July 8: NYC - Mortgage Foreclosure

The lecture will cover the foreclosure process including pre-foreclosure and post- foreclosure proceedings. Topics will include the Fair Debt Collection and Practices Act (FDCPA); default, acceleration, and tender; election of remedies; pleadings; types of appearances, mortgagor’s affirmative defenses; resolutions; role of the receiver and the referee; judgment of foreclosure, rights of junior-lien holders, foreclosure sale procedures; bankruptcy including liquidation, repayment plans, automatic stays, serial bankruptcy filings and fraudulent transfers; closing; surplus money proceedings; deficiency Judgments; eviction after foreclosure; and foreclosing on co-ops and condominiums.
