October 27: A Discussion on Forensic Onsite Claim Investigations

At Pete Fowler Construction, we work on hundreds of projects every year, and most of them have expensive problems. In addition to our traditional services like inspection & testing, quality and construction management, we are often hired to help clients understand the technical issues and costs of insurance claims and litigated matters related to buildings. We regularly testify as expert witnesses, so our work gets scrutinized by lawyers who have an interest in making us look bad. So, what some people call an "inspection," which seems too passive, we consider proactive "investigations" where we seek understanding and document this work in a "forensic" way that is professional enough to be presented in a court of law. Our work includes single-family homes, skyscrapers, hospitals, factories, highways, and everything in between.

October 25+28: Navigating The New Town Square: Cultivating Competency In Basic Online Legal Research

Bill Gates once said, “The Internet is becoming the town square for the global village of tomorrow.” For attorneys and for all individuals, our lives, professionally and privately have expanded through the global power of the internet. The vast amount of information available and the many different platforms to obtain that information grow daily and have grown exponentially over the last 25 years. This information and technology impacts the way attorneys practice law. It also brings forth more issues and new laws that your clients may face. The many ways technology can aid attorneys in locating the best and most on point statutes, caselaw, secondary materials and all relevant materials can be overwhelming. The comments to the model rules of professional conduct governing attorneys state that to maintain competency a lawyer should keep abreast…[of] the benefits and risks associated with relevant technology. The goal of this course is to assist attorneys in navigating online legal research so they feel more confident and competent when researching subjects important to their work.

Kirkpatrick served on the firm's recruiting committee and co-led the summer associate program one summer. Kirkpatrick's experience also includes a clerkship with the Honorable Matthew E. Johnson of the Minnesota Court of Appeals.
  • Professor Melissa Shultz has taught legal writing, family law, and a domestic violence practicum and has participated actively in bar preparation for the past five years. October 18: A New Path to the Sunshine: Reconsidering Physicians’ Financial Conflicts

For decades, legislators, scholars, and practitioners have expressed dismay over financial conflicts of interest between pharmaceutical and medical device manufacturers and the physicians who use their products.
Industry now spends hundreds of millions of dollars annually complying with the Sunshine Act—enacted a decade ago to provide patients with insight into whether their physicians’ recommendations may be tainted by payments from manufacturers. Yet despite its goal of providing transparency, few patients know this information exists, and examination of the program reveals its problems run far deeper than lack of publicity.
Join Professor Jacob Elberg as he analyzes key questions striking at the heart of the doctor-patient relationship and proposes a new policy aimed at restoring trust in the health care system.
