April 7: Cleveland - Issues in Post-Conflict and Small Island State Regulation of Telecommunications Markets

Description:
One of the greatest challenges faced by governments of post-conflict and small island nations (frequently referred to as Small Island Developing States, or “SIDS”) is attracting capital necessary for increasing job opportunities and prosperity for their citizens. Prompted in part by World Bank studies that claim a correlation between increased Internet penetration and economic growth, many of these countries view developing the information, communications and technology (“ICT”) sector of their economies as a critical component of ensuring domestic stability.
Undertaking ICT initiatives in such environments is not without risk. Governments seeking to attract investors through promises of high returns must also be sensitive to consumer demand for affordable and high quality service. Small market size makes monopolization an ongoing concern, and governments must be vigilant for anti-competitive conduct where competition exists. Perhaps most importantly, Internet-fueled exposure to ideas from developed nations often prompt calls for filtering and censorship antithetical to the investors’ core beliefs and in conflict with their business plans.
The presentation will provide an overview of the issues faced by regulators in Iraq, Afghanistan, and certain Caribbean SIDS as they attempt to balance the concerns of citizens, legislatures, investors, and the media when the complexities of the Information Age come to their countries.

Marc Lipton, a 1977 Case Law graduate, Member of the Order of Barristers, and winner of the school’s Heiss Labor Law Award, began his legal career at a small Chicago labor boutique, Edes and Rosen. He moved to in-house practice at Illinois Bell Telephone in 1979, and over the last thirty-plus years has actively participated in the legal, regulatory, and business decisions that prompted seismic change in the telecommunications industry and in the way people interact with one another. Issues that have crossed Marc’s desk include the post-divestiture restructure of the former Bell System, the deregulation of pricing, the development, regulation and censorship of the internet, the increasing demand for faster consumer broadband, and the rapid adoption and evolution of wireless technologies. He is licensed in both Illinois and Texas, where he worked for AT&T and its predecessor companies until 2011, when he retired as an Associate General Counsel. As part of the company’s community outreach when its headquarters shifted from San Antonio to Dallas, Marc served for three years as the volunteer supervising attorney for the Small Business Clinic at SMU’s Dedman School of Law and taught one semester of the school’s classroom course, “Counseling the Small Business Owner,” as an adjunct lecturer. He has also lectured on telecommunications law and regulation at DePaul, Seton Hall, and Northwestern University Law School.
Marc’s elected to leave AT&T to accept the opportunity to work for the United States Department of Defense and Department of State in Baghdad, helping those agencies advise the Iraqi government on growing and regulating its nascent telecom market. When the civilian contractors left Iraq ahead of the military withdrawal, Marc returned to the US, formed his own consulting firm, and won a series of World Bank-funded contracts to consult for the Afghan government in Kabul. He has spent most of the last three years advising Afghanistan’s Ministry of Communications and Information Technology and the Afghanistan Telecommunications Regulatory Authority on the subjects of Open Access, electronic government and market development. His most recent project takes him to the Caribbean, where the World Bank is funding three nations’ efforts to improve their internal government communications and increase internet penetration among their citizens.

Cleveland State University’s Cleveland-Marshall College of Law (1801 Euclid Ave.) will host “The History and the Future of the Ohio Constitution,” Wednesday, March 4 at 5 p.m. in the school’s Moot Court Room. The lecture, co-sponsored by the League of Women Voters of Greater Cleveland, will be presented by Dean Emeritus Steven Steinglass, senior policy advisor for the bipartisan Ohio Constitutional Modernization Commission.
His talk will review the history of constitutional revision in Ohio from 1802 to the present. The discussion will focus on the Ohio Constitutional Modernization Commission’s current efforts to revise the constitution on a wide range of issues, including congressional redistricting, term limits, privacy, voting, the initiative/referendum, and education.

