The past couple of years have seen a trend with states passing legislation or engaging in executive action to limit the enforceability of non-compete/non-solicit agreements in many circumstances. Even more recently, there has been an uptick in liability – and, particularly, criminal liability – with no-poach agreements entered into between companies.
