Since the enactment of the DTSA in 2016, trade secrets litigation in the Federal courts has grown exponentially. But the growth hasn’t been without hiccups: conflicts and inconsistencies have arisen between different circuits and districts, as well as between State and Federal courts considering the same laws. As a result, it is more important than ever to consider carefully where to sue and how to plead. At the same time, the Supreme Court is considering a critical trade secrets question under FOIA, determining how much protection will be given to confidential information provided to the government. Topics will include:
- The consideration requirement to support restrictive covenant cases in various courts, both Federal and State
- Ex parte seizure developments under the DTSA
- Pleading pitfalls in DTSA cases
- The Supreme Court’s consideration of the trade secrets exception to FOIA in Food Marketing Institute v. Argus Leader Media.
