May 29: Allocation of Responsibility for Construction Defects

Title:
Allocation of Responsibility for Construction Defects
Description:
"Allocation" is mostly "science," but critical parts include the “art” of applying professional judgment. Construction defect litigation claims come in all possible project types, sizes, and ownership structures.
It's rare that construction defect (CD) claims are related to a single party. There are usually multiple parties who share responsibility, and sometimes, there are dozens.
Given how complicated allocation is, it's important to have an engineered process for assigning supportable portions of the cost to repair defects and other damages to each responsible party. This includes making a sensible list of defects ("issues") that can be allocated, assigning values to each issue or category, making a list of all possibly involved parties and understanding their role in the project, and assigning justified portions of responsibility for each issue.
A real, professional, supportable allocation has a lot of moving parts.

February 27: Construction Site Accident Claims Webinar

Title:
Construction Site Accident Claims Webinar
Description:
It is no secret that a construction site is not a playground. Few places are more potentially dangerous; the list of safety regulations goes on and on to safeguard the wellbeing of construction professionals. Still, humans are flawed and prone to error, with three construction site fatalities and hundreds of injuries each day here in the US.
When these accidents happen, the companies involved are obligated to step in and investigate the details, rendering a thoughtful opinion about the facts surrounding the accident. No two claims are the same. Our analytical method walks through a professional investigation and analysis regardless of the specifics of the claim, like how the scientific method aids in discovery of the workings of our natural world.
Anyone who works with construction of any kind has an interest in being prepared for construction site accident claims and knowing how to handle them effectively. Insurance professionals need to know how to investigate a claim fairly and thoroughly with the full context of construction site safety standards. Legal professionals need the specific knowledge necessary to best represent their clients. Construction professionals should be aware of the process involved in an investigation.

Title:
Construction Defects from the Developer & GC Perspective
Description:
Construction Defect Litigation from the Developer/GC Perspective is a series of case studies in successful planning, analysis, and execution of expert work on behalf of developers and general contractors.
Construction defect litigation can be expensive, confusing, and long-lasting, but it doesn’t have to be. Through this presentation, we will break down the process from the Developer/GC point of view, and provide approaches and alternatives in construction defect litigation.
This Webinar will demonstrate how developer and general contractor litigation should be investigated and executed from an expert consultant perspective, using the most current ASTM standards and science-based building performance analysis. In preparing for trial, you want the highest level of professionalism in conducting building performance investigations. Investigations should involve conformance with the best standards of practice, a written investigation plan, random selection protocol for inspection and testing locations so the data is not biased, a comparison of performance to perfection, realistic repair estimates, and allocations to trade contractors. This program will include real-life case studies applying various approaches to construction defect litigation matters and examples of good work.

Title:
Admissibility of Expert Testimony
Description:
In today’s legal landscape, expert testimony is often crucial in litigation, arbitration, and mediation. However, courts apply rigorous standards to determine whether expert testimony is admissible. For those practicing in California, the CA Supreme Court’s decision in People v. Sanchez redefined the standards, significantly impacting how expert testimony is evaluated.

Through these insights, attorneys and claims professionals will gain a clearer understanding of the expert’s role, the adversarial process, and ethical considerations in expert testimony.

Title:
Investigating and Estimating Fire Claims Webinar
Description:
Investigating and Estimating Fire Claims is intended to help claims professionals understand the process from beginning (Notice of Loss) to end, especially when they end up in a dispute or litigation.
Investigating fires is a well developed profession with its own collection of professional guidelines governing best practices, and we will explain them. Investigating fires requires a qualified fire investigator to apply the applicable investigative standards to develop a hypothesis regarding it's origin and cause. It's not always cut and dry and we will discuss some of these scenarios.
Cost estimating is a profession with specialized skills, training, education, and certifications; but it’s not rocket science. It's always about figuring out what it will take to do construction work; in this case, the construction is repairing fire damage. There is some math in all estimating, so it’s scary to a lot of people. We will explain all of this as simply and clearly as possible.

February 12: 22 Lewd Chinese Women: Chy Lung v. Freeman

In 1874, a ship arrived in the port of San Francisco carrying 600 passengers from China. A state official inspected the passengers and determined that 22 Chinese women, who were traveling alone, were prostitutes. He required a bond of $500 each for the women to disembark. The captain refused to post the bonds, and the women were detained under California law.
Legal proceedings followed, including a four-day trial and appeals all the way to the United States Supreme Court, raising issues of due process, human and civil rights, and the power of states to regulate immigration.
This program tells the story of the women, through narration, reenactment of court proceedings, and historic photographs. Title:

March 3: Breached! Cybersecurity 101

With data security incidents and data breaches happening daily, it’s important for attorneys to turn towards one reality—it’s NOT IF a breach or incident will occur—it’s WHEN. These incidents are forcing government agencies, companies, law firms, etc. to address, define, and handle these challenges. As cloud technology and big-data analytics have become the norm, cybersecurity risks have increased and it is more important than ever to have both an avoidance and a response plan in place.
During this 60-minute CLE session, we will cover
(1) the latest security threats in the news and what’s being done to address/remedy them,
(2) explore current data breach laws,
(3) the roles and responsibilities of government agencies, and
(4) how to prepare a data breach avoidance plan as well as a data breach response plan.
After completing this course, you will be able to:
  • Know the latest cybersecurity threats the U.S. is facing;
  • Understand the different roles and responsibilities of various agencies;
  • What the legal framework surrounding data breaches look like?
  • How both government entities and companies across the globe have been impacted by cyber breaches; and
  • How to prepare both a “data breach avoidance plan” as well as a “data breach response plan.”
