September 7: Ethical Issues in California Pro Bono Representation 2017 #MCLE

While the ethical obligations of pro bono legal practice are no different than a commercial law practice, there are practical considerations regarding eligibility of clients, challenging clients, conflicts (similar in theory, different in practice settings), expectations on both sides, case management responsibility, and different delivery models, such as limited scope representation, that cause many professionals to hesitate to offer pro bono legal services. This program is designed to answer questions regarding the ethical obligations of pro bono legal service, encourage attorneys to engage in this professionally rewarding aspect of law practice, and remove ambiguities that are barriers to engaging in pro bono legal services.
What You Will Learn: Attorneys knowledgeable about professional responsibility and pro bono service, who work in legal services, law firms, private bar programs and in-house corporate law departments will discuss the application of the California Rules of Professional Conduct, the ABA Model Rules of Professional Conduct, and, where relevant, the Proposed California Rules of Professional Conduct to pro bono legal service in different settings. The faculty will begin with the basics of pro bono, including the definition of “Pro Bono” for lawyers, why it is considered an important part of the profession, and ethical concerns unique to pro bono, as opposed to the commercial practice of law.
The faculty will also address emerging ethical issues in developing areas, such as pro bono clinics, incubators, pro bono in Federal courts, and the impact of technology in pro bono legal services.
Finally, the faculty will discuss hypothetical fact patterns to illustrate the application of the rules.
Law firm pro bono coordinators and partners, law firm associates, legal services pro bono coordinators, solos, small and medium firm attorneys engaged in pro bono legal services, court-based program administrators for self-represented litigants, judges, and everyone interested in access to justice.

August 24: FTCA and Other Civil Rights Claims - Immigration Enforcement & Damages Actions

Increased immigration enforcement is likely to include enforcement practices that give rise to damages action. Claims under the Federal Tort Claims Act, Bivens, and Section 1983 are important tools to combat abusive enforcement practices and ensuring that federal and local law enforcement abide by their constitutional obligations. This program will give a general overview of each of these claims. We will also discuss employing a media strategy, in addition to litigation, to highlight abusive enforcement practices, as an advocacy tool in its own right.
We will cover the legal standards and procedures to bring an administrative claim and both individual and impact litigation under the Federal Tort Claims Act. We will similarly cover Bivens and Section 1983, as well as the defenses government defendants commonly raise in these cases. This will include the types of conduct that can be challenged and the life of a damages claim from fact-gathering to judgment.
Anyone who is interested in providing representation to immigrants whose constitutional rights are violated should attend the training. Immigration-based damages actions often involve, but are not limited to, claims related to excessive force, unlawful detention, unlawful arrest, physical abuse, wrongful death, denial of medical services, unlawful search, and denial of religious freedom.

July 19: A Guide to Post-Traumatic Stress Disorder (PTSD) for Advocates: How to Effectively Address PTSD in Matters Involving Veterans and Others Affected by Trauma

Although PTSD can cause symptoms that significantly affect cognition and behavior, the people who assist or make critical decisions affecting those who experience PTSD may not recognize or understand these symptoms well. This training provides advocates with an understanding of PTSD that will allow them to:
  • Work productively with clients who have experienced trauma;
  • Learn about PTSD and how it may relate to clients’ legal issues;
  • Partner effectively with mental health professionals; and
  • Develop compelling evidence to support advocacy for individuals affected by PTSD.
Led by a faculty that includes a VA psychologist with extensive clinical expertise in PTSD and lawyers specializing in mental health-related advocacy, this training will provide:
  • An understanding of how trauma and PTSD affect the brain;
  • A description of PTSD symptoms and how they affect people in their day-to-day lives;
  • Discussion of how PTSD symptoms can be relevant in legal proceedings;
  • Guidance for developing relevant information and evidence about PTSD;

Already, Minnesota provides important safeguards to commercially sexually exploited minors, while holding perpetrators accountable. The same commitment toward victim protection and perpetrator accountability can help address serious forms of labor exploitation, including trafficking.
Minnesota legal professionals will play a vital role in preventing and responding to human trafficking. This CLE will provide basic definitions of human trafficking, including labor exploitation and labor trafficking; help legal professionals recognize indicators of potentially trafficked individuals and the risk factors of victims; and describe appropriate responses when working with potential victims of trafficking. In 2015 alone, there were 333,341 documented removals, or deportations, from the United States. Not only is the large number of removals concerning, it is particularly alarming that so many removals could have been successfully challenged, but so many of the deportees were never advised regarding any such options. Many individuals facing removal do not obtain legal assistance, and unwittingly forfeit critical rights and legal protections. This training will provide you with the tools that you need to assess the options of individuals facing imminent deportations due to administrative or reinstatement orders, orders issued by the Immigration Courts, and the role of habeas and other legal actions in the context of imminent removal.

August 11: Reentry in California – Overcoming Legal Barriers to Community Reintegration 2017

In the past three decades, incarceration rates have exploded in the U.S., such that today we incarcerate over two million people, more than any other country in the world. The result is that many more people encounter the criminal justice system at some point in their lives. Indeed, an estimated 1 in 3 adults in California has an arrest or conviction record, and low-income people and people of color are disproportionately affected.
A person with a prior record faces significant barriers to employment, occupational licensing, and other basic necessities like housing, even when the record is old or relatively minor. Now more than ever, immigrants face the threat of deportation based on criminal justice contacts as minor as an arrest that did not result in conviction. This training is designed to give lawyers a foundation in the collateral consequences of contact with the criminal justice system, as well as tools for representing clients in need of reentry legal services.

July 31: #Ethical Considerations for Attorneys Representing Detained Immigrants #MCLE

As of April 2017, there were 884 individuals detained ICE custody in Northern California alone. And in fiscal year 2016, the Department of Homeland Security reports having apprehended 530,250 individuals nationwide and conducted a total of 450,954 removals and returns. We are fortunate that in recent months, private and public funding has increased for pro bono representation of detained immigrants in several localities around the country. Representation of detained immigrants raises some unique challenges because the clients are particularly isolated, have extremely restricted means of communication available, their cases often entail procedural and criminal histories that raise numerous difficult legal issues, and their cases move at a fast pace. This training will provide you with the foundation that you need to navigate the many ethical challenges that may arise in representing detained immigrants.
What You Will Learn
  • How can I ethically address consent and confidentiality with a detained client?
  • How should I keep my client reasonably informed?
  • What conflicts of interest might arise in the context of ICE enforcement actions?
  • What should I do if I become concerned about the validity of evidence or testimony?
  • How can I ethically prepare my client to testify without eliciting too much information?
  • What if my client has multiple forms of relief and some may not seem worth pursuing?
  • How to discuss potential settlement offers with your client.
This training is designed for immigration attorneys who want to learn about ethical issues that arise in the context of detention work. Participants should have a basic knowledge of immigration law, but need not have prior experience defending detained immigrants against removal.

July 26: Minneapolis - Human Rights Advocacy at the United Nations #MCLE

In March 2017, The Advocates for Human Rights led a delegation to conduct human rights advocacy before the United Nations. Pro bono attorneys Lisa Borden, Matthew Forsgren, Margaret Grieve and Mark Petty will discuss their experiences traveling to Geneva to advocate before the Human Rights Council, treaty bodies and special procedures. Panelists will describe how they used U.N. human rights mechanisms to enforce international legal standards related to women’s rights, the death penalty, torture, racial discrimination, and the rights of persons with disabilities, as well as the impact of their work.
