December 2: 9/11: A 20-Year Retrospective of the Central Backstory

The central backstory of the 9/11 attack focuses on the need for financing to successfully carry out the acts of terrorism committed on that fateful day. This presentation will discuss the financial investigation conducted as part of the overall counterterrorism investigation after the attacks, and the critical importance of public and private sector partnerships.
This compelling presentation will discuss how terrorists were able to make their aspirations for the 9/11 attacks a reality and how the threat environment has morphed and changed 20 years later. From a financial perspective, it will start with the planning, execution, impact and how we responded to 9/11 from both a public and private sector standpoint. It will end with where we are today and how we should respond to evolving threats.

November 2 + 23: Navigating the New Town Square: Cultivating Competency in Basic Online Legal Research

“The Internet is becoming the town square for the global village of tomorrow.” -- Bill Gates.

The growth in the amount of information available and the many different platforms on which to obtain it impact the way attorneys practice law. It also brings forth more issues and new laws that your clients may face.
The many ways technology can aid attorneys in locating the best and most on-point statutes, caselaw, secondary materials and all relevant materials can be overwhelming. As the comments to the model rules of professional conduct state, to maintain competency a lawyer should keep abreast of the benefits and risks associated with relevant technology.
The goal of this free online continuing legal education program is to assist attorneys in navigating online legal research, so they are more confident and competent when researching subjects important to their work.

November 18: Expert Testimony: Preparing and Delivering Deposition Testimony

Expert deposition testimony can change the course of a case. In the best scenario, the expert work is right, it's helpful to the people who have hired the expert, and the presentation during the deposition is professional and compelling such that the opposing parties dramatically change their position to more closely align with the expert analysis and conclusions. In the worst scenario the expert gets picked up by opposing counsel and shaken like a ragdoll (figuratively, of course).
In general, the arbitrator, judge, or jury will never read, hear, or see the video of good deposition testimony; the opposing parties will not want to present it and the party the expert is working for will generally let the expert present it him/herself in direct testimony. But if the deposition testimony is bad, then the arbitrator, judge, or jury will almost always read, hear, or see it!
This program is "a map of the terrain" to help experts, attorneys, claims professionals, and parties to litigation understand and navigate the nuanced world of expert deposition testimony. This program will give you a framework to make sure your expert testimony is complete, supportable, and understandable by non-technical people who need to use the information to make decisions. With our process, the only additional ingredient is old fashioned elbow grease.

November 10: Prison Release Discretion and Prison Population Size

With a focus on the length of prison sentences and their contribution to America's high rate of incarceration, the Robina Institute's Prison Release: Degrees of Indeterminacy Project shines a light on the oft-ignored role that back-end decision-makers - like parole boards and prison officials – play in determining actual time served.
Cross-state differences in legal frameworks for prison release decisions reflect differing capacities to reduce and increase prison populations. An empirical examination of how these system design features affect time served provides policymakers with potential tools to manage prison population size.
This presentation features a panel of researchers and practitioners who will review the lessons emerging from the Prison Release: Degrees of Indeterminacy Project and its potential for system-wide effects.

December 8: How You Can Ensure Open Source License Compliance Won't Tank A Transaction

If you're an in-house lawyer, today's deal market means any day may bring news of an IPO, merger, or even fast-tracked SPAC acquisition.
The ubiquitous nature of open source software in modern applications means it’s likely that license compliance will be part of due diligence. And, any compliance issues that surface during this assessment may present significant roadblocks to a successful transaction.
Are you prepared to brief your CEO on the status of open source license compliance if asked right now? Could flaws in your company’s code emerge after an IPO, bringing about major business and reputational harm for all involved?
In today’s market, even tech-savvy legal departments would be wise to revisit the IP risks presented by open source software, with an eye toward implementing continuous license compliance and ditching the one-off audits.
In this webinar from our friends at FOSSA, we detail steps to consider now.
In addition, you'll learn:
  • How to prepare for transaction-related compliance reviews in an era of ever-increasing complexity and ever-decreasing timelines
  • How OSS license compliance impacts the 2021 SPAC boom and other transaction trends
  • How to implement a system of continuous compliance and the benefits of doing so
  • How to anticipate and address any cybersecurity issues raised by open source code.

Growing use of facial recognition technology and concerns over inherent bias as well as the risk of mass surveillance generally have prompted calls for stricter regulation and even bans. November 17: How To Guard Against Buyer’s Remorse In Today’s Deal Market

As Litera notes in its upcoming M&A Trends report, today’s robust M&A market is the product of factors like low-interest rates, a stock market rebound, and stockpiles of private capital. This is a market with new levels of urgency, certain to push dealmakers to take ever-increasing diligence risks, pursue ever-riskier transactions, and possibly cut corners.
Such an environment presents significant challenges for corporate lawyers, who have a core responsibility of helping their clients avoid buyer’s remorse down the line.
In this free webinar with our friends at Litera, we look at the findings from the M&A Trends report, and detail steps transactional lawyers should consider to minimize these types of risks.
You’ll learn:
  • Navigating new factors like PPP loans, EIDL loans, and coronavirus compliance in due diligence
  • Avoiding common problems that have emerged, like valuation difficulties or challenges in compiling accurate data
  • Emerging tools that can deliver on total diligence in a transaction
  • How transactional lawyers are walking a fine line between speed and diligence demand Webinar Panel.