Recent years have seen a proliferation of transitional justice mechanisms--from truth and reconciliation commissions to national prosecutions, ad hoc international tribunals, and now a permanent international criminal court—all aimed at realizing the promise of smooth and lasting transition to peaceful, democratic governance in countries emerging from conflict and gross violations of human rights. But ensuring that transitional justice truly moves societies to a lasting rule of law poses abundant practical, political, legal, and cultural challenges. This is a full-scope project in which the volunteer can take the case from start to finish. Depending on the circumstances of each case, cases can last for weeks, months or even years. Before you volunteer with this project, we ask that you attend this free MCLE training session.
This training will be given by JDC’s Supervising Attorneys who will go over the volunteer procedures as well as the forms for completing a simple divorce. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site. February 28: Seattle - Regional Representation in Mediation Competition #MCLE Opportnity

Want to help law students learn how to be representatives in mediation?  Want to be of service?  We need you!
 The University of Washington Moot Court Honor Board and the ABA Section of Dispute Resolution seeks experienced lawyers and mediators for the Regional Representation in Mediation Competition, February 28, 2015, at the University Of Washington School Of Law.
In this competition, law students role-play as attorneys and clients in a mediation setting.  The competition measures how well law students model appropriate preparation for and representation of a client in mediation.  The competition will bring law student competitors from various law schools in the Western region, including UC Berkeley and Chapman University.   We welcome attorneys from all practice areas to participate.
Volunteers are needed for both morning and afternoon sessions of competition.  The morning round begins at 8AM and ends at 12PM.  The afternoon round begins at 1PM and ends at 5PM.  There will be a training meeting prior to the start of each round where snacks and beverages will be provided. Judge volunteers that participate for both rounds will receive lunch.  All judge volunteers are welcome to attend the evening reception at 5PM where competition finalists will be announced.

The Mock Trial Competitions are two of five annual in-house competitions hosted by the Moot Court Honor Board to provide students with the opportunity to gain first-hand experience with a variety of practical lawyering skills. Students form teams of two and are provided the mock trial problem in advance. Teams must prepare an opening statement, direct examination of two witnesses, cross examination of two witnesses and closing arguments. The competition features two preliminary rounds and three elimination rounds (quarterfinal, semifinal, and final).
As a judge, you will provide feedback and evaluate the participants’ performance. We welcome attorneys from all practice areas. We will provide you with details regarding the problem and fact pattern in advance of the competition.
Judging for a UWLS competition is an opportunity to provide law students with valuable feedback on their trial advocacy skills. Volunteer judges are also invaluable to the continued success of the Moot Court Honor Board and the in-house competition program.

March 26: San Francisco - Substance Abuse in the Legal Profession: Prevention, Detection, and Treatment

In this presentation, Mr. Mann provides a review of the brain chemistry of addiction and alcoholism, as well as a discussion of the behavioral and health consequences of the disease. Insights are offered into the personality traits of attorneys and the qualities of the legal profession that combine to make lawyers significantly more susceptible to addiction, and more difficult to treat, than the general population.
The presentation includes a case study of an addict attorney, as well as a self-diagnosis exercise for attorneys to utilize if they are concerned that they may have a problem which needs to be addressed. Concluding remarks are directed towards both systemic and individual solutions to the problem, with references to specific strategies and resources available to attorneys. Mr. Mann approaches this very serious topic in a manner that incorporates humor and irony and invites attorneys to engage in a bit of sometimes much-needed self-reflection.
All active ALRP Panel Attorneys and associates at partner pro bono law firms are welcome to attend any of ALRP’s free MCLE trainings.   • California: Program is eligible for California CLE credit only if the attorney is calling in from outside of California. The program cannot be taken for California credit if you call in from California.
  • Colorado: Colorado attorneys should submit a Colorado Affidavit form along with a statement certifying that the CLE program is accredited in another mandatory CLE state.
  • Florida: Courses approved by other state bars are generally acceptable for use toward satisfying CLE requirement but attorneys must first submit a CLE Application for Course Attendance Credit.
  • Hawaii: Program is eligible for Hawaii CLE credit only if the attorney is calling in from outside of Hawaii. The program cannot be taken for Hawaii credit if you call in from Hawaii.
  • Iowa: 1.0 CLE credit applied for
  • Maine: Credit hours for activities approved by another MCLE state will be accepted for identical credit by the Board of Overseers of the Bar in Maine upon the Board's receipt of evidence of such certification as issued by that state
  • Minnesota: 1.0 CLE credit applied for.
  • Montana: Montana will honor the approval given by other CLE jurisdictions. Simply attach documentation of the other state's approval to your affidavit at the end of the reporting year.
  • New Jersey: New Jersey attorneys who are taking courses approved for CLE by another state will receive 1:1 credit for courses approved in that jurisdiction through reciprocity.
  • New York: Attorneys may claim New York CLE hours for programs accredited Wisconsin.
  • Wisconsin: 1.0 CLE credit applied for.

