The Bilski Oral Argument: On-Demand CLE


The Bilski case has understandably generated an enormous wealth of commentary, including eight-plus amicus briefs, dozens of thoughtful articles, and hundreds of blog posts, CLE seminars, and the like.
Here at IP Colloquium, we therefore thought that the best way for us to add value would be to do something admittedly unconventional. Specifically, the Supreme Court has released a transcript of the Bilski oral argument but has not yet released actual audio of the event. Our thought was that one of the best ways to learn about the case would be to listen to the arguments the parties actually made and to hear the questions that Chef Justice Roberts and his colleagues actually posed. So, this month, we stage a reading of the transcript, with a dozen UCLA law students lending their voices for each relevant attorney or justice.

The Law and Technology Electronic Courtroom Presentation Workshop focuses on the use of modern technology to improve the persuasiveness of courtroom presentations. This workshop is an intensive program where participants will learn to use TrialDirector and PowerPoint products to sharpen their courtroom skills. Attendees will enhance their direct-examination, cross-examination, and opening/closing argument abilities with detailed application and use of these litigation tools. Today, many federal courtrooms are "wired" to accommodate the latest computer programs, and this technology has proven to be an effective and persuasive addition to lawyers' arsenals. Participation in the Law and Technology Workshop is particularly valuable for federal criminal defense attorneys.

General presentations and demonstrations are supplemented by concentrated small group workshops. In the smaller breakout groups, attendees receive hands-on guidance to apply the information presented in the plenary sessions using facts from a mock case file. July 19/Boston - Advanced Training on Rogers #Guardianships

VLP/Senior Partners is delighted to offer an advanced training on Rogers issues in guardianships of adults and minors.
Joanne Moses, former Assistant General Counsel for the Department of Mental Health, will provide a nuts and bolts training on the issues that arise when a guardian requires legal authority to administer antipsychotic drugs to a minor ward or adult respondent. A substituted judgment analysis by the court requires the submission of a treatment plan, affidavit from the treating physician laying out all the factors the judge must consider in making a substituted judgment as well as a proposed order. This training is an excellent opportunity for practitioners who have handled guardianship matters and are interested in learning about the procedure and substantive law involved in obtaining Rogers authority. Attorney Moses will provide basic information for new practitioners as well as tips and suggestions for attorneys familiar with Rogers authority but wanting to hone their skills.

Derivative Work - On-Demand MCLE

Recently, RDR books endeavored to publish  an unauthorized encyclopedia of all things Harry Potter. Warner Brothers filed suit, and the resulting litigation turned out to be a fascinating fight over the precise contours of copyright law's "derivative work" right.
In this audio we look back at that now-settled case, using it as a launching point from which to consider not only the scope of the derivative work right, but also some practical questions about when and whether a copyright holder ought to enforce such a right as against fan-produced materials.

Telecon/June 14 - Outspoken Opinionated Attorneys Needed for #Ethics seminar!


Attention Minnesota, Wisconsin and New York Attorneys: Richard Clem has a free CLE opportunity for you - if you're opinionated!
He writes:

"I'm going to be doing an "Elimination of Bias" CLE on Tuesday, June 14. Two credits of "Elimination of Bias" are required in Minnesota, but such programs are rarely offered outside the state, and can be difficult to find for Minnesota licensed attorneys living in other states. I have a couple of people in that position, and I'll be doing a telephone conference call on Tuesday, June 14 at 1:00 PM Central Time.
I've exhausted everything I know about the subject in the first hour of the program, so the second hour is an open discussion by the participants. Unfortunately, two people doesn't make for a very lively discussion.
Therefore, I'm using the lure of free CLE credit to get a couple more people to participate. The more opinionated you are, the better. If you have personal experience with bias in the legal profession or court system and would like to share, that would be greatly appreciated. But unfortunately, this won't be the typical CLE where you can sit in the back of the room and read the newspaper.
If you are interested, please let me know at clem.law@usa.net. I'll send you the course materials from the first half of the program to read, along with the proposed discussion questions, and instructions for calling in.
I have applied for 1.0 Minnesota Elimination of Bias credit. In addition, I will be applying for 1.0 Wisconsin standard CLE credit. Wisconsin credit was granted for the first half of the program, but I'm not sure how they will treat the discussion format. But Wisconsin has reciprocity with New York, so if it's approved, it will also provide New York credit. Many other states will get you credit on the strength of the Minnesota credit.

June 28/Seattle - The Ehren #Watada Case: Standing On Principle


The World Peace Through Law Section of the Washington State Bar Association’s meeting on Tuesday, April 26, noon – 1 p.m. features Kenneth S. Kagan, of the Seattle firm Carney Badley Spellman, discussing his experiences in successfully defending Lt. Ehren Watada from court-martial proceedings for his refusal to deploy during the Iraq War.  
Lt. Watada’s refusal to deploy garnered national attention and was based upon his claim that the Iraq War itself was illegal, violating international law.  Mr. Kagan will discuss both the substantive legal issues involved and his practice experiences with this notable case.
First Lieutenant Ehren K. Watada was the first commissioned officer in the US armed forces to refuse to deploy to Iraq, in June, 2006, saying he believed the war to be illegal and that, under the doctrine of command responsibility, it would make him party to war crimes. He was brought before a court-martial in 2007 which ended in a mistrial, and was discharged in 2009.
Mr. Kagan has extensive trial and appellate practice experience in both the public and private sectors and in state and federal trial and appellate courts, as well as before state administrative agencies. He has been responsible for a number of published appellate court decisions, including the decision of the Washington State Supreme Court, Seattle v. Mesiani, wherein the Court ruled that DUI roadblocks are unconstitutional. In 1994 and 1995, he served as Disciplinary Counsel to the Washington State Bar Association. Since then, Mr. Kagan has developed expertise in additional practice areas, including legal ethics, professional licensing and discipline (representing, among others, doctors, lawyers, psychologists, therapists and counselors), and complex civil litigation, including medical malpractice and wrongful death.
