Human trafficking is global crisis. The International Labor Organization has estimated that there are 20.9 million victims worldwide. The number of trafficking cases being prosecuted by the U.S. government has seen an increase since the passage of the Trafficking Victims Protection Act of 2000. In this program, President of The Human Trafficking Pro Bono Legal Center, Martina Vandenberg, discusses the state of human trafficking law in the United States and debunks many of the myths surrounding it. Ms. Vandenberg not only covers criminal prosecutions, but discusses civil actions as well, giving particular focus to restitution and the calculation of damages. A number of key cases are discussed in depth, as are the statistical occurrences and outcomes of human trafficking cases.

November 18: Webcast - Providing Respectful and Culturally Competent Services to LGBT Clients #MCLE

Lesbian, gay, bisexual, and transgender (LGBT) people are incredibly diverse, are found in all communities, and have a variety of legal needs. Unfortunately, a common difficulty for LGBT people with legal problems is finding an attorney with the appropriate legal expertise who is also LGBT-friendly and culturally competent. Becoming more familiar with LGBT communities and issues facing LGBT people is key for attorneys to increase access to justice for LGBT people.
The presentation will explain the basics of culturally competent legal services for lesbian, gay, bisexual and transgender clients. Please join Lisa J. Cisneros of California Rural Legal Assistance and Ming Wong of the National Center for Lesbian Rights for this presentation. By the end of the session participants should be able to:
  • understand the differences between sexual orientation and gender identity;
  • develop strategies for outreach to LGBT communities; and
  • develop ideas for how to modify their practices, including intake, to provide quality services to LGBT clients.

December 3: Webcast - Navigating Patent Potholes Along the FDA’s Proposed ANDA / 505(b)(2) Pathway

The FDA has released new rules regarding the procedures for approval of an Abbreviated New Drug Application (ANDA) and a 505(b)(2) application implementing the Medicare Prescription Drug, Improvement, and Modernization Act (MMA). The U.S. Patent and Trademark Office in turn has created new procedures and other ways by which they cancel, modify, and administer patent rights. The USPTO’s actions have created potholes along the FDA-proposed pathways for pharmaceuticals companies and generics manufacturers attempting to maintain monopolies. These USPTO activities may also provide an express lane for new startups in the pharmaceutical space.
The webinar will cover these topics and more:
  • Newly listed patents in the Orange Book and the ability to catch up to first applicants
  • Breaking through settlement roadblocks with AIA post-grant procedures
  • Newly listed and issued patents downshifting ANDAs into tentative approvals
  • Express lane for 505(b)(2) applicants.

November 12: Webcast - The Cargo Cult of Legal Marketing Regulation (#ethics)

Hosted by:

General Counsel &
VP of Business Development,
Avvo
“Cargo Cults” of the Pacific attempted to bring back the material abundance islanders had enjoyed during WWII by replicating the circumstances associated with those outcomes. Similarly, attorney regulators often enforce outdated legal marketing regulations despite the abscence of harm that those regulations were originally designed to prevent.

Lawyers who attend this webinar will learn about:
  • How historic prohibitions on "runners and cappers" are being used to squelch today's performance-based advertising methods.
  • The prevalence of mechanically applying rules in situations where there is no risk of consumer harm.
  • A new approach bars could use to protect consumers AND the free speech rights of attorneys.

November 2: Webcast - Wrongful Conviction 2015: Litigating Claims of Innocence

The conviction of innocent individuals is among the issues getting increased attention as our nation looks more closely at our criminal justice system. While there are a number of ways individuals can be wrongly convicted, successfully reversing a conviction is incredibly difficult. This is an area where competent legal representation can make a big difference and where there are myriad opportunities for lawyers interested in providing pro bono legal services. Many of the recent DNA and non-DNA exonerations have occurred as a result of work from innocence organizations in collaboration with pro bono partners.
What You Will Learn:
  • The contributing causes of wrongful conviction and how to recognize these issues
  • Using DNA to show innocence
  • Post-conviction re-investigation and fact development
  • How to find and use non-DNA evidence of innocence to exonerate the wrongly convicted
  • Litigating eyewitness identification cases

This program is designed for lawyers who advocate post-conviction claims of innocence or who are interested in getting involved in this area. Prisoners’ rights advocates, as well as lawyers or law students considering pro bono representation or who want to hear about the legal issues that arise in connection with exoneration work will find this program especially valuable.

November 10: San Francisco - Representing Unaccompanied Minors and Families on the “Surge” Docket #probono

Since the beginning of 2014, there has been a dramatic increase in unaccompanied children and families with young children fleeing to the United States. Most of the migrants are from Guatemala, El Salvador, Honduras, and Mexico. Pursuant to a Department of Justice initiative, these children and families are detained and placed in expedited removal proceedings before an Immigration Judge. Most can expect to have their hearings within a year.
Through its Unaccompanied Minors/Families Program, Asian Pacific Islander Legal Outreach has represented over a hundred individuals currently on the “Surge” docket in San Francisco Immigration Court. Learn how you can contribute by volunteering as a pro bono attorney.
