January 23: What Plan Sponsors and IRA Owners Need to Know About the SECURE Act

2019 ended with a bang for stakeholders of retirement plans with the passage of the SECURE Act, a major piece of federal legislation that will alter the retirement plan landscape for years to come. Signed into law as part of a $1.4 trillion bipartisan spending bill on December 20, the SECURE Act (the full name is the “Setting Every Community Up for Retirement Enhancement Act of 2019”) contains a wide-ranging assortment of provisions designed to expand access to retirement savings for small businesses and part-time employees, promote the availability of annuities in defined contribution plans, and simplify or repeal many complexities and quirks in various existing administrative and plan design rules. It funds these tax expenditures in large part by eliminating the popular use of the “Stretch IRA” as a means of tax-efficient intergenerational wealth transfer.

This two-hour ethics course explores valuation ethics and cases. A power-point presentation is backed up by an outline and a complete 10-case file for reference. The presentation implies a possibility that IRS finds that valuation practitioner discipline may be less efficient than various practitioner penalty provisions, and the use of taxpayer punitive economic consequences. An implied larger problem is a short sighted appraiser selection criteria that results in (a) minimalist appraisal, by (b) unqualified or low-effort appraisers; much of which may be based upon taxpayer reluctance to ascribe value to a detailed, high-quality appraisal.  The case facts teach lessons through the stories of published cases.

Course Objectives:

  • Identify current principles in play for a potential winning appraisal while determining a strategy to avoiding both ethics entanglement and a more negative taxpayer outcome.
  • Personally derive a feel for what is needed to protect the taxpayer, the tax practitioner and the appraiser, and conclude whether or not the weight of a misstep is squarely on the taxpayer.

  • Identify a path to a more efficient arrangement for obtaining a high quality appraisal report and appraiser; the taxpayer and/or tax practitioner then understands and enables a maximized opportunity to determine taxpayer's own efficient, detail justifiable, highest taxpayer outcome preparation.

January 30+February 20/Cleveland: Election Administration: Law and Practice

The Cuyahoga County Board of Elections has been approved by the Supreme Court of Ohio to offer a Continuing Legal Education (CLE) credit (general hours: 4.0) for a course titled Election Administration: Law and Practice”. Designed specifically for attorneys, this seminar addresses Federal and State election law on such topics as voter registration and residency, voter identification requirements, ballot production and tabulation, neutrality and accessibility, physical security of equipment, and planning for contingencies.
Practical knowledge of elections qualifies attorneys to work as Precinct Election Officials (PEOs) at one of 336 polling locations in Cuyahoga County. Attorney-PEOs will be asked to serve in locations where highly skilled help is most necessary, likely as a supervisor in a location with several assigned precincts.

    Twenty three states and the District of Columbia have legalized marijuana in some form and a few more have decriminalized it. Four of these states and DC have legalized marijuana for recreational use as well as medical use. However, marijuana remains illegal under federal law and employers, regardless of whether or not marijuana is legal, likely will not want their employees using it at work.
