April 16: Trade Secrets Litigation 2019: Developments from the Trial Courts to the Supreme Court

Since the enactment of the DTSA in 2016, trade secrets litigation in the Federal courts has grown exponentially. But the growth hasn’t been without hiccups: conflicts and inconsistencies have arisen between different circuits and districts, as well as between State and Federal courts considering the same laws. As a result, it is more important than ever to consider carefully where to sue and how to plead. At the same time, the Supreme Court is considering a critical trade secrets question under FOIA, determining how much protection will be given to confidential information provided to the government. Topics will include:
  • The consideration requirement to support restrictive covenant cases in various courts, both Federal and State
  • Ex parte seizure developments under the DTSA
  • Pleading pitfalls in DTSA cases
  • The Supreme Court’s consideration of the trade secrets exception to FOIA in Food Marketing Institute v. Argus Leader Media.
