February 28: Meredith Trail Reenactment & Panel

In 1961, James Meredith applied for admission to the University of Mississippi. Despite his high qualifications, he was rejected. Meredith was black, and the University had never admitted a black student.
Represented by Constance Baker Motley and the NAACP Legal Defense and Educational Fund, Meredith sued in the United States District Court for the Southern District of Mississippi, alleging that the University denied him admission because of his race.
The litigation was difficult and hard-fought. Although seven years had passed since the Supreme Court's landmark ruling in Brown v. Board of Education, many in the South continued to resist the notion that segregation in public education was unconstitutional. Meredith would later describe the case as "the last battle of the Civil War."
On Tuesday, February 28th, Fordham Law will honor the contributions of Constance Baker Motley and James Meredith by telling the story of their battle with Ole Miss and its impact on the Civil Rights Movement. Please join us for the Trial Reenactment of the Meredith case, featuring Dean Matthew Diller, FLS faculty, students, and alumni. Following the reenactment, there will be a panel discussion with Professor Aysha Ames, Professor Thomas Lee, and moderated by Professor Bennett Capers.

February 23: Recent English Law Changes Invite Mass Tort Litigation, Some Backed by U.S. Plaintiff Lawyers

Over the last several years English court decisions have broadened the use of aggregate litigation mechanisms, including Group Litigation Orders, which is leading to a rise in mass claimant litigation in the UK. This development brings group litigation in the UK closer to mass litigation in the United States. Recently, U.S.-based plaintiffs’ attorneys have entered the UK market, including some who are known for securing multi-million dollar verdicts. These U.S.-based lawyers have announced their goal of bringing U.S.-style aggregate litigation to English courts, which could cause a substantial change in the UK litigation climate.
Please join Dechert’s Product Liability and Mass Torts group, UK practitioners and guest speakers for a discussion of what has happened to date, what to expect and how to be one step ahead.

February 22: Toward a Sustainable Global Trading System: Legal Challenges and Environmental Imperatives

As the world community ramps up its response to climate change and demands for a more sustainable future, interest in the international trade regime as a point of leverage for transformative change has grown. At the same time, various climate change
policy approaches – including the European Union’s Carbon Border Adjustment Mechanism and the “green industrial policy” reflected in the U.S. Inflation Reduction Act – have been called out for their potential violations of trade rules.
Professor Esty will assess the opportunities and challenges that arise in trying to better align the trading system with climate action and the sustainability imperative of the 21st century.

February 16: Refresher on Ethics of Trial Work in a Courtroom

As health officials continue to try to get the pandemic under control, the legal community is trying to get back to business as usual. But is it? Lawyers’ skills and knowledge of courtroom practice and procedure may need a bit of sharpening. It is time for lawyers to brush up on the ethical rules that are in place when handling trials. Through hypotheticals, this two-hour program will deal with areas of concern that lawyers come across every day. A panel will answer questions on how best to handle and diffuse what could turn into unnecessary confrontational situations. From discovery issues to closing arguments, hypotheticals will be presented at various trial stages with attendees answering polling questions on best practices.
It should also be noted that effective Jan. 1, 2023, the Illinois Supreme Court has enacted an updated Illinois Code of Judicial Conduct for the first time in almost two decades, bringing it in line with national standards by addressing the use of social media and other technology that didn’t exist at the code’s last major update in 1993. How some of these Rules dovetail with trial lawyers in a courtroom will be discussed as well.

March 14: Lemkin, Genocide, and the Modern World

Rafael Lemkin
was a Polish Jewish lawyer best known for coining the term “genocide” and a key person behind the creation of the UN Genocide Convention. For that work, he was twice nominated for the Nobel Peace Prize. On the 50th anniversary of the Convention entering into force, Lemkin was honored by the UN Secretary-General as an inspiring example of moral engagement.
This seminar is the second part of the webinar series discussing “genocide” and its applicability to the current events in Ukraine and beyond. It debates whether Lemkin’s ideas are helpful in the prosecution of mass murder and other crimes aimed at eliminating or erasing entire groups of people. It also addresses the likelihood of a successful prosecution of atrocities committed in Ukraine, either as war crimes, crimes against humanity, or a crime of aggression, via either international or national courts or via special tribunals.

March 30: The Art of Discovery: Leveraging Proportionality to Reduce Client Burden

Register Now!
Does this sound familiar? The issues in your case are narrow, but opposing counsel is demanding that your client disclose documents and provide witnesses for deposition that are completely disproportionate to the needs of the case. What began as a friendly dispute has grown into fiercely contentious litigation, including the service of broad and invasive discovery requests and its’ clear that opposing counsel is only interested in using discovery as a weapon to impose unreasonable burdens on your client and drive up the cost of litigation.
Learn how to put a stop to these excessive requests and more. Join our expert panelists to discuss the proper scope of discovery in litigation and "proportionality" as defined by Rule 26(b)(1) of the Federal Rules of Civil Procedure. Explore how to apply the standard to curtail unreasonable requests for the production of documents, as well as other tools such as depositions, requests for inspection, and discovery requests directed to third parties.
Our panelists will also share how they have applied the proportionality standard in previous litigation as well as the challenges that often face practitioners in their practice areas.
Learning Objectives:
  • Understand how to interpret proportionality, as defined by Federal Rule of Civil Procedure 26(b)(1). Explore strategies to apply the proportionality standard and curtail improper discovery requests in various practice specialties.
Who would benefit from attending this program?
  • Law firm attorneys advising clients in civil litigation matters
  • In-house counsel involved in litigation matters.

June 14: Social Media - Discovery, Ethics, Evidence & Sanctions

Register Now!
We'll review the pervasive world of social media providing counsel with focused information on its integral presence in the practice of law from an ethical, discovery, evidentiary and practice perspective. Technology advancements have created many grey areas in terms of reasonable expectations of privacy and have blurred the lines of public and private identities. Ethical considerations and requirements, as well as new case precedents, mistrials and sanctions are popping up daily throughout the country due to the misuse and lack of understanding of the affect social media now has in the work environment and practice of law. Class participants will be armed with specific techniques and tools to identify and collect evidence from social media sources. The presentation qualifies for 1 hour of Ethics MCLE credit.
In this seminar we will review:
  • What is social based media?
  • Why is social based media important to attorneys?
  • How social media can cost you: public pitfalls and poor judgment
  • What should you be considering ethically?
  • Online research tools and resources
  • Ways to consider and capture social media evidence

February 10: Building a Greener Future Through Urban Sustainability

Climate change has been, and will continue to be, one of the greatest global challenges we face. Cities hold a unique position in climate change. The impacts of climate change affect all areas of urban life, including infrastructure, city waterfronts, housing, and human health, and these impacts fall disproportionately on low-income communities and people of color. At the same time, urban areas are a major source of greenhouse gas emissions. Cities therefore play an integral role in fighting climate change – both as advocates and as targets of reform. It is imperative for cities to take the lead in finding equitable solutions to protect all of their communities and to prevent further damage to the rural and suburban environments that urban activities have negatively impacted.
The second event of the Fordham Urban Law Journal’s 50th year of publication provides a forum for this discussion at its 2023 Symposium, Building a Greener Future Through Urban Sustainability. Alongside scholars, government and agency appointees, technical experts, and advocates, the Symposium will explore a range of topics on urban climate adaptation and resilience, including flood prevention, electrification of the transportation and buildings sectors, efforts to equitably transition to clean energy, and the important environmental justice considerations central to all climate initiatives and policies.
