Apr 16/Boston: Intro to Guardianship of Minors - VLP Training




The training will provide a nuts and bolts approach to handling an uncontested guardianship of a minor case. The training will include instruction on how to complete the petition and accompanying pleadings, waive fees and costs, obtain assents from the ward's parents, and how to handle issues of service and the bond. This class will give participants the tools they need to handle simple guardianship of minor cases from filing through the establishment of a permanent guardianship. 
In addition, attorneys and law students who attend this class will be qualified to participate in the VLP/Senior Partners for Justice guardianship petition assistance projects in the Norfolk (Wednesday), Middlesex (Thursday) and Suffolk (Tuesday and Wednesday) Probate & Family Courts on Fridays from 9 a.m. to 1 p.m. These are limited assistance representation projects in which volunteers help pro se petitioners complete and file the guardian of minor petition and other pleadings.

Apr 13 DEADLINE: June 7-8 Pathways to Justice Conference Scholarships

The Pathways to Justice Conference, June 7-8, 2012 at UC Hastings College of the Law in San Francisco, offers up to 10 MCLE credit. You may be able to attend free if you apply for a scholarship. According to the Scholarship Announcement
"Thanks to a grant from the California Bar Foundation, the State Bar of California is pleased to announce that a limited number of scholarships are available to cover registration fees for individuals interested in attending the Pathways to Justice Conference, June 7-8, 2012 at UC Hastings College of the Law in San Francisco. 
Scholarships are intended to enable legal services advocates, court staff or contractors and justice partners from small and rural programs that generally have fewer resources and opportunities for training to fully participate in Pathways to Justice.
Scholarships will cover the conference registration fee valued at $175 (the Early Bird 2-day rate for registrants from the nonprofit/court-affiliated/government setting).  Partial travel expenses may be provided on a very limited, case-by-case basis. Scholarship applicants will be required to submit an application by Friday, April 13, 2012. The State Bar staff will determine eligibility based on criteria below.
CRITERIAEligibility for scholarship awards are based on one or more of the following criteria:
  • Staff from a main or branch office of a "qualified legal services provider" (grantee of the Legal Services Trust Fund Program, also referred to as an IOLTA-funded program) located in a rural area to be a speaker and/or attendee at the conference.
  • Staff from a main or branch office of a 'qualified legal services provider" with qualified expenditures of $500,000 or less per office to be a speaker and/or attendee at the conference.
  • Staff from a non-IOLTA funded entity providing legal assistance to low- or moderate-income individuals such as a court-based program, lawyer referral service, public interest law project, or other access to justice partner located in a rural area to be a speaker and/or attendee at the conference.
  • Staff or a board member from any IOLTA or non-IOLTA funded program with compelling extenuating financial circumstances to be a speaker and/or attendee at the conference.
  • Priority will be given to individuals from entities that did not send an attendee to the 2008 Pathways to Justice Conference in Los Angeles."

I'd thought I'd seen every form of free CLE there is, but CLE Tennessee has come up with a new one: a contest!
According to an add in the top right corner of their website, if you sign up for their newsletter, you're automatically added into a contest to win 5 free CLE credit hours!
I just don't see a downside to this. Their list of courses includes over 70 on-line courses on a variety of subjects, and there's plenty of traditional live courses as well. If you can use Tennessee credit, why not subscribe to their free newsletter and take a chance on free credit?

Mar 26-30/NYC: NYS Courts Access to Justice Program’s FREE Bridge-the-Gap CLE

Recent law school graduates and newly admitted attorneys may fulfill their first or second year Mandatory CLE requirements through the NYS Courts Access to Justice Program’s FREE Bridge-the-Gap CLE Bridge the gap between law school and the realities of practicing law through presentations by experienced practitioners and a HANDS-ON Pro Bono Practicum that will provide
participants with the opportunity to:
• gain client interviewing skills,
• represent clients in court,
• negotiate with opposing counsel, and
• argue before a judge.
Gain invaluable experience in lawyering while helping some of New York’s most disadvantaged civil litigants obtain due process of law. Participants are supervised on site by attorneys with expertise in Family Law, Housing and Divorce law.

