October 24/Web: Representing Unaccompanied Children in Immigration Proceedings: Learn How to Help #probono #MCLE

The number of unaccompanied children placed in U.S. custody in Fiscal Year 2012 has reached an historic high: over 14,000 children, more than double the number last year.  Many of these children, who range from toddlers to teenagers, are fleeing abuse, abandonment, and persecution in their home countries, or are victims of human trafficking or other crimes.  They are placed in immigration removal proceedings and are not provided an attorney, regardless of their age.  Kids in Need of Defense (KIND) is a national nonprofit organization working hard to match these children with caring pro bono attorneys who will ensure that they do not face an immigration judge alone.

October 31/Web: Slip and Fall Accident Investigations - An Engineering Perspective

Walking accidents will injure millions of people each year, and thousands will die. Slip, trip and loss of balance accidents are the second highest cause of accidental death among the elderly. The effects of these types of accidents can be devastating, resulting in extreme changes in lifestyle and monetary losses to the victim. Most of these accidents are the outcome of some defect of a premise arising from the lack of proper maintenance.
Walking is an extremely complex task, when one tries to understand the mechanism of these accidents. Walking, in reality, is the process of locomotion in which the human body moves along supported first by one leg then by two and finally by the second leg. The accidents occur at the time when the body is supported by only one leg due to dynamic effects and the required reaction at the contact point with ground.

  • Carl Berkowitz, PhD, PE, AICP, has 48 years of transportation and traffic engineering experience, served as a litigation consultant, and held various positions in industry, government, and higher education.   • Dr. Oren Masory holds BS, MS and PhD degrees in Mechanical Engineering from the Technion – Israel Institute of Technology. Currently, he is a professor in the Department of Ocean and Mechanical Engineering at Florida Atlantic University, Boca Raton, FL. He has over 30 years of mechanical engineering experience, served as a litigation and engineering consultant and held positions in industry, as well. His research interests include robotics, automation, machine tool controls, assistive technology, and accident reconstruction. November 14/Cleveland, OH: International Law in Crisis: Piracy off the Coast of Somalia #MCLE

The rise of piracy off the coast of Somalia over the last five years has been spectacular, amounting to a true crisis in international law. Somali pirates have attacked hundreds of ships and have taken hundreds of sailors hostage. Moreover, pirates have been attacking larger ships, such as oil tankers, and using more potent weapons, such as rocket-propelled grenades and automatic weapons. In sum, piracy has increased shipping expenses, costing an estimated $10 billion per year in global trade.
What has sparked this international law crisis off the coast of Somalia? Moreover, what can the international community do in order to alleviate the crisis and prevent piracy from spreading to other regions of the world? What should be the way forward?
This lecture will seek to answer these difficult questions by first exploring the reasons for the proliferation of pirate attacks off the coast of Somalia in the 21st century, before turning to an analysis of international law on piracy and focusing on finding solutions for the future. This lecture will particularly focus on a possible solution of increased reliance on regional partners in the fight against piracy. Such regional partners include Kenya, the Seychelles, and Mauritius; this lecture will propose useful ways in which these countries could participate in the global fight against Somali piracy. In the absence of an international piracy court and in the face of major maritime nations’ unwillingness to participate in the prosecution of pirates on a large scale, the use of Kenyan, Seychellois and Mauritian courts may be the best tool in combatting Somali pirates.

Before joining the Cleveland-Marshall faculty, she was an associate in the New York City firm of Cleary, Gottlieb, Steen & Hamilton and an Adjunct Law Professor at Cornell, where she taught in the International War Crimes Clinic. Her research interests are in the field of international law, international criminal law, international human rights, law of the seas, as well as private international law. She has published in the American University Law Review, the Connecticut International Law Journal, the Fordham International Law Journal, the Cardozo Journal of International and Comparative Law, the Denver Journal of International Law and Policy, the Florida Journal of International Law, and the UC Davis of International Law and Policy.

October 22/Chicago: Representing People With Disabilities

Low-income people with disabilities are very likely to have legal problems that require the assistance of an attorney. Sometimes the disability is central to the case, as in special education, but even when the case is not strictly a disability rights case, the disability may be highly relevant. Pro bono attorneys can help in many of these cases but may hesitate to take a case because they feel uncertain about proper etiquette or are afraid of doing something wrong. This program will provide practical guidance about representing clients with disabilities on such topics as language usage, interaction and communication strategies, confidentiality, and accommodations.
