Hosted by the Economic Policy Institute, Harvard Labor and Worklife Program, National Consumer Law Center, and Towards Justice, this webinar will provide a lively discussion among advocates, attorneys, academics, and current and former government officials about how consumer laws can be used to protect workers and address corporate abuse in the labor market. Often, workers are exploited in ways that can be addressed through both consumer and workplace laws – or in ways that fall in the cracks between the two:
  • A janitorial company sells franchises to workers, with unfair and fraudulent terms under which no one can make a profit;
  • A trucking company provides training for drivers, while also roping them into lease-to-own contracts requiring excessive repayment if the driver leaves the job;
  • A gig company conceals from workers information about pricing and jobs; or
  • An app-based delivery company promises workers their tips, or represents to customers that tips will go to workers – but instead keeps some or all gratuities for its own use.
Government agencies and worker/consumer advocates alike have begun to rely on laws traditionally used to protect consumers as a way of addressing unfair and deceptive labor market practices that target working people, often immigrants and people of color. Voting Rights Litigation Today: Strategies for Moving from Voter Suppression to Election Protection (Throughout July 2021)

Across the country, and especially in the Deep South, a concerted assault on voting rights is taking place. Since the Supreme Court struck down a key provision of the Voting Rights Act of 1965 – one of the most successful pieces of civil rights legislation designed to increase voter registration, turnout, and fair electoral schemes – we have seen a proliferation of policies that do just the opposite. Georgia and Florida have passed severe voter restrictions following the historic 2020 elections, Alabama has enacted onerous photo ID requirements, counties continue to close polling places at an alarming rate, and state legislators in general are erecting burdensome voter eligibility requirements. The Supreme Court also has upheld extreme forms of partisan gerrymandering and approved of discriminatory voter purge procedures. In response, the Southern Poverty Law Center and partner organizations have mounted a massive campaign to challenge these regressive policies, improve access to the ballot box, and demand government accountability. This course will address these issues and many more as we gear up for the 2021 redistricting cycle and 2022 mid-term election season.

September 9: Supreme Stalemates

The U.S. Supreme Court is famously tie-breaker free. When the Court is shorthanded and locks up 4–4, it issues a dry, one-sentence order: “The judgment is affirmed by an equally divided Court.”
Most American justice, though, is dispensed in state judiciaries. How do unsatisfying SCOTUS stalemates compare with what happens in state high courts? How do the laboratories of democracy deal with deadlock? Turns out, a supermajority of states—33—reject the SCOTUS “ties happen” approach, using various substitute-justice mechanisms to avert or break legal logjams.
Judge Willett will survey impasse resolution in state supreme courts and evaluate the good, bad, and in-between of the sundry approaches. This much is certain: Supreme stalemate is a vexing issue, and some state mechanisms to avert or break ties are plainly more juris-imprudent than others.

July 8: Adapting to the AML Act of 2020

The Anti-Money Laundering Act of 2020 (AMLA) is the most significant anti-money laundering (AML) legislation since the USA PATRIOT Act was enacted twenty years ago. It contains important provisions that are designed to make the Bank Secrecy Act (BSA) regime more risk-focused, while promoting information sharing, encouraging use of technology, and streamlining reporting requirements. The AMLA represents a much-needed and long overdue update of the BSA framework, which is now more than 50 years old. Among other things, it will require legal entities to:
  • Provide identifying information on their beneficial owners to FinCEN (instead of financial institutions), which will compile the information into a National Registry;
  • Task the Treasury Department with issuing a set of National Anti-Money Laundering and Countering the Financing of Terrorism Priorities;
  • Create incentives and protections for whistleblowers; and
  • Impose enhanced penalties for certain violations.
In this session, we will explore the key aspects of this important legislation, its impact on financial institutions, and the implications for the BSA/AML framework in the months and years ahead.

August 3: Prejudgment Attachment Statutes

Elliott Feldman and Joseph Scopelitis will present a Cozen O'Connor webinar titled, "Prejudgment Attachment Statutes (CA, CO, IL, KS, NJ, and TX)" on Tuesday, August 3. This webinar will focus on prejudgment attachment statutes in California, Colorado, Illinois, Kansas, New Jersey, and Texas. Attachments are provisional remedies designed to seize the property of a defendant or prospective defendant to hold as security for the satisfaction of an eventual judgment. They are statutory remedies designed to prevent responsible parties from fraudulently or improperly conveying property before a judgment has been issued by the court, and thereby preserve the rights of claimants and creditors. Therefore, pre-judgment attachments can serve as a valuable pre-litigation/litigation tool.
This program will discuss the specific requirements of attachment statutes for exemplar jurisdictions and the procedural steps that need to be taken.
