Speakers:
  • Darrell J. Whiteley
  • Jennifer R. LoydMatthew Strauss
  • Moderator: Esther P. Holm.
Description:
Darrell Whiteley, Jennifer Loyd and Matthew Strauss will discuss the impact of the Affordable Care Act on personal injury litigation, and a plan to defend against claims for future medical costs, loss of health insurance, and life care plans. They will discuss the implications of the Affordable Care Act (presently in the second period of open enrollment) to the defense of economic damage claims for future medical expenses. We will take you through the specific costs and coverage levels in place under the ACA for 2015 in several sample states; we will demonstrate how to reduce plaintiff’s economic damage claim by demonstrating the availability and the mandates of the Affordable Care Act. We will cover the costs of premiums and out-of-pocket limits under the ACA, and contrast them with the Plaintiff’s “list price” medical services. You will learn about the necessary affirmative defenses, discovery demands and the deposition inquiries needed to qualify the Plaintiff for ACA eligibility. We will also focus on the experts required to present these issues at trial, and the anticipated motion practice. In addition, we will discuss how to overcome the categorization of Affordable Care Act coverage as a collateral source, and present the argument that expert testimony and documentary support of required ACA health insurance should be allowed as direct evidence at trial.

December 2: NYC - eDiscovery & Technology: the Ethics of Search and Use of Effective Keyword Strategies

The escalation in the use of technology to create and share information is affecting the practice of law. To address this reality, in August 2012 the ABA Model Rule of Professional Responsibility 1.1 (competence) was amended in to focus attorneys on the need to stay aware of the risks and benefits of its use.
In litigation, especially, the use of technology for document review continues to be a topic of interest, both to law firms and the courts. How much does a lawyer need to know about the new and evolving eDiscovery search tools and how they work? How do you know if they’re doing a good enough job, and how do you know what’s good enough? Are these tools defensible?
In this CLE, Julia Brickell, general counsel and executive managing director at H5 and Dan Brassil, H5’s principal consultant and linguist, join forces to both explore the evolution of courts’ expectations on the use of technology in discovery—including the ethical issues related to the use of various tools—and to discuss how basic principles of linguistics and information retrieval science can be applied to the litigation discovery effort.
Julia sets the stage with a discussion of the basics of various search methodologies used in discovery, and Dan takes a deeper dive with a practical primer on one commonly applied approach to search: how to use keywords effectively to cull data populations and conduct searches for relevant documents, whether for case preparation or production to the opposing side.

December 17: Webcast - The Lure of Functional Claiming: Benefits, Pitfalls, and Recent Court Decisions

Patent attorneys have historically used functional claim language in an effort to cover what an invention does rather than what it is. The use of functional language in a claim presents potential advantages over strictly reciting structure, but also presents potential risks during prosecution and litigation. Understanding how the USPTO and courts are currently evaluating functional claim language is essential to writing and prosecuting patent applications that issue with valuable and enforceable claims.
During the webinar, we will cover these topics and more:
  • Functional claim language: history, examples, and advantages
  • Functional claim-drafting techniques for maximum impact at the USPTO
  • Cases including Nautilus, Inc. v. Biosig Instruments, Inc. and their impact on the interpretation of functional claim terms during litigation
  • Writing and prosecuting applications to survive the storm of litigation and post-grant proceedings.
