Anytime/Web - #Ethics: Effect of Corporate IT Policies on Otherwise Privileged Communications

Personal use of corporate IT resources has become commonplace and, in some instances, essential for busy employees. If the company has an IT monitoring policy, however, that policy could prevent any privilege from attaching to personal communications from company employees to third parties (attorneys, spouses) that pass through the company's server. Counsel should be aware of the effect these corporate IT policies have (or could have) on evidentiary privileges and, therefore, the scope of discoverable information in various litigation settings.

Jun 13/Boston, MA - Fair Debt #Collection Practice VLP Training

This training will prepare volunteer attorneys to assist low-income, unrepresented litigants in civil collection cases through VLP's Fair Debt Collection Lawyer of the Day project at the Boston Municipal Court.  The training will cover civil procedure and practice at the BMC, Limited Assistance Representation, as well as substantive areas of consumer and fair debt collection law that you will need as a volunteer.  Fair debt collection cases are a great opportunity for lawyers seeking courtroom experience.
Volunteer attorneys assist low-income debtors and creditors at the Boston Municipal Court in the Brooke Courthouse on Wednesdays from 9 a.m. to noon and 1:30 p.m. to 3 p.m. on a Limited Assistance Representation (LAR) basis.  LAR means that the attorney only represents the client in the proceeding (case management conference, motion, etc.) before the court that day.  The representation begins and ends on the same day.

Statutory Damages and the Tenenbaum Litigation

Joel Tenenbaum looks a lot like every other defendant who has been accused by the music industry of illegally sharing copyrighted work online, but with one key difference: his defense attorney is Harvard Law School Professor Charlie Nesson, and Nesson is out to turn his case into a public referendum not only on the music industry's efforts to enforce copyright through these direct-infringer suits, but also on the copyright rules that make the industry litigation possible.
This program engages Nesson's key arguments, focusing especially on Nesson's claim that copyright law's statutory damages regime runs afoul of constitutional protections against excessive and/or arbitrary civil damages awards.

June 1/NYC: Rivera v. Lutheran Medical Center - an #Ethical Issue: The Perils of Representing A Client's Employees

In Rivera, the Court concluded that a law firm representing a defendant violated New York’s attorney non-solicitation rules by contacting the defendant’s current and former employees and offering to represent them at depositions at the defendant’s expense. The Court referred the lawyers to the state disciplinary committee.

Winning Strategies provides attorneys with an array of continuing legal education topics central to the handling of federal criminal defense cases. The seminar employs plenary and break-out sessions on “nuts and bolts” defenses to firearms, drug, child pornography and immigration prosecutions, as well as more novel areas such as mortgage fraud, identity-theft, and more. Winning Strategies also provides guidance and insights to help practitioners safely navigate the post-Booker sentencing landscape. John Dean was White House Counsel in 1972 when five burglars were arrested at the Watergate Complex in Washington, D.C. He was 34 years old. Events that unfolded in the week following the break-in would lead directly to the resignation of Richard M. Nixon, the nation's 37th President. A conversation held in the Oval Office on Friday, June 23, 1972, would prove to be the final straw. Two years later, when a tape recording of the June 23 conversation was released, Nixon's support in Congress evaporated and he resigned. The tape became known as the "Smoking Gun" tape.

This CLE focuses on John Dean's involvement as counsel in the events that led up to the "Smoking Gun" conversation. During this one week, Dean met with all the major players, from John Mitchell to G. Gordon Liddy. He learned first-hand about what had taken place and who was involved. He handled critical evidence (E. Howard Hunt's safe), and met with the Attorney General and the head of the Criminal Division of the Department of Justice to track the government's investigation. He also had several meetings with the Acting Director of the F.B.I., L. Patrick Gray. Dean sat in on the F.B.I. interview of Charles Colson, Special Counsel to the President.

