October 28: An Anomalous Status: Rights and Wrongs in America’s Territories

More than 100 years ago, the Supreme Court issued a series of decisions collectively known as the Insular Cases that held that the “half-civilized,” “savage,” “ignorant and lawless” “alien races” that inhabited Puerto Rico, Guam, and other American territories were not entitled to the same constitutional rights and protections afforded to other Americans and were not on the path to full political participation.
Though the flawed reasoning of Insular Cases has long since been discredited, federal courts have continued to rely on those cases to issue decisions that result in disparate treatment of Americans residing in territories. And despite its significant presence throughout American constitutional law, essentially none of the law governing U.S. territories is taught in law school. 
This symposium aims to critically examine American territory law and leave attendees with a greater understanding of and appreciation for America’s territories and the legal framework in which they operate.

July 28: Research & Drafting Techniques for Finance: Replacing LIBOR

In July of 2017, the United Kingdom’s Financial Conduct Authority announced that LIBOR (London Interbank Offered Rate) will be phased out in 2021, as regulators look to replace it with a more reliable alternative. LIBOR is a benchmark rate that is calculated from reported interest rates that select banks pay to borrow from each other on an unsecured basis. As the transition away from LIBOR towards a new, alternative benchmark rate is well underway, there are several steps lenders and finance counsel should take now to amend existing transaction documentation and to manage new transactions. This course will discuss the history, present and future of LIBOR.

July 25: Educating Peace through Law: TWAIL-ing the Peace Brigades International

Please join us on Monday, July 25, 2022 as Dr. Thamil Ananthavinayagan of the University of Nottingham (UK) School of Law, describes his experience with the legal and practical problems in providing protective, non-violent accompaniment to members of organizations threatened by political violence. 
Being the chairperson of the Irish Section of PBI (Peace Brigades International - a non-partisan, non-governmental organization founded in 1981 to protect human rights and promote non-violent transformation of conflicts) since 2021, he will use his academic scholarship - the Third World Approaches to International Law (TWAIL) - to sketch and explain the necessity of diverse approaches to human rights to disrupt conflicts and pave the way to peace through law

It’s not very easy but it is a very valuable skill that can save lots of money. Remediation and repair projects are VERY expensive and yet so few people have the skill to analyze the fairness and value of the costs.
Cost estimating is a profession with specialized skills, training, education, and certifications; but it’s not rocket science. There is some math, so it’s scary to a lot of people. There are many moving parts in a big estimate: designers, insurance, labor, materials, equipment, subcontractors… The list can go on and on.
So how does a normal person without years of experience understand and evaluate an estimate? We are going to show you. Remember: Construction is not terribly difficult to understand. It's really just sticks and stones and pieces of glass and steel stacked neatly. What makes it hard is the complexity; the sheer number of components requires an organizational system. We have one and we present it in this 1-hour program.

    September 20/Cleveland: The Chevron Doctrine


    Since the Supreme Court’s 1984 decision in Chevron v. Natural Resources Defense Council, this judicial review has been highly deferential: courts must uphold agency interpretations of unclear laws as long as these interpretations are “reasonable.” But the Chevron doctrine faces backlash from constitutional scholars and, now, from Supreme Court justices who insist that courts, not administrative agencies, have the authority to say what the law is. Critics of the administrative state also charge that Chevron deference enables unaccountable bureaucratic power.
    In The Chevron Doctrine: It's Rise and Fall and the Future of the Administrative State, Columbia University law professor Thomas Merrill reviews the history and immense consequences of the Chevron doctrine and suggests a way forward. Recognizing that Congress cannot help relying on agencies to carry out laws, Merrill rejects the notion of discarding the administrative state. Instead, he focuses on what should be the proper relationship between agencies and courts in interpreting laws, given the strengths and weaknesses of these institutions. Courts are better at enforcing the rule of law and constitutional values; agencies have more policy expertise and receive more public input. And, unlike courts, agencies are subject to at least some political discipline. The best solution, Merrill suggests, is not of the either–or variety. Neither executive agencies nor courts alone should pick up the slack of our increasingly ineffectual legislature.

    Privacy by design—the notion that organizations should consider data privacy at each stage of product development and across business practices—has been advocated by the Federal Trade Commission and other privacy regulators for quite some time. But what does this concept mean in practice for attorneys who represent companies that rely on rapid innovation and the constant collection, use, and sharing of personal data?     September 13: “You have the right to remain silent…”

    This session will explain why the Miranda warning is so easily misunderstood (or not understood at all); the result is the abrogation of rights that the warning was designed to protect. Numerous factors contribute to the poor comprehension (and low readability scores):
    • the situation and contexts in which the warning is used;
    • the special linguistic abilities required for understanding it;
    • the grammar, vocabulary, event sequencing, and other features of the text.
    The listener must comprehend all of this in less than a minute, which is the time it takes to deliver the warning, and sometimes obstacles are concurrent, thus multiplying the burden of comprehension. The speakers will conclude with a suggested workaround, which is markedly different from the standard version but accomplishes the intended aims.
