July 1: The Little Engine That Could! Celebrating the 20th Anniversary of the Founding of the UN Special Court for Sierra Leone

A little over 20 years ago, the international community answered the call for justice by the people of Sierra Leone and West Africa by creating the world’s first international hybrid war crimes tribunal. Armed with a workable mandate, the Special Court for Sierra Leone achieved justice for the murder, rape, maiming and mutilation of over one million people. and took down a sitting head of state for international crimes, President Charles Taylor of Liberia.
The jurisprudence that was achieved during the three joint criminal trials of those who bore the greatest responsibility for international crimes, advanced the ability of future local, regional, and international prosecutors to account for atrocity crimes.
Join a roundtable discussion, moderated by Dean Michael Scharf of Case Western University School of Law, with those individuals who created, sustained, and accomplished that justice for the people of Sierra Leone. For all its hard work, against tremendous odds, the Special Court earned the title of “The Little Engine That Could”.
Joining the roundtable to consider all this are:
  • Ambassador Hans Corell, the Undersecretary General for Legal Affairs who drafted the creative documents for the Special Court for Sierra Leone
  • Ambassador David Scheffer, the senior American official who led the international effort to create the Special Court for Sierra Leone Professor David Crane, the founding Chief Prosecutor of the Special Court for Sierra Leone;
  • Brenda Hollis, a Chief Prosecutor of the Special Court for Sierra Leone
  • Binta Manasary, the Registrar for the Special Court for Sierra Leone and current Registrar of the Residual Special Court for Sierra Leone
  • Professor James Johnson, the current Chief Prosecutor of the Residual Special Court for Sierra Leone, Director of Case Western Reserve University School of Law’s Henry T. King War Crimes Research Office.

October 25/Cleveland: On Being Predictably Unpredictable

A judge should aspire to be perfectly predictable with respect to his or her methodology. That methodology, broadly described, is one of formalism – which manifests itself, most notably, in an originalist approach to constitutional cases and a textualist approach to statutory and regulatory cases. But if applying that methodology properly and honestly, the results of decisions should be at least somewhat unpredictable.

June 24: HR Essentials – Let’s Talk About the Pros and Cons of Using Independent Contractors (AKA Gig Workers)

Regardless of what the contract says (or even what the worker wants), every employer utilizing “independent contractors” in California must be prepared to demonstrate that their contract workers are truly “independent” under the law. Misclassifying employees as independent contractors may expose employers to potential liability for a host of individual, collective, and class claims, additional tax liability, and more, all while the law on independent contractors and “gig workers” continues to evolve. Join us to learn about how your company can stay in compliance and out of court as we provide an overview of the legal requirements, best practices, and pros and cons of using independent contractors in California.
For experienced human resources professionals, this webinar will be a practical “refresher.” For less experienced human resources professionals, this webinar will provide an introduction to and real-world advice regarding independent contractor essentials. This webinar kicks off our 2022 continued California Employment Law Essentials series for HR Professionals. Be on the lookout for details about this series in the months ahead during 2022. Further webinars will include compliance with and best practices for California employers for other classification issues (including exempt employees); discrimination, retaliation, and harassment; disabilities; and leaves of absence.

June 23: How Co-Parenting Apps Can Prevent Families from Returning to Court and Keep Them on Track for Success

Communication problems often plague families in divorce or separation. While more of the correspondence is moving to email and texting, from the court's perspective, these forms of communication are often unreliable and easy to manipulate. In turn, court dockets are continually overloaded with custody cases coming back to court due to communication breakdowns, often with insufficient evidence.
This presentation will advise family law practitioners of communication technology ordered by the court in high-conflict custody and visitation cases. More specifically, it will explore the OurFamilyWizard app. The app is frequently included in parenting agreements as a way to reduce litigation and improve family outcomes. Learn how it can simplify co-parenting communication, prevent coercive control and streamline the work of practitioners. Practitioners will learn how to stay informed of co-parent communication using online tools. Each attendee will receive examples of agreements and court orders currently used to specify parent and practitioner use of the app as well as a full demonstration of the available features.

