December 2: NYC - eDiscovery & Technology: the Ethics of Search and Use of Effective Keyword Strategies

The escalation in the use of technology to create and share information is affecting the practice of law. To address this reality, in August 2012 the ABA Model Rule of Professional Responsibility 1.1 (competence) was amended in to focus attorneys on the need to stay aware of the risks and benefits of its use.
In litigation, especially, the use of technology for document review continues to be a topic of interest, both to law firms and the courts. How much does a lawyer need to know about the new and evolving eDiscovery search tools and how they work? How do you know if they’re doing a good enough job, and how do you know what’s good enough? Are these tools defensible?
In this CLE, Julia Brickell, general counsel and executive managing director at H5 and Dan Brassil, H5’s principal consultant and linguist, join forces to both explore the evolution of courts’ expectations on the use of technology in discovery—including the ethical issues related to the use of various tools—and to discuss how basic principles of linguistics and information retrieval science can be applied to the litigation discovery effort.

Since 1997, IPNW has obtained exonerations of thirteen men and women who collectively served over 90 years in prison for crimes they did not commit. 
  • Fernanda Torres is a Staff Attorney and Volunteer Coordinator at the Innocence Project Northwest (IPNW). She helps oversee the screening and review of applications for assistance and leads the litigation of non-DNA cases. She recruits and supervises IPNW volunteers.
