August 29/Seattle: Ensuring Equal Access to Washington Courts for Persons with Disabilities and the Implementation of General Rule 33 #MCLE


GR 33 provides a mechanism for persons with disabilities to request accommodations from a Washington State Court. There are several aspects to the rule, but perhaps the most intriguing is that it permits (and sometimes mandates) the court to appoint a lawyer to a person with a disability in a civil case, at no cost to the disabled person.
The Honorable Anne Ellington, Division One of the Court of Appeals, and David Lord of Disability Rights Washington will describe the origins, purpose and use of the rule in obtaining accommodations needed for equal access to the justice system by people with disabilities. Speaker Bruce Moran is the Deputy Court Administrator for Pierce County Superior Court and has been involved in implementing the rule on the ground in Pierce County.

Fatou Bensouda of The Gambia is Prosecutor Elect of the International Criminal Court (ICC). She has been Deputy Prosecutor since 2004, in charge of the Prosecution Division of the Office of the Prosecutor. Earlier, Ms. Bensouda worked as a Legal Adviser and Trial Attorney at the International Criminal Tribunal for Rwanda (ICTR) in Arusha, Tanzania, rising to Senior Legal Advisor and Head of The Legal Advisory Unit. Before joining the ICTR, she was the General Manager of a leading commercial bank in The Gambia. Earlier, she was Senior State Counsel, Principal State Counsel, Deputy Director of Public Prosecutions, Solicitor General, and Legal Secretary of the Republic, then Attorney General and Minister of Justice, in which capacity she was Chief Legal Advisor to the President and Cabinet of The Gambia. Ms. Bensouda also took part in negotiations on the treaty of the Economic Community of West African States (ECOWAS), the West African Parliament, and the ECOWAS Tribunal. She has been a delegate at U.N. conferences on crime prevention, human rights, and the ICC. Ms. Bensouda holds a masters degree in International Maritime Law and Law of The Sea.

The lecture also touches upon key issues related to software and music protection.     First Program Title:
    Introduction to Landlord Tenant Training
    LSP's full scope Eviction Defense Project provides representation to clients during their eviction proceedings. These cases provide excellent litigation experience as the procedures are the same as those involved in business litigation-discovery, motions, settlement, and trial-on a more manageable level. Before you volunteer with this project, we ask that you attend this free MCLE training session.
    This training will be given by VLSP’s Supervising Attorney who will go over the volunteer procedures as well as the different types of cases we place with volunteers. The substantive portion of the training must be viewed ahead of time on the Practising Law Institute’s Web site.     Housing Negotiation Project training
    VLSP's Housing Negotiation Project is a limited-scope project providing representation to individuals and families facing eviction. Representation is limited to settlement conferences only. HNP is the first pro bono project of its kind, and is a project in which every single person in need of representation has a pro bono attorney. Volunteer shifts are Wednesday and Thursday afternoons from 12:30 - 4:30 p.m. During one shift, a volunteer will represent one to three clients. It is an excellent opportunity to get valuable negotiation experience without a large time commitment. Volunteers must attend our free CLE training before volunteering for this project. After attending the training, we ask our volunteers commit to 4 afternoon sessions within 6 months.

    August 8/San Francisco: Forced Arbitration Today: Where Workers Stand

    In the year after the Supreme Court’s decision in the consumer class action case, Concepcion v. AT&T Mobility, 131 S. Ct. 1740 (2011), courts around the country have erected new barriers to employees seeking to vindicate their rights under worker protection laws. While the rulings have not sounded the death knell for class actions, they have generally made it more difficult for employees to have their day in court and shine a light on corporate misconduct. Meanwhile, several rulings have also limited the reach of Concepcion in the employment context including the National Labor Relations Board’s landmark decision in D.R. Horton, Inc. and California state court decisions, like Brown v. Ralphs, 197 Cal. App. 4th 489 (2011).
    As the Arbitration Fairness Act continues to inch its way through Congress, join us for a brown bag discussion of the current state of employee rights in the arbitration context, what advocates can do to keep the courthouse doors open for workers, and explore legal strategy for fighting forced arbitration.
    The Access to Justice series will focus attention on ways to ensure that our justice system is truly available to all.  Programs in the series will highlight barriers to access to our civil justice system, including efforts to strip courts of jurisdiction, raise procedural hurdles, remove classes of cases from federal court, insulate wrongdoers from suit, limit remedies and deprive legal aid services of resources.

    Ovie Carroll has over 20 years of federal law enforcement experience. Ovie was a special agent for the Air Force Office of Special Investigations (AFOSI) and Chief of the Washington Field Office Computer Investigations and Operations Branch responsible for investigating all national level computer intrusions into USAF computer systems. Following his career with the AFOSI he was the Special Agent in Charge of the Postal Inspector General’s computer crimes unit where he was responsible for all computer intrusion investigations and for providing all computer forensic analysis in support of USPS-OIG investigations. Ovie is currently the Director for the Cybercrime Lab at the Department of Justice, Computer Crime and Intellectual Property Section (CCIPS) and an adjunct professor at George Washington University teaching computer crime investigations. In addition to his career fighting computer crime, Ovie has conducted investigations into a variety of offenses including murder, fraud, bribery, theft, gangs and narcotics.