July 20: Navigating the Recent SEC Private Fund Rule Proposals | Session Three: Considerations for Open-End Fund Managers

The SEC has recently engaged in a flurry of rulemaking activity that would significantly impact asset managers that advise private funds. In February, the SEC proposed rules that, if adopted, would represent the most significant changes to the regulation of private funds and their advisers since the Dodd-Frank Act, and a fundamental shift in how private funds are regulated. These proposed rules would impose substantive regulation on an industry that currently is subject to a largely disclosure-based regime. While it remains to be seen what will be in the final rules, advisers should be aware of what is in these proposals and how they may impact their operations.
In light of this, Dechert is hosting a series of webinars to discuss the proposals and their relevance for: closed-end fund managers; open-end fund managers; and non-U.S. fund managers with U.S. investors.
Session 3: Considerations for Open-End Fund Managers
Topics will include:
  • Preferential treatment/side letters
  • Liability standard

Not all business activities constitute you doing business in a foreign state, but there are times that failure to qualify can leave your company facing negative consequences.
Join CSC for a complimentary CLE webinar by Frank Ballantine and Beth Lyden of Dykema Gossett PLLC, on state foreign qualifications, recent case law, and critical principles of conducting business outside your state.
The webinar will bring to life Qualifying to Do Business in Another State: The CSC 50-State Guide to Qualification. You’ll have the opportunity to ask presenters about formations and qualification guidelines as they review their impact on your business, and what you can do to protect yourself. We’ll also touch on some common CSC customer qualification questions.
Who should attend:
Corporate counsel
Outside counsel
Corporate paralegals and others involved in corporate compliance
Learning objectives:
Attendees will leave the program with a better understanding of corporate activities that generally do not require qualification and corporate activities that do require qualification. We’ll review the process of evaluating if a business is impacted and needs to qualify in another state, or if it meets a general exception. Attendees can expect a review of online and eCommerce activities that do or do not generally require qualification. Attendees will also leave with a better understanding of how corporations can cure failures or terminate qualification if necessary.

June 16: The Clash Between State & Federal Law in the Cannabis Industry Where We Are, Where We Are Going, and What Lies Ahead

Just this spring, the sale of recreational cannabis began in New Jersey after becoming the 18th state in the nation to make it legal. The growing disconnect between state legality and federal illegality has left many businesses with uncertainty. This disconnect affects virtually every aspect of the cannabis industry – from banking and capital markets to real estate and more.
Join members of our Cannabis Industry Team, recognized by Law360 for two consecutive years as a Cannabis Practice Group of the Year, for a discussion highlighting some of the major issues and trends currently at play, including:
  • The federal cannabis policy
  • The impact of federal policy on cannabis operations in states where cannabis is legal
  • The efforts and likelihood of federal legislation that would legalize cannabis
  • Policy, safety, and oversight opportunities that could be gained by federal legalization.

July 13: Navigating the Recent SEC Private Fund Rule Proposals | Session Two: Considerations for Non-U.S. Fund Managers

In light of this, Dechert is hosting a series of webinars to discuss the proposals and their relevance for: closed-end fund managers; open-end fund managers; and non-U.S. fund managers with U.S. investors. Session 2: Considerations for Non-U.S. Fund Managers
Topics will include:
An overview of the rule proposal, including:
  • Clawback issues
  • Liability standards
  • Expense allocation
  • Reporting to investors
  • Side letters with investors
  • How these rule proposals will likely impact non-U.S. fund managers, including fully registered investment advisers, exempt reporting advisers and foreign private advisers.

June 8: Ethics, the Press and your Practice: Getting out there without getting into trouble

The reporter covering your case for a national media outlet calls. They’d like a detailed quote for the piece they’re working on. You’re eager to tell your client’s side of the story – but worried about getting stung. You don’t want to leave the other side’s statement without a counterstatement, allowing them to set the narrative, but you aren’t sure how to best present your client’s case publicly in a way that protects both you and the client.
For attorneys looking to elevate their profile and influence public opinion on a specific matter or case, partnering with the press can provide real benefits. However, as seasoned practitioners and communications industry experts know, there are very specific rules of engagement for attorneys who speak to the press and failing to follow them can cause damage to the attorney, client, and ultimately the case. Even inadvertent mistakes can leave an attorney open to risks from ethics violations to defamation.
During this program, our expert panelists will discuss the benefits to be gained from engaging with the press, the ethical considerations practitioners must evaluate as they do so, and additional risks to consider. The discussion will include specific attention to ethical rules – including ABA Model Rule of Professional Conduct Rule 1.6 and 3.6, concerning confidentiality and trial publicity, respectively, to provide practical and actionable takeaways for attorneys as they balance skillful press interactions with ethical considerations and other risks.
Learning Objectives:
  • Understand ethical obligations as they relate to speaking with the press about a client’s case and get tips to avoid potential missteps
  • Explore strategies to answer press inquiries while maintaining duties to client and preservation of confidentiality and avoid defaming an adversary or other party
  • Discover what benefits press engagement may provide to the client, and how to prepare for press contact for the best outcome.
Who would benefit from attending this program?
  • Law firm attorneys advising clients in civil litigation matters
  • In-house counsel involved in litigation matters
  • Communications, business development and PR professionals at law firms.
