Jury nullification occurs when jurors disregard the law or the evidence in a case. There have been a number of cases where people have been prosecuted for attempting to inform the public about jury nullification.
We will discuss jury nullification and look at relevant caselaw including caselaw related to the interaction between the First Amendment and educating the public about jury nullification.
The presentation will include a limited discussion of ethics/professional responsibility issues that may arise from jury nullification and related First Amendment issues.
