Additionally, we will cover lessons we can learn from Southern disabled reproductive justice organizers, the unique barriers and marginalization faced by folks at the intersection of racial justice and disability justice, how mental illness and invisible disabilities impact access to reproductive rights and care, and the challenges facing disabled pregnant and birthing people. April 1: Coordination, Not Competition: Achieving Value-Based Care Through Shared Governance with Jessica Mantel

Jessica Mantel
Title:
Coordination, Not Competition: Achieving Value-Based Care Through Shared Governance with Jessica Mantel
Description:
Value-based payment (VBP) aims to transform healthcare by incentivizing providers to improve patient outcomes and reduce costs through better care coordination, preventive strategies, and increased efficiency. Yet VBPs have struggled to deliver on their promise.
Attorney Jessica Lind Mantel will discuss a key reason for this limited progress – a regulatory framework that relies on market forces and grants payers significant autonomy in designing and implementing VBP models. This decentralized, bottoms-up approach leads to misaligned payment policies that create barriers for providers seeking to redesign how they care for patients.
Mantel advocates for an alternative approach: value-based governance. This model emphasizes collaboration among government agencies, payers, providers, patient advocates, and other stakeholders, replacing fragmented, market decision-making with coordinated public-private efforts that foster payment alignment. Value-based governance can address other systemic challenges to health reform by advancing technical assistance programs that support providers transitioning to value-based care, improving health data-sharing infrastructures, and promoting a workforce equipped to deliver value-based care. Through shared responsibility for policy outcomes and horizontal coordination across the public and private sectors, value-based governance offers a pathway to successfully transforming the healthcare delivery system.

Jessica Lind Mantel joins the Health Law & Policy Institute as co-director after eight years of service with two government agencies in Washington, D.C. She worked most recently as a senior attorney in the Office of the General Counsel for the Department of Health and Human Services. She previously worked as a health policy analyst in the Government Accountability Office evaluating Medicare payment issues. Prior to her service with government agencies, she practiced as an associate in the Health Care Department of the firm of Ropes & Gray in Boston and clerked for the Honorable Karen Nelson Moore of the U.S. Court of Appeals for the Sixth Circuit in Cleveland. Her research interests include the impact of various legislative and regulatory schemes on emerging trends in the health care delivery system and the allocation of limited health care resources. In 1997, Mantel received both her JD from the University of Michigan Law School and an MPP from the University of Michigan School of Public Policy. She also holds a BA in psychology from the University of Pennsylvania.

August 28: Habitability Claims Webinar

Description:
Introduction Habitability is the conformance of a residence or abode to the implied warranty of habitability ... It is an implied warranty or contract, meaning it does not have to be an express contract, covenant, or provision of a contract. It is a common law right of a tenant or legal doctrine.” Although there is no concise, statutory definition of the term, there are LOTS of regulations mandating the minimum performance requirements of residential property being rented by owners to tenants.
This presentation is a 1-hour walk through Pete Fowler Construction Services’ (PFCS) Construction Claims Analysis Method applied to Habitability Claims brought by residential tenants against landlords. No two claims are the same, but our analytical method walks us through a professional investigation and analysis, like how the scientific method aids in discovery of the workings of our natural world, regardless of the specifics of the claim.

June 26: Evaluating Slip, Trip, and Fall Claims

Description:
The world is a dangerous place. And while falling down in your teens is often funny, falling down when you’re grown-up hurts and people are often injured. Combine that fact with a society that has become more and more litigious, and we have arrived in a time where Slip, Trip, Fall Claims are common. And when there is a claim, someone needs to figure out if the condition is a danger and render a thoughtful opinion about whether or not it caused or contributed to the fall.
Slip, Trip, Fall & Personal Injury Claims is a 1-hour walk through Pete Fowler Construction Services’ (PFCS) Construction Claims Analysis Method applied to personal injury claims that occur as a result of a hazard in the built environment. No two claims are the same, but our analytical method walks us through a professional investigation and analysis, similar to how the scientific method aids in discovery of the workings of our natural world, regardless of the specifics of the claim.

September 25: Construction Cost Estimating in a Turbulent World

Description:
Construction Cost Estimating in a Turbulent World is intended to help claims professionals learn to understand what it takes to summarize and analyze estimates from contractors and consultants in the midst of inflation, COVID-19, and a supply chain crisis. It’s not easy, but it is a valuable skill that can save lots of money.
Cost estimating is a profession with specialized skills, training, education, and certifications; but it’s not rocket science. There is some math, so it’s scary to a lot of people. There are many moving parts in a big estimate: designers, insurance, labor, materials, equipment, subcontractors… The list can go on and on.
So, how does a normal person without decades of experience or specialized training understand and evaluate an estimate in uncertain conditions? We are going to show you. Remember: Construction is not terribly difficult to understand. It's really just sticks and stones, and neatly stacked pieces of glass and steel. What makes it hard is the complexity; the sheer number of components requires an organizational system. We have one, and we present it in this 1-hour program.

December 18: Desktop Reviews for Building Claims Webinar

Description:
"Building Claims" is a broad term that includes property, premises liability, general liability (GL), construction defect litigation, or construction contract claims. Lawyers call them "a case" when a lawsuit has been filed. Most claims get sorted out with little disagreement, where one party acknowledges having caused damage, everyone agrees to the value, and either they or their insurance company pay. On the other end are large, expensive, contentious claims that require a team of attorneys and experts to sort out.
But there are claims in the middle where our clients need help. They might know their client caused damage, but think the costs are exaggerated. Or they might not be sure their client has liability. These require professional judgement by an experienced building expert who has knowledge of the law and insurance. This is where a "Desktop Review" is valuable. Desktop Review is sometimes called Preliminary Analysis, Level 1 Analysis, or Small Project Protocol They cost $1,500-10,000 and take a day to a week to complete. For claims professionals and defense lawyers our analysis is a "fight or pay" decision tool; it helps them decide "How much to pay vs. how much to fight." For plaintiffs or subrogation attorneys it is a "go/no-go" tool.