Speaker:
Professor Ronald W. Staudt is the associate vice president of law, business and technology and a professor of law at IIT Chicago-Kent College of Law. He teaches Copyright Law, Intellectual Property Strategies, Internet Law, Public Interest Law & Policy, Justice and Technology Practicum, and Access to Justice and Technology. He is director of the Center for Access to Justice & Technology (CAJT)--a law school center using Internet resources to improve access to justice with special emphasis on building Web tools to support legal services advocates, pro bono volunteers and pro se litigants. Current CAJT projects include the law school's Public Interest Certificate program; A2J Author, a collaboration with the Center for Computer-Assisted Legal Instruction to build new computer interfaces for self-represented litigants; and the Self-Help Web Center at the Cook County Courthouse in the Daley Center, where law student volunteers help self-represented litigants to use technology tools developed at CAJT.
Professor Staudt has written numerous articles and books on technology and law. His most recent book is a report co-authored by Charles L. Owen, Distinguished Professor of Design at IIT's Institute of Design, and Edward B. Pedwell, titled Access to Justice: Meeting the Needs of Self-Represented Litigants.
Professor Staudt is a fellow, board member and vice president of the College of Law Practice Management, a member of the ABA Law Practice Management Section's E-Lawyering Task Force, a member of the advisory council of the ABA Standing Committee on the Delivery of Legal Services, and a member of the ABA TechShow 2006 Planning Board.

The hosts have not applied for CLE credit; however attorneys have successfully applied for credit for some sessions in some states, e.g. Washington.
The TDLP series runs for one hour a week for nine weeks and will feature a different guest speaker each week. Each class will be delivered via webcast and will have a 30 minute lecture presentation followed by a question & answer period and an online, interactive homework assignment for all course students to complete.
The presentations will be recorded and posted to the course blog. Cost:

The Pregnancy Discrimination Act (PDA) has generally been hailed as a success story that has brought pregnant workers from an era of exclusion to an era of inclusion.  However, the law has utterly failed to help women who are partially, but not fully disabled by pregnancy gain the accommodations necessary to allow them to continue to work.
This lecture will explore the misunderstandings and misperceptions that have hampered the ability of the PDA to make room for pregnant women's full participation in the workplace.

Mar 20/Cleveland: Censorship and Death

Americans like to believe that prior licensing of speech and the press came to an end in the seventeenth century.  This was the sort of censorship that the Inquisition imposed on Galileo, that the English abandoned in 1695, and that the First Amendment most clearly prohibited.  Nonetheless, the federal government has revived the licensing of speech and the press.  It does this by means of committees known as "Institutional Review Boards," and although it claims that it imposes the licensing to protect Americans, it thereby licenses much academic speech and publication.  Professor Hamburger will discuss this reversion to 17th century censorship and its consequences for Americans.

Speakers:
Judge Brisbois is a member of the White Earth Band of Ojibwe Indians, and was raised in Hibbing, Minnesota. He received his B.A. and J.D. degrees from Hamline University in St. Paul, Minnesota. Before his appointment as Magistrate Judge, he was a partner with the Minneapolis law firm of Stich, Angell, Kreidler, Dodge & Unke, PA, and served in the Judge Advocate General’s Corps. He has been president of the Minnesota State Bar Association, and active in the Minnesota American Indian Bar Association, the 1st, 4th and Iron Range District Bar Associations, and the Minnesota Defense Lawyers Association. Judge Brisbois is the first American Indian to serve as a United States Magistrate Judge in Minnesota and only the second American Indian to ever hold the position in the United States.
Professor Ann Tweedy came to Hamline from Michigan State University Law School. She is a graduate of Bryn Mawr College and University of California, Berkeley School of Law, where she clerked for the ACLU, California Indian Legal Services, and the Contra Costa Public Defender. After law school, she clerked for Ninth Circuit Court of Appeals Judge Ronald Gould and Oregon Court of Appeals Judge Rex Armstrong. She also practiced law with Kanji and Katzen in Seattle, WA, and served as tribal attorney for Swinomish Indian Tribal Community, near La Conner, WA , for four years. She publishes and teaches in Federal Indian Law, Sexual Orientation Law and Property.

The class will address both contract issues the attorney should be aware of as well as due diligence that the attorney must conduct on behalf of the client.
