January 29: Breached! Cybersecurity 101

With data security incidents and data breaches happening daily, it’s important for attorneys to turn towards one reality—it’s NOT IF a breach or incident will occur—it’s WHEN. These incidents are forcing government agencies, companies, law firms, etc. to address, define, and handle these challenges. As cloud technology and big-data analytics have become the norm, cybersecurity risks have increased and it is more important than ever to have both an avoidance and a response plan in place.

November 6: Energy Tax Credits: Insights and Recent Developments

The Inflation Reduction Act of 2022 enacted tax provisions to incentivize a wide range of clean energy technologies, constituting approximately $300 billion of the climate-related expenditures implemented by the legislation.
This program will provide an overview of recent developments in the clean energy industry in the United States and a deep dive into the clean energy tax credits that have been enacted, expanded, or enhanced by the Inflation Reduction Act. We’ll discuss current and forthcoming guidance from the IRS and Treasury on a number of topics including the investment tax credit (“ITC”), the production tax credit (“PTC”) and base and bonus credits for solar, wind and other clean energy technologies. Finally, the program will review practical resources to assist practitioners in dealing with renewable energy tax credit tasks to assist you in successfully navigating any of the challenges that can occur in a project. December 4: Antio v. Department of Revenue: A Significant Tax Case with Far-Reaching Implications

On October 24, 2024, in a 7-2 decision, the Washington State Supreme Court upheld the Department of Revenue’s reversal of its long-standing interpretation of the Business and Occupation (B&O) tax investment deduction in Antio LLC v. Department of Revenue, Wash., No. 102223-9. 
Before the decision, the Department had allowed the deduction for any investment income, so long as the taxpayer was not a banking, lending, or security business as defined in legislation from 2002. This decision greatly narrows the deduction. This new interpretation of the deduction greatly increases the B&O tax liabilities of a wide variety of taxpayers and creates significant uncertainty regarding the scope of the deduction.
