Learn how to protect the rights of public assistance and food stamp applicants and recipients to these basic subsistence benefits. Many applicants have difficulty navigating the confusing and bureaucratic process to establish and maintain eligibility for public assistance and food stamps. Without legal assistance and advocacy, large numbers of clients go without the benefits to which they are entitled, resulting to increased hunger and homelessness.

• Basic eligibility rules: The application process, Due process in the public benefits context – Fair Hearings
• Written notice in Public Assistance and SNAP cases: Fair hearing basics, Digital due process – the impact of new technologies on the right to fundamental fairness, Article 78s
• The use of Article 78 proceedings to appeal fair hearing decisions and in cases of emergency
• Obtaining attorney’s fees in benefits-related Article 78 proceedings

All attorneys who work with low income clients will benefit from learning the basics of New York public assistance and food stamp law and policy. This course will provide an overview of the eligibility rules, the stages of the application and appeals processes, and the tools you need to assist clients with legal issues arising under these programs.
