Oct 13/ NYC - Managing Electronic Discovery as an In-House Attorney


In-house attorneys face special challenges, especially in today's environment. They are under constant pressure to reduce the costs of litigation and discovery, while providing solutions that can withstand challenges in court, make strategic sense from a litigation and technological perspective, and are minimally intrusive to the various departments or employees of their company and existing IT infrastructure. In-house attorneys must also sort through, collect, and have processed significant amounts of data, possibly in the range of terabytes, during the course of a litigation. These responsibilities require, among other things, knowledge about the rapidly evolving case law in e-iscovery and about the corporation's information technology infrastructure, and the ability to educate and communicate with the technology department.


This 2 hour presentation will cover some of the most critical discovery topics facing in-house attorneys. The presentation will first address the obligations of in-house and outside counsel to respond to document requests; the second phase will cover some of the techniques companies are utilizing to ensure adequate collection and preservation of relevant documents; and the last phase will discuss various document retention programs organizations might consider to develop life cycle management into their IT environments and to reduce the volume of documents necessary for storage and review in litigation. The goal is to discuss strategies which have been proven to avoid sanctions, reduce the review burden, and be minimally disruptive to corporate officers and employees.
The program is eligible for two (2) hours of New York Professional Practice CLE credit for both newly admitted and experienced attorneys.
