing law. However, there's nothing wrong with using this rule every year, so that in Washington State's 3-year CLE reporting cycle, you can earn up to 18 (3x6) credits for free!

April 30/Boston: VLP Training - Intro to Guardianship of Adults

This basic training will focus on how to bring a Petition for the Guardianship of an Adult in the Probate Court. The training will address guardianship of incapacitated persons that are unable to make or communicate decisions due to a medically diagnosed condition. The training will include instruction on how to complete the petition and accompanying pleadings, waive fees and costs, obtain a medical certificate from the incapacitated person's physician, and how to handle issues of service and the bond. April 29/Boston: VLP Training - Fair Debt Collection Practice

This training will prepare volunteer attorneys to assist low-income, unrepresented litigants in civil collection cases through VLP's Fair Debt Collection Lawyer of the Day project at the Boston Municipal Court.  The training will cover civil procedure and practice at the BMC, Limited Assistance Representation, as well as substantive areas of consumer and fair debt collection law that you will need as a volunteer.  Fair debt collection cases are a great opportunity for lawyers seeking courtroom experience.
About this project: 
Volunteer attorneys assist low-income debtors and creditors at the Boston Municipal Court in the Brooke Courthouse on Wednesdays from 9 a.m. to noon and 1:30 p.m. to 3 p.m. on a Limited Assistance Representation (LAR) basis.  LAR means that the attorney only represents the client in the proceeding (case management conference, motion, etc.) before the court that day.  The representation begins and ends on the same day.

April 12/Philadelphia: School-to-Prison Pipeline and Back: Obstacles to Educational Reentry

This course is designed to provide attorneys with an overview of New Jersey's education laws and regulations that often affect the rights of juvenile offenders.  The course will thus cover the following topics: (1) the general right to education in New Jersey; (2) public school registration procedures, including domicile requirements; (3) school discipline procedures, including long-term suspensions and expulsions; (4) alternative school placement; and (5) special education.  For each topic, the course will provide instructions on how to legally challenge school decisions and an explanation of the administrative appeals process.  After completing the course, attorneys will be prepared to represent youth experiencing legal obstacles to public school placement.

April 5/Philadelphia: The Future of Food: Labeling and Litigation

The food industry is under attack. With the rising popularity of movies like “Food Inc.” and “Fast Food Nation,” there is increasing public demand for information about our food – where it came from, how it was grown, and whether it is good for us.
And with that increasing demand has come increasing scrutiny of food labels—by consumers, by states, and by the federal Food and Drug Administration. The result has been an onslaught of recent litigation questioning the use of labels like “all natural,” “organic,” “zero trans fats,” and “low-fat” as well as a push to tighten regulatory controls on how the food industry communicates about food.
Our panel will discuss the legal basis for lawsuits about food labeling, the regulatory landscape affecting labeling claims, and the issues facing companies in today’s dynamic food industry.

April 23/NYC: Avoiding #Bankruptcy for Small Businesses in Financial Distress


Obtain the knowledge to assist low-income small businesses - corporations, partnerships, or sole proprietorships - faced with financial distress due to loss of a lease, sustained business slowdown, financing issues, or an unforeseen disaster, by analyzing the relevant circumstances and weighing the potential courses of action.
While the session is focused predominantly
on filing for bankruptcy relief and using the protections afforded under the Bankruptcy Code, the session also includes a discussion of other key actions by which low-income business owners might salvage or, if necessary, wind down their companies. March 20/St Paul: The Defense of Marriage Act: Its Current and Future Effects on Taxes, Immigration and Employment #MCLE

For the purposes of federal programs and benefits, Article III of the Defense of Marriage Act of 1996 (“DOMA”) defines marriage as being between one man and woman. This definition allows the federal government to deny benefits to gay and lesbian couples married in states that recognize their union. This year the U.S. Supreme Court will hear arguments in the case of United States v. Windsor, challenging Article III.
This panel presentation will focus on three areas of law – tax law, immigration law, and employment law. Local experts will explore DOMA’s current effect on each of these areas, and will speculate on the possible ramifications of the U.S. Supreme Court’s decision.
This CLE is directly related to the practice of law, and is designed to educate attorneys to identify and eliminate from the legal professional and from the practice of law, biases against persons because of sexual orientation. The goal of this CLE is to educate attendees about the elimination of bias on the basis of sexual orientation in the legal profession, the practice of law, and in the administration of justice. In particular, presenters will explore barriers to the full participation in the legal system of gay and lesbian individuals. Panelists will focus on particular areas of law, including tax, immigration and employment.

This program provides training free of charge to attorneys who agree to counsel and/or represent a veteran/VA claimant or family member before the Veterans Court. As well as receiving the day-long training, attorneys who participate are assigned a case that has been screened for merit and provided a screening memo outlining the issues in the case. Volunteers are also assigned a mentor (a practicing veterans’ law lawyer or practitioner) to give advice and share sample pleadings. Attorneys also receive the Veterans Benefits Manual (VBM) and other resource materials.
Attorneys who participate receive free training in exchange for a commitment to handle at least one appeal that is before the Veterans Court. Attorneys with little or no prior veterans’ law experience are generally able to capably represent an appellant before the Veterans Court provided they attend the training seminar and maintain contact with their mentor. Most cases can be completed in 50 to 60 hours; many cases may require fewer hours. A typical case lasts about 1 year from the time that the attorney enters the case. Some cases may be resolved more quickly and some may take longer.
These trainings tend to fill up quickly, so register asap.
