November 15/Indianapolis: Indianapolis Women Working for the Right to Vote: the Forgotten Drama of 1917 #MCLE


Following the passage of Maston-McKinley Suffrage Bill, in the fall of 1917, between 30,000 and 40,000 Indianapolis women registered to vote. The bill, passed earlier that year, granted women the right to vote in municipal elections, school elections, liquor matters, and constitutional convention elections. While the bill did not grant women the right to vote in presidential and state elections, this “limited suffrage” gave them a significantly amplified voice in the public realm.
William Knight, an Indianapolis lumber company owner, quickly filed a lawsuit claiming the legislature did not have the right to extend their voter base through these means. Both the Marion Superior Court and the Indiana Supreme Court ruled in favor of Knight and women lost their right to vote.

He has been involved in developing innovative legal services delivery systems for over 30 years, first as part of the initial working group that created the National Legal Services Program, and then later as Director of the Center for Legal Studies at Antioch Law School in Washington, D.C., the nation's first clinical law school, and later President and Dean of the Philadelphia Institute for Paralegal Training, the nation's first paralegal school. He was the founding CEO of Automated Legal Systems, Inc., an affiliate of The Philadelphia Institute, one of the first legal software companies to publish legal applications for the personal computer in the early 1980s. He is an acknowledged expert on the delivery of online legal services.

November 5/Web: Family Member Entitlement to VA Pension Benefits (#Veterans #MCLE)

The CLE webinar of the Texas Veterans Legal Assistance Project will educate attendees on Family Member Entitlement to VA Pension Benefits.  It will provide an overview of (1) who is considered a qualified family member of a Veteran, (2) benefits available to qualifying survivors of a deceased Veteran, and (3) special allowances pursuant to Title 38 of the United States Code and Title 38 of the Code of Federal Regulations.
Attorneys in private practice who are providing legal assistance to low-income Texas Veterans, on referral from a Legal Aid program or a local bar association volunteer lawyer program, can receive back-up and support from the AmeriCorps Equal Justice Works Fellow in the Texas Veterans Legal Assistance Project.  For further details, or to request such back-up and support, please contact emarfin@tlsc.org.

November 9/Oxford, MS: The Impact of Concussion Lawsuits on the Future of Football #MCLE


Once thought to be a badge of honor that doctors could quickly “cure” with a sniff of smelling salt, concussions have now become the subject of litigation that could threaten the future of football and other contact sports. Recent medical studies consistently show serious long-term effects for athletes who have had multiple concussions, including serious brain trauma and reduction in life expectancy. Where re-entering the game after a concussion, or even the week after a concussion, used to be common practice, there is an increasing burden on team physicians and the athletes themselves to consider the implications of going back onto the field. In light of this research, the four major American sports leagues have implemented concussion policies and procedures, but many question if these policies alone are sufficient to protect the athletes from permanent injuries.
The pending litigation against the National Football League by over 3,500 of its former players will be the first case to address the question of concussions on a larger scale.  At its heart are tort law questions of duty, causation, and assumption of risk by athletes, trainers, and administrators in responding to these injuries. How should courts allocate liability in such cases?
Further, this is a problem that transcends professional football, extending both to high school athletes and to female athletes. In fact, women’s soccer is the sport with the second highest amount concussions after football, and the Center for Disease Control and Prevention estimated that nearly two million teenage athletes suffer brain injuries every year.
Presenters include a former NFL player, the lead attorney in the suit against NFL in Mississippi,  a head of the Concussion Center at Vanderbilt University, and two leading sports law professors.