In short, this week provides a classic example of an internal investigation and brings up all the major ethical issues that any lawyer would face when representing an entity in which some of its constituents have been accused of wrongdoing. Who is the client? What are the lawyer's obligations of confidentiality? When can she report what he knows? Who in the entity is protected by the attorney-client privilege and who needs to be warned that the privilege belongs to the entity and not the individual (the so-called Upjohn warnings)? What are the lawyer's obligations to an investigating agency like the F.B.I.?
 
All these issues will be explored under today's standards and the Model Rules of Professional Conduct. This program has been approved by the Illinois MCLE Board for 3.75 hours of professional responsibility credit.

May 25/Web - The Federal Bureau of Prisons: An Overview Of #Drug Treatment (RDAP), Psychological And Medical Services For Inmates

"The Association of Federal Defense Attorneys (AFDA) is presenting a free online CLE on May 25, 2011, 11:00 a.m. Central Time, entitled: “The Federal Bureau of Prisons: An Overview Of Drug Treatment (RDAP), Psychological And Medical Services For Inmates.” Anyone is welcome to attend. The program will consist of an informal, 60-90 minute presentation by Dr. Gareth Lasky, Dr. B. Carl Gordon, and Dr. George H. Saltzberg.
Dr. Lasky worked for the BOP for 22 years, during which time he served as the Chief Psychologist at FCI Ashland and Drug Abuse Program Coordinator at FCI-Sheridan. While in the BOP, he completed over 1500 Residential Drug Abuse Treatment Program (RDAP) evaluations. Dr. Lasky will focus on the RDAP program during the seminar.
Dr. Gordon worked for the BOP for 25 years, during which time he served as a clinical psychologist, Drug Program Coordinator, and Chief Psychologist at FCI-Sheridan. He will focus on the Psychology Services department within the BOP facilities, including mental health screening and treatment.
Dr. Saltzberg retired from the BOP in 2005 after having served as the Clinical Director at FCI-Sheridan and FDC SeaTac. During the seminar, he will focus on medical services within the BOP, including medications and the process by which designations to federal medical facilities are made.
The program includes an online Question/Answer session where attendees may speak directly to the panelists, as well as post questions via a moderated chat room.
Apparently, the AFDA applied for CLE credit in California, but not in any other states. Thus, attendees seeking CLE credit in other states need to apply for it.

The Honorable Paul Michel currently serves as Chief Circuit Judge for the Federal Circuit and, in that role, has overseen a period of enormous growth and change in the patent system.

June 6/Boston, MA - New Panel #Attorney Orientation

This training course provides an introduction to working with the Volunteer Lawyers Project.
Taught by one of the VLP staff attorneys and the referral coordinator, this course provides an in depth look at everything you need to know in beginning your work with our organization. We will touch upon many frequently asked questions like: what types of cases does VLP work with, what it's like to work with interpreters, and where can I get help on this case. Along with that, this training will provide a space for new panel attorneys to ask any questions they may have about the way our organization works, the referral process and anything other questions that may arise.
This training is meant to provide an introduction to VLP, our services, and our clients. It will be held the first Monday of every month from 4pm-5pm. Seating is limited, so please register early to reserve your spot.

#Scholarships for ALI-ABA CLE Programs may cut or eliminate cost for eligible attorneys

"As a service to the legal profession, full and partial scholarships are available for ALI-ABA’s live courses, webcasts, and online CLE (on-demand web courses). In an effort to provide equal educational opportunities to all, ALI-ABA awards scholarships to those who otherwise may not be able to attend or participate in its high quality courses.

"Volunteer attorneys are eligible for one of three (3) free slots in exchange for accepting a pro bono case referral from a recognized pro bono legal services program.  Staff legal services attorneys (e.g., public defenders, prosecutors, Legal Aid Bureau, Public Justice Center, House of Ruth, etc.) may also register for one of three (3) discounted slots offered at 50% off the regular course cost.  Slots will be filled on a first-come, first-serve basis.
