  • Nicolle L. Jacoby is the co-head of Dechert's Labor and Employment practice. Her practice focuses on employment-related matters, including conducting internal investigations into allegations of employee misconduct and litigating high-stakes discrimination cases, contractual disputes with executives, and non-compete, non-solicit and trade secret cases in the courts as well as in mediation and arbitration. Ms. Jacoby also regularly represents employers in proceedings before the Equal Employment Opportunity Commission, New York City and State Human Rights Commissions and other regulatory agencies. She also counsels companies on managing whistleblower claims, high-risk terminations and severance arrangements; advises on compliance with federal and state anti-discrimination and other labor and employment laws; and drafts severance and employment agreements, and personnel policies and procedures. Ms. Jacoby regularly counsels and defends financial institutions, including hedge funds, investment advisers and a wide range of public and private companies, in connection with disputes with current and former executives, and has managed a variety of employment-related disputes in litigation, arbitration and mediation. Ms. Jacoby leads investigations into allegations of sexual harassment and other employee misconduct and advises public and private companies on compliance with federal and state anti-discrimination laws. She represents clients in diverse fields including investment banking, financial services, media and entertainment, insurance, pharmaceuticals, and health care.
  • J. Ian Downes practices in the area of labor and employment law, with a focus on ERISA litigation and labor-management relations. He has significant experience with ERISA and wage-and-hour class actions, as well as in representing clients in all types of labor and employment litigation. Mr. Downes devotes a significant portion of his practice to providing clients with day-to-day assistance and counseling concerning all varieties of labor and employment issues, including negotiation and drafting of employment agreements and restrictive covenants, planning and implementing reductions in force and complying with the Worker Adjustment and Retraining Notification (WARN) Act and state and local plant closing laws, and handling of employee complaints and discipline issues.
  • Jeffrey W. Rubin represents employers in state and federal courts and agencies in employment and labor matters ranging from employment discrimination and wage-and-hour disputes to non-competition litigation. Mr. Rubin devotes a significant portion of his practice to counseling employers on personnel issues to prevent disputes from arising and ensure ongoing compliance with legal requirements. He has extensive experience advising clients on wage-and-hour issues, proper classification of personnel, and restrictive covenants.
  • Linda Dwoskin's practice includes both litigation and counseling on a wide variety of employment and labor issues, including all forms of discrimination, sexual harassment, disability claims, restrictive covenant issues, the Worker Adjustment Retraining and Notification Act and the Family and Medical Leave Act. Linda also regularly conducts training programs nationwide and both conducts and advises on internal workplace investigations involving sensitive topics and high-level managers. As part of her litigation practice, she has represented employers ranging from small companies to multinational corporations, and she has litigated matters before the U.S. Supreme Court, the Third Circuit Court of Appeals and a number of state and federal trial courts, as well as state and federal administrative agencies. As part of her counseling function, Ms. Dwoskin drafts and revises policy manuals, employment and separation agreements, confidentiality agreements and restrictive covenants. She advises companies on conducting reductions in force and reorganizations and handling challenging leave and accommodation issues. Ms. Dwoskin develops and conducts educational and interactive employment-related training programs on topics such as sexual harassment, the ADA and requests for reasonable accommodation, the FMLA and equal employment opportunity and fair employment practices.