February 19: Webcast - The 2015 Measles Outbreak: Exploring the Role of Public Health Law

From January 1 to January 28, 2015, 84 people from 14 states were reported to have measles, a highly contagious respiratory virus which was declared eliminated in the United States in 2000. Most of these cases are part of a large, ongoing outbreak linked to an amusement park in California. Measles is a vaccine-preventable disease, but many parents choose to opt-out of immunizing their children. This webinar examines the current measles outbreak in the U.S. and associated legal issues. Speakers will describe current vaccination recommendations, provide an overview of vaccination laws and exemptions, explore state temporary exclusion laws related to unvaccinated students, and highlight lessons learned by LA County in implementing legal disease control measures.

March 7: Austin - Voting Rights Institute

The landmark Voting Rights Act of 1965 is undoubtedly one of the most successful civil rights laws in our Nation’s history, and remains an important piece of national legislation that is still relevant today. However, the Supreme Court’s 2013 decision in Shelby County v. Holder effectively nullified the Act’s special preclearance provisions. As a result, until Congress amends the Act, voting rights litigation will be the only path available to minority voters seeking to protect their rights against discriminatory voting laws.
Help respond to this voting rights crisis by joining the American Constitution Society in a training program, taught by some of the most respected voting rights practitioners in the country. This training will arm attendees with the tools and tips necessary to become active members of the voting rights bar, and will provide an opportunity for new and returning members of the voting rights community to meet and strategize about the challenges to come. March 6: Cleveland + Web - Religion in the Public Square

Description:
Religion is often invoked in many major political and legal issues in America today, including abortion, the death penalty, and same-sex marriage. Many people object that appeals to religion in public debate are unfair because religious reasons are not comprehensible to all citizens, and to impose laws on citizens for reasons they cannot understand is unjust. In this view, people of faith may speak in the public square only if they first expunge religious appeals and present only secular reasons for their positions. Others argue that religious appeals are just as comprehensible as other reasons and that religion is as valid and reasonable a source of norms as are secular doctrines. In this view, excluding religion from public debate treats people of faith as second-class citizens who must either keep silent or translate their speech into a language that is foreign to them.
This program will present speakers on both sides of the issue and give members of the audience opportunities to raise questions.

March 18: Cleveland - Copyright's First Sale Doctrine in the Digital Economy #MCLE

The first sale doctrine in copyright law has enabled resale, rental, and lending of books, movies, and other copyrighted material for centuries. But as digital distribution overtakes traditional analog sales of media, what is the future of consumer property interests in the digital content they acquire. This lecture will consider potential judicial, legislative, and market responses to the growing tension between consumer and copyright holder interests.

Speaker:
Aaron Perzanowski, Associate Professor of Law, Case Western Reserve University School of Law, teaches courses in intellectual property and telecommunications law. His research examines the influence of law and technology on the creation and exchange of information goods. His work has been published in law reviews and top specialty journals at Harvard, UC Berkeley, University of Pennsylvania, Northwestern University, UCLA, University of Minnesota, and UC Davis. Prior to his teaching career, he served as the Microsoft Research Fellow at the Berkeley Center for Law & Technology and practiced law at Fenwick & West in Silicon Valley.
